Friday, July the 8th, 1659.

Indemnity.

MR. Say reports, from the Grand Committee upon the Bill for Indemnity, Amendments to the said Bill: Which were Twice read.

Ordered, That the Word "necessary" be inserted before the Word "Salary," in the last enacting Clause, in the Second Line, next after the Word "for."

And the said Amendments, being put to the Question, were assented unto.

A Clause was tendered to this Bill, To enable the Parties to be indemnified to plead the General Issue; and to give this Act, and other Acts and Ordinances of this Parliament, in Evidence; and, if the Party ought to be indemnified, to indemnify them accordingly: and to impower the Judges to put all Powers in any Act of Indemnity in Execution: Which was read the First and Second time.

Resolved, That the Words "pardoned and" be inserted, before the Word "indemnified."

Resolved, That, next after the Word "Meaning," these Words be added, "of this present Act."

Ordered, That Mr. Say, Sir Tho. Widdrington, Major Salway, Colonel Waite, Serjeant Hill, Colonel Morley, Major Lister, Mr. Nelthrop, Mr. Garland, or any Three of them, do withdraw; and perfect this Clause in any thing wherein the same is defective.

Mr. Say reports, from the Committee appointed to withdraw, Amendments to the Clause formerly committed, to be added to the Bill for Indemnity: Which were Twice read; and, upon the Question, agreed unto:

And also one other Clause, prohibiting Officers and Clerks to make out Process against the Persons pardoned by this Bill, upon a Penalty: Which was read; and laid aside.

A Proviso was tendered to this Act, That no Person take any Benefit by this Act, but such, who, within a Year, sue forth his Pardon: For which there shall be paid Forty Shillings; one Moiety to the Use of the Parliament, for Payment of the Arrears of the Army and Navy; and the other Moiety amongst the Officers belonging to the Seal: Which was read the First time.

The Question being put, That this Proviso be read the Second time;

It passed with the Negative.

A Proviso was tendered to this Act, That this Act shall not extend to pardon * Pack, of the City of London, Alderman, for any thing by him done towards Setting up of a Single Person, contrary to the Law in that Behalf; or in respect of any publick Monies in his Hands, which are not yet by him accounted for: Which was read the First time.

Ordered, That this Bill, so amended, be ingrossed; and brought in on Monday Morning next.

Money due to Publick.

Ordered, That the Committee to whom the Bill for Bringing in of Monies due to the Commonwealth was committed, be required and enjoined to meet To-morrow Morning, at Seven of the Clock, in the Speaker's Chamber.

Excise.

A Letter to be written to the respective Judges in their Circuits, to give Charge to the several Justices of the Peace to give that Assistance, which the Law requires, to the Sub-Commissioners and Farmers of the Excise, in the due Gathering in of the Excise, was read; and agreed unto.

Ordered, That Mr. Speaker do sign this Letter: And that the same be sent to all the Judges of Assize and Nisi prius, who ride the several Circuits.

Militia Commissioners.

Ordered, That the Committee to whom the Names of the Commissioners of the Militia for the several Counties within England and Wales is referred, do meet this Afternoon, at Two of the Clock: And that the Clerk of the Parliament do attend the said Committee, with the Names of the Commissioners for the Militia, referred to the said Committee.

Army, &c.

Major Salway reports from the Council of State, The State of the Matter of Fact touching the Regiments and Garisons who have been ordered a Month's Pay out of the Monies raised upon the New Buildings, Which of them are paid, and which are not, for the Direction of the Parliament, how such of the said Regiments and Garisons, as are unpaid the said Monies, may be satisfied; with a List of the Warrants from the Committee of the Army, assigned for Pay of the Forces in England, out of the Two Third Parts of the Monies coming in upon the Act concerning new Buildings in and about the City of London, as followeth; viz.

Ordered, That it be referred to the Committee of Inspections, to consider of the Matter of Fact touching the New Buildings; and present their Opinion therein to this House; and also to consider, How such of the Regiments and Garisons, who have been ordered a Month's Pay out of the Monies raised upon the New Buildings, that have not been paid their Arrears, may be paid equally with the other Soldiers in other Regiments and Garisons, who have been paid: And this Committee are to meet Tomorrow in the Afternoon, at Two of the Clock, in the Speaker's Chamber.

Ordered, That it be also referred to the same Committee, to examine, What Monies are due from Alderman Pack, and the rest of the Commissioners of the Customs; and how the same may be forthwith paid in towards the Payments of the Regiments and Garisons, who have been ordered a Month's Pay out of the Monies raised upon the New Buildings, and are not yet paid, notwithstanding any Pretence of Discharge since the Interruption of this Parliament.

Piedmount, &c. Protestants.

Ordered, That it be referred to the Committee for Inspections, to send for the Treasurers for Monies contributed for Relief of the distressed Protestants in Piedmount and Poland; and to examine, What Monies are in their Hands; and to take care that the same be secured, so that it may be disposed of according to the charitable Intention for which it was given, until the same can be sent over: And that Inquiry be made, How the same may be speedily returned for the Uses for which the same was contributed.

Ordered, That the Chapel belonging to SomersettHouse, shall be exempted from Sale, notwithstanding the former Act of the Parliament for the Sale of SomersettHouse, and Appurtenances: And that the Trustees for Sale of the Crown-Lands shall forbear the Sale of the same: And that the French Protestant Congregation, now using the said Chapel, shall make use of the same, until the Parliament do take further Order.
