Oath in Customs.

AN Act, enabling the Commissioners of the Customs to give an Oath, was this Day read the First and Second time; and, upon the Question, passed.

Dean and Chapters Lands.

The House this Day resumed the Debate upon the Bill for Sale of Dean and Chapters Lands.

A Proviso was tendered to the Bill for abolishing Deans and Chapters, and Sale of their Lands, for one House, wherein Dr. Steward late lived, adjoining to the Abbey of Westminster, to be vested in the Trustees, and their Heirs, to the Use of the Serjeant at Arms attending the Parliament for the time being; to be held and enjoyed by him as incident to his Office: Which was this Day read the First and Second time; and, upon the Question, assented unto; and ordered to be Part of the Bill.

A Proviso was tendered to the said Act for Sale of Deans and Chapters Lands, That this Act extend not to the Dwelling-houses and Gardens settled by the Committee of Westminster upon the Two Ministers that preach on the Lord's Day in the Abbey Church: Which was twice read.

And the Question being propounded, That the said Proviso be read the Third time;

The House was divided.
The Yeas went forth.

So the Question passed with the Affirmative.

The said Proviso was read the Third time; and, upon the Question, assented unto; and ordered to be Part of the Bill.

A Proviso was tendered to the Bill for abolishing Deans and Chapters, &c. and Sale of Deans and Chapters Lands, That the said Bill extend not to a Lease (dated 2 Julii 1640, but executed, with Livery and Seisin, in June 1642) made by Henry Fairefaxe, late one of the Prebends of the Cathedral Church of Yorke, unto the Mayor and Commonalty of the said City, for three Lives: Which Proviso was this Day read the First and Second time.

And the Question being put, That the said Proviso be read the Third time:

It passed with the Negative.

Resolved, &c. That the said Proviso be rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That the said Bill shall not extend to certain Parcels of Land appertaining to the Dean and Chapter of the Cathedral Church of Durham, &c.; Which was this Day read the First time; and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That the said Trustees do stand seised of Two Messages in all Cities and Towns, where any Cathedral or Collegiate Church is, to the only Use of Preaching Ministers of the said City or Town: Which was this Day read; and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That the said Act should not extend to the Avoiding of a Lease made to John Berry, of Thurverton, in the County of Devon: Which was this Day read, and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That the said Act extend not to a Lease granted to John Were, and others: Which was this Day read; and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That such Monies as should be raised by the sale of the said Lands, and of Bishops Lands, be hereafter repaid, and be employed to pious and charitable Uses, was this Day read; and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That the Trustees give Warrant to the Treasurers, to pay unto Purchasers, whose Leases are avoided by this Act, such Monies as they paid bona side for the said Leases, upon Oath made thereof: Which was this Day read, and, upon the Question, rejected.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That Two thousand Pounds, lent by Arthur Samuell, of London, Esquire, upon the Security of Four hundred thousand Pounds Subsidies, be secured upon Sale of Deans and Chapters Lands; he doubling the said Monies: Which was this Day read the First and Second time; and, upon the Question, rejected.

Ordered, That it be referred to a Committee, to examine and state the Matter of Fact, touching the Debt of Two thousand Pounds, lent by Arthur Samuell Esquire to the Use of the State, as is alledged; and to report the same to the House; and what hath been received of the whole Debt: Viz. Unto the Earl of Pembroke, Sir Arthur Heslerigg, Mr. Holland, Mr. Reynolds, Mr. Allen, Mr. Pury, Mr. Say, Sir William Masham, Colonel Harvey, Mr. Scott, Mr. James Challenor, Sir John Bourchier, Mr. Love, Mr. Dove, Sir James Harrington, Sir John Danvers, Colonel Venn, Sir Peter Wentworth, Mr. Carew, Mr. Garland, Mr. Wm. Stephens, Mr. Boone, Colonel Jones, Mr. John Corbett, Mr. Rigby, Sir Thomas Wroth, Alderman Pennington, Colonel Thompson, Colonel Rich, Mr. John Goodwyn, Mr. Luke Hodges, Mr. Blakistone, Alderman Atkins, Alderman Wilson, Sir William Allanson, Mr. Aldworth, Mr. Feilder, Mr. Edwards, Mr. Gould; or any Five of them: With the same Powers that the Committee for removing Obstructions in the Sale of Bishops Lands had. The more particular Care hereof is referred to Mr. Reynolds and Mr. Jo. Corbett.-

Ministers Maintenance.

Ordered, That the Bill touching Maintenance for Ministers be reported To-morrow Morning, the first Business; nothing to intervene.-

Deans and Chapters Lands.

A Proviso was tendered to the Bill for Sale of Deans and Chapters Lands, That this Bill do not extend to make Sale of Two Messuages in Worcester: Which was this Day read; and, upon the Question, rejected.

Another Proviso was tendered to the said Bill, That several Sums of Money, transferred upon the Security of Deans and Chapters Lands, shall not be allowed by the Trustees, &c. upon any Purchase of the said Deans and Chapters Lands, until the said Sums be first allowed of by a Committee appointed by Parliament: Which was this Day read; and, upon the Question, assented unto; and ordered to be part of the Bill.

Another Proviso was tendered to the said Bill, touching the Purchasers having Advowsons of the Manors belonging to Deans and Chapters, and of the Manors of the late Bishops: Which Proviso was this Day read the first and Second time; and, upon the Question, assented unto; and ordered to be Part of the Bill.

A Clause was tendered to the said Bill, That Alderman Foukes be Comptroller for the Deans and Chapters Lands: Which was this Day read the First and Second time; and, upon the Question, assented unto; and ordered to be Part of the Bill.

Ordered, That Sir Arthur Heslerigg be heard To-morrow Morning, touching such Matter as he hath to offer for Settlement of the present Government.

Ordered, That all such Places, in this Bill, where the Word "Realm," and "Kingdom," are mentioned, the same be rased out; and the Words "within England and Wales" to stand, in those Places, throughout the Bill.

Resolved, &c. That this Act, so amended, with the several Amendments and Alterations made at the Table, and the Provisoes and Clauses agreed to be made Part of this Bill, do now pass.

Ordered, That the Committee who brought in this Bill do take care to see the Provisoes and Clauses inserted accordingly; and take care the same be placed in their proper Places, that there be no Mistakes in the Printing thereof.

Ordered, That this Act be forthwith printed and published.

Ordered, That Mr. John Corbett and Mr. Allen do bring in the Instructions for the Treasurers in this Act To-morrow Morning.
