Harbin's Estate.

A BILL to enable John Harbin Esquire to make Sale of his Lands to pay his Debts, and make Provision for younger Children, was this Day read the Second time.

Resolved, That the said Bill be committed to Sir William Doyle, Sir William Lewes, Sir Hugh Windham, Mr. Churchill, Mr. Reyms, Mr. Swanton, Sir John Goodrick, Sir John Strangwayes, Mr. Giles Strangwayes, Mr. Morton, Mr. Geoffery Palmer, Sir John Brampston, Colonel Francis Windham, Dr. Craddock, Sir Robert Atkins, Mr. Yorke, Mr. Wm. Lowther, Sir Edmond Peirce, Sir Solomon Swale, Sir Humphrey Winch, Mr. Milward, Sir Thomas Meres, Mr. Lewis Palmer, Mr. Crouch, Sir Benjamin Ayloff, and all the Knights, Citizens, and Burgesses, that serve for Sommersetshire: And they are to meet in the Queen's Court at Two of the Clock this Afternoon: And have Power to send for all Parties concerned, Papers, Witnesses, and Records.

A Bill for Confirmation of certain Decrees made for the Level of Ancolne, was this Day read the Second time.

A Bill for the naturalizing of Renee de Sabran, being this Day read the First time;

Resolved, That the said Bill be read again the Second time To-morrow Sevennight.

Northampton Election.

Serjeant Charleton reports from the Committee for Privileges and Elections, touching the Return for the Town of Northampton, That, to the Indenture returned by the Sheriff, wherein Sir John Norwich and Sir James Langham were named, there was mention made, as if the Mayor who is the proper Officer, had joined therein; and Wax, with a Paper about it, was affixed with a Label thereunto, but not the Mayor's Seal; and that, to the other Indenture, brought in by the Mayor, and owned by him, whereby Sir James Langham, and Mr. Francis Harvey, were returned as Burgesses for that Place, the Mayor's Seal was affixed; that the first Indenture came to the Sheriff's Hand the Fourth of May, and the latter not till four Days after; that the Precept not being returned with the Indenture, and the Mayor having printed a Paper against the Sheriff, and refusing to come to speak with him, to give him Satisfaction about the Return, he forbore to return the latter, until he, being scandalized in Print, had publickly vindicated himself; and the Opinion of the Committee, that the Sheriff is not guilty of any Misdemeanor that deserves the Censure of this House.

Resolved, That this House doth agree with the Committee, that the Sheriff is not guilty of any Misdemeanor, that deserves the Censure of this House.

And the said Serjeant Charleton further reporting from the said Committee, as their Opinion, That the said Sir James Langham, and Mr. Francis Harvey, being returned by the proper Officer, ought to sit, until the Merits of the Cause touching the Election be determined; and that the Indenture, whereby they are returned, ought to be put upon the File; and that the other Indenture, wherein Sir John Norwich was named, not being made by the proper Officer, was but in the Nature of a Certificate; so as he ought not to sit, until the Merits of the Cause be determined; and that that Indenture ought to be withdrawn.

Resolved, That this House doth agree with the said Committee, that the said Sir James Langham, and Mr. Francis Harvey, being returned by the proper Officer, ought to sit in this House, until the Merits of the Cause touching the said Election be determined; and that the Indenture whereby they were returned, ought to be put upon the File; and that the other Indenture, wherein Sir John Norwich was named, not being made by the proper Officer, was but in the Nature of a Certificate; and that he ought not to sit, until the Merits be determined; and that that Indenture ought to be withdrawn.

And the Clerk, attending with both Returns at the Table, did accordingly file the Return made by the Mayor, and took the other Certificate from off the File.

Members taking the Communion.

Sir Ralph Ashton, one of the Members of this House, desired he might be admitted to shew his Reason why he could not (as his particular Case was) with a good Conscience receive the Communion, as he was enjoined by the Order of this House.

Whereupon some other Members going about to draw into Debate the Order of this House, made the Thirteenth of May Instant, for all the Members of this House to receive the Communion, which is to be administered according to the Form prescribed in the Liturgy of the Church of England on Sunday next;

The Question was put, That Liberty should be given to debate again the said Order;

And it passed in the Negative, that there should not be any Liberty given to debate the same.

Militia.

Resolved, upon the Question, that the Bill for settling the Forces in the several Counties of this Kingdom, be committed to a Committee of the whole House; to proceed de die in diem, at Ten of the Clock, till the same be completed.

Whereupon Mr. Speaker left the Chair:

And the House was resolved into a Grand Committee.

After which, Mr. Speaker taking the Chair again.

His Majesty's Solicitor General made Report from the said Committee of the whole House, That the said Committee had taken the said Bill into their Consideration; and made some Proceedings therein. Thereupon

Resolved, That this House be adjourned till Friday Morning, at Eight of the Clock.
