Cooke's Estate.
An ingrossed Bill from the Lords, intituled, An Act for the enabling of Trustees to sell certain Lands of Richard Cooke, Esquire, deceased, to pay Debts, to raise a Portion for his Daughter, was read the Third time.
Resolved, That the said Bill, with the Amendment, do pass: And that the Title be agreed to.
Ordered, That Sir Rob. Davers do carry the Bill to the Lords; and acquaint them, That this House hath agreed to the Bill, with the said Amendment; and desire their Lordships Concurrence to the said Amendment.
Vexatious Suits for acting in Defence of the Kingdom.
Ordered, That the ingrossed Bill from the Lords, intituled, An Act for preventing vexatious Suits against such as acted for their Majesties Service in Defence of the Kingdom, be read the Second time upon Monday Morning next, at Ten of the Clock.
Bagnall's Estate.
An ingrossed Bill to bar a Remainder limited to Dudley Bagnall, Esquire, in the Estate of Nicholas Bagnall, Esquire, in Ireland, was read the Third time.
Resolved, That the said Bill do pass: And that the Title be, An Act to bar a Remainder limited to Dudley Bagnall, Esquire, in the Estate of Nich. Bagnall, Esquire, in Ireland.
Ordered, That Sir Rob. Cotton do carry the Bill to the Lords; and desire their Concurrence thereunto.
Earl of Salisbury's Estate.
Mr. Dalben reports from the Committee to whom the ingrossed Bill from the Lords, intituled, An Act to limit the Power of James, now Earl of Salisbury, to cut off the Intail of his Estate, was committed, That the Committee had considered thereof, and of the Petitions referred to them: And that they had agreed upon several Amendments, and Clauses to be added to the Bill; which they had directed him to report to the House: And which he read in his Place, with the Coherence; and afterwards, delivered the said Amendments and Clauses in at the Clerk's Table: Where the same were all read throughout; and are as followeth; viz.
Press last, Line 40, before "provided," insert "and the respective Rents therein reserved shall, after the Death of the said Earl, be due and payable to such Person or Persons, who, by virtue of the said Settlement, shall be seised of the Freehold of the Premises in such Lease or Leases to be comprised."
A Proviso, That the said James, now Earl of Salisbury, to demise or grant any the Manors, Lands, and Premises, except what comprised in the common Recoveries, and demised by the Earl his Father; for the like Terms, Conditions, and Rents reserved, as formerly they have been by the said James late Earl the Father.
A Proviso to enable James, now Earl, to lease several Houses and Gardens in Heming Row, and St. Martin's Lane, for Thirty Years and a Half, to commence from Michaelmas last; reserving the Rents now paid for the same subject to the Trust, towards raising Portions.
A Clause to disable Robert, Wm., Charles, and George Cecill, Esquires, to bar or dock any the Estate Tail, or Remainders limited by the Settlement, unless he to whom the next Estate of Freehold and Inheritance in Remainder ought to descend, shall, or at any time be, or become a Papist; but may respectively be impowered, when in possession of the Premises, to demise and charge the same, towards making Provisions for Jointures and Portions, as the said James, now Earl, is impowered to do.
The said Amendments and Clauses being severally read a Second time, one by one; the same were, upon the Question severally put thereupon, agreed unto by the House.
Ordered, That the said Clauses be ingrossed.
Ordered, That the Bill be read the Third time upon Tuesday Morning next, at Ten of the Clock.
Hildyard's Estate.
An ingrossed Bill from the Lords, intituled, An Act to enable Philip Hildyard, Esquire, to sell Lands in Surrey, and to settle Lands in Lincolnshire, in lieu thereof, was read the Third time.
Resolved, That the Bill do pass: And that the Title be agreed to.
Ordered, That Sir Fran. Vincent do carry the Bill to the Lords; and acquaint them, That this House hath agreed thereunto, without any Amendments.
Southwarke Court of Conscience.
Ordered, That the ingrossed Bill for erecting a Court of Conscience in the Borough of Southwarke be read the Third time on Monday Morning at Nine a Clock; and nothing to intervene.
Supply Bill; Low Wines.
A Bill for laying several Duties on Low Wines, or Spirits of the First Extraction, was, according to Order, read the Second time.
Resolved, That the Bill be committed to a Committee of the whole House.
Resolved, That this House will, upon Tuesday Morning at Eleven a Clock, resolve itself into a Committee of the whole House, to consider of the said Bill.
Offences at Sea.
Resolved, That a Committee be appointed to inspect the Laws relating to the Tryal of Offences committed upon the Sea; and to consider of the Defects thereof; and to report their Opinions therein to the House; and how the same may be cured and remedied.
And it is referred unto Sir Tho. Clarges, Mr. Hawtry, Mr. Solicitor General, Sir Rich. Temple, Mr. Harcourt, Sir Wm. Poultney, Colonel Churchill, Colonel Granvile, Sir Rob. Holmes, Serjeant Trenchard, Sir Jerv. Elwes, Mr. Clarke, Mr. Vice Chamberlain, Mr. C. Mountague, Mr. Chancellor of Exchequer, Admiral Russell, Sir Edw. Seymour, Sir Hen. Goodricke, Lord Falkland, Mr. Christie, Serjeant Wogan, Sir Rob. Rich. Mr. Kenyon, Sir Rich. Onslow, Mr. Clerke: And they are to meet this Afternoon at Five of the Clock, in the Speaker's Chambers; and to make their Report with all convenient Speed.
Leave of Absence.
Ordered, That Colonel Stanley have Leave to go into Holland, to his Command there, in their Majesties Service.
Supply Bill; East India Goods.
Then the House resolved itself into a Committee of
the whole House, to proceed further in the Consideration
of the Bill for granting certain new Impositions to their
Majesties upon all East-India Goods, and other Goods
and Merchandize.
Mr. Speaker left the Chair.
Mr. Solicitor General took the Chair of the Committee.
Mr. Speaker resumed the Chair.
Mr. Solicitor General reports from the said Committee,
That they had gone through the said Bill; and that he
was ready to make his Report thereof to the House: And
that they had directed him to move the House, That a
Clause might be brought in for appropriating Part of the
said Duties to the Use of the Navy.
Ordered, That a Clause be prepared and brought in accordingly.
Ordered, That the Report of the said Bill be made upon Monday Morning next, at Ten of the Clock.
Supply Bill; Wine Duties, &c.
Resolved, That this House will, upon Monday Morning next, at Eleven a Clock, resolve itself into a Committee of the whole House, to consider of the Bill for continuing the Impositions upon Wines, Vinegar, and Tobacco.
Aulnage Duty.
Ordered, That Sir Cha. Bloys, Mr. Sandford, Mr. Clarke, Sir Ralph Dutton, Mr. Bayle, Mr. Piggott, be added to the Committee to whom the Bill for transferring the Duty and Subsidy of Aulnage to the Customhouse, is committed.
Debtors Escapes.
Ordered, That the Committee to whom the Bill for the better preventing Escapes of Prisoners in the Prisons of the King's Bench and Fleet, is committed, be revived; and do sit, in order to adjourn till Monday Morning next.
And then the House adjourned till Monday Morning, Eight of the Clock.
