London Militia.

MAJOR-General Skippon presents to the Parliament, A List of Names of Commission-Officers, from the Commissioners for the Militia of London, as Persons whom they conceive to be meetly qualified for the several Commands after mentioned, in the Six Regiments of Foot now raising by the said Commissioners, within the said City and Liberties; viz.

Green Regiment.

Owen Rowe, Colonel; Robert Price, LieutenantColonel; Robert Mallory, Serjeant-Major Robert Whitby, Edward Greene, Captains.

Yellow Regiment.

John Owen, Colonel; Tho. Randoll, LieutenantColonel; Robert Offley, Serjeant-Major; Tho. Bourne, Richard Boult, Captains.

White Regiment.

Geo. Langhame, Colonel; Wm. Clement, LieutenantColonel; Robert Ostler, Serjeant-Major; George Gosfright, Humfrey Davy, Mathew Randoll, Captains.

Red Regiment.

Militia.

The House resumed the Debate upon the Bill for the Militia of England and Wales.

The Question being put, That Thomas Evans and Lieutenant-Colonel Richard Herbert do stand Commissioners for the Militia in the County of Cardigan;

It passed with the Negative.

Resolved, That Anthony Mildmay and Wm. Elliot be added Commissioners for the Militia in the County of Surrey.

Resolved, That the Lord Chief Justice St. John be added a Commissioner for the Militia in the Isle of Ely, and in the County of Huntington.

Resolved, That Colonel Phillip Twisleton be added a Commissioner for the Militia in Yorkeshire.

Resolved, That Samuell Foxley be added a Commissioner for the Militia in the County of Middlesex.

A Proviso was tendered to this Act, in these Words; viz. "Provided always, That no Person nominated a Commissioner in this Act, or which shall be nominated to any Office or Trust, by virtue of the same, do exercise, or put in Execution, any of the Powers mentioned therein, until such Person, in the Presence of Two or more of the said Commissioners, respectively, hath made and subscribed this Declaration; that is to say; "I do declare, That through the gracious Assistance of Almighty God, I will be true, faithful, and constant to this Commonwealth, without a Single Person, Kingship, or House of Peers." And be it further Enacted, That no Person nominated a Commissioner in one Act of this present Parliament, intituled, An Act for settling the Militia of the City of Westminster, and Liberties thereof, and Places adjacent; as also no Person nominated a Commissioner in one other Act of this present Parliament, intituled, An Act for settling the Militia for the City of London, and Liberties thereof; as also no Person nominated a Commissioner, in one other Act, intituled, An Act for settling the Militia for the Borough of Southwarke, and Parts adjacent; as also no Person nominated in one other Act, intituled, An Act for settling the Militia within the Hamlets of the Tower of London, or which is or shall be nominated to any Office or Trust, by virtue of the said Acts, or either of them, respectively; do, from and after the One-and-thirtieth Day of July One thousand Six hundred and Fifty-nine, exercise, or put in Execution, any of the Powers or Trusts mentioned in the said Acts, or either of them, respectively, until every such Person hath, in like manner made and subscribed the aforesaid Declaration:" Which was read the First and Second time.

Resolved, That the Blank in this Proviso be filled up with these Words; viz. "the One-and-thirtieth."

And the said Proviso was, upon the Question, agreed unto; and ordered to be Part of this Bill.

Another Proviso was tendered to this Bill, in these Words; viz. "Provided always, such Number and Proportion of Horse and Foot be levied and raised in the respective Counties and Places mentioned in this Act: and at such Times, as shall be declared and directed from time to time, by the Parliament, or Council of State; and not otherwise:" Which was read the First time.

Resolved, That this Proviso be read the Second time.

The said Proviso was read the Second time accordingly.

Ordered, That Sir Arthur Hesilrig, Sir Henry Vane, Lord St. John, Major Salwey, Colonel Morley, Colonel Martyn, Mr. Robinson, Colonel White, or any Three of them, do withdraw; and present some Proviso upon the Debate.

Resolved, That James Williams, John Bowen, Henry Jones, William Lewin, Gentlemen, Griffith Lloyd of Garth, Howell Hughes, Humphrey Pugh, and Thomas Ellis, Gentlemen, be added Commissioners for the Militia in the Six Counties of North Wales.

Resolved, That Charles Lloyd and Thomas Vaughan be added Commissioners for the Militia in the County of Brecon.

Resolved, That Thomas Tunman, Richard Tracy, Wm. Prostock, Richard Griffith, Edward Williams, John Price, and Evan Price, Gentlemen, be added Commissioners for the Militia in the County of Radnor.

Resolved, That Wm. Blomfeild Esquire, Major Wm. Barton, John Bendish Esquire, Isaack Preston Esquire, Thomas Sheeres, Gentleman, Captain * Phillips, Daniell Clinch, and Cornet * Hassell, be added Commissioners for the Militia in the County of Suffolk.

Another Proviso was tendered to this Act in these Words; viz. "And be it further Enacted, by the Authority aforesaid, That if any Person or Persons charged or chargeable by this Act, or any of the Acts of this Parliament, lately published, for settling the Militias in the City of London, the City of Westminster, Hamlets of the Tower, and Borough of Southwarke, and Places thereto respectively appeartaining, with Horses and Arms, or otherwise, shall not observe the Direction and Appointment of the respective Commissioners in the several Counties and Places aforesaid; and shall not have sufficient Goods and Chattels in the respective Counties and Places aforesaid, whereby he or they may be distrained for the respective Penalties inflicted upon him or them by the respective Commissioners aforesaid, by virtue of this or the other several Acts above specified: That then it shall and may be lawful for the respective Commissioners, after sufficient Notice thereof, left with the Tenant or Tenants of such Persons as above said, in case the said Tenant or Tenants shall not, upon such Notice, pay the several Penalties inflicted by the said Commissioners upon the Landlord or Landlords of such Tenant or Tenants, by like Warrant under their Hands and Seals, to distrain upon any of the said respective Tenants, for the said several Penalties inflicted upon the Landlord or Landlords of any such Tenants; who shall and are hereby enabled to defalk the same out of his or their next Rents; and shall, for his so doing, be saved harmless, and indemnified by this Act against every such Landlord or Landlords; notwithstanding any Proviso or Covenant within his or their Leases, to the contrary: And likewise shall, for so much as the said Tenant or Tenants shall pay, by virtue of this Act for the Penalties aforesaid, be acquitted and discharged against the said Landlord or Landlords:" Which was read the First and Second time.

Resolved, That this Proviso be committed to the Committee appointed to withdraw: And that Mr. Lister and Mr. Trenchard be added to that Committee.

Another Proviso was tendered to the said Bill, in these Words; viz. "Provided always, and it is hereby Enacted and Ordained, That where any Person, by virtue of this Act, shall be charged with a Horse or Horses, and Arms, and not be allowed by the Commissioners for the Militia to appoint a Rider or Riders for the same; or where any Person or Persons shall be charged with Horses and Arms for Lands lying in any Country where he is not usually resident; in such Cases, if the Person or Persons, charged as aforesaid, shall within Days after Notice of such Charge, pay to the Commissioners, or any Three of them, or to such Person or Persons as they shall appoint, the Sum of Eight Pounds for every Horse and Arms charged upon him, upon Payment thereof, every such Person or Persons shall be fully discharged from any further Charge for Horse, or Pay of any Horseman, Dragoon, or Foot-Soldier:" Which was read the First and Second time; and committed to the said Committee, ordered to withdraw: And that Mr. West and Sir James Harrington be added to that Committee.

Resolved, That, instead of the Word "his," in the 104th Line, the Word "the" be inserted; and that, after the Word "Army," in the same Line, these Words; viz. "under his Command by Authority of Parliament."
