Tuesday, the 28th of April, 1657.

Members summoned.

THE House being set, the Serjeant was sent with his Mace into Westminster-Hall, to require the Lords Commissioners of the Great Seal, the Judges, and Lawyers, who are Members of the House, to attend the Service of the House.

Protector's Answer.

Mr. Pedley reports (from the Committee appointed to consider of an Answer to be returned to his Highness, upon what was by him offered, as to the 16th Article) the Opinion of the said Committee in Writing: Which was read; and taken into Debate by Parts.

The Preamble being read;

Resolved, That the House doth agree with the Committee in this Preamble.

The several Ordinances and Acts were put to the Question one-by-one.

The Question being propounded, That the House doth agree with the Committee, as to the Ordinance appointing Commissioners for Approbation of publick Preachers;

And the Question being put, That these Words, viz. "Provided, That the Commissioners to be hereafter named, in the Intervals of Parliament, shall be afterwards approved by Parliament," be Part of the Question;

It passed in the Affirmative.

Resolved, That this House doth agree with the Committee, as to the (fn. 1) Ordinance appointing Commissioners for Approbation of publick Preachers, with this Proviso; "Provided, That the Commissioners to be hereafter named in the Intervals of Parliament, shall be afterwards approved by Parliament."

Resolved, That this Debate be adjourned till Three of the Clock this Afternoon.

THE House resumed the Debate upon the Report made by Mr. Pedley, from the Committee this Morning.

Probate of Wills.

Ordered, That the Report of the Amendments to the Bill for Probate of Wills, be made on this Day Sevennight.

Irish Adventurers.

The Question being put, for agreeing with the Committee, touching an Ordinance appointing a Committee of the Adventurers for Lands in Ireland, for determining Differences among the said Adventurers:

It passed in the Negative.

Ordinances agreed to.

The Question being put, That the House doth agree with the Committee, touching an Ordinance for the Ejection of scandalous, ignorant, and insufficient Ministers and Schoolmasters;

The House was divided.

The Yeas went forth.

So it passed in the Negative.

Resolved, That the Ordinance for the Ejection of scandalous, ignorant, and insufficient Ministers and Schoolmasters, be continued for Three Years, unless the Parliament take further Order therein in the mean time.

And upon the several Questions being put, the House did agree with the Committee, as to the several Ordinances following; viz.

January 24th, 1653. An Ordinance for repealing of several Acts and Resolves of Parliament, made for or touching the subscribing or taking the Engagement.

March 20. An Ordinance for settling and confirming of the Manors of Framlingham and Saxted, in the County of Suffolk, and the Lands, Tenements, and Hereditaments thereunto belonging, devised by Sir Robert Hitcham Knight, and late Serjeant at Law, to charitable Uses.

23. An Ordinance for settling Lands in Ireland on Colonel Robert Hamond.

29. An Ordinance touching the Arrears of Colonel Roger Fenwick deceased.

29. An Ordinance for the granting unto, and vesting in, the Mayor, Bailiffs, and Burgesses of the Town of Berwick upon Tweed, for ever, certain Lands and Tenements within the Bounds of the said Town, for the perpetual Repair of the Bridge there, and other Benefits of the said Town.

30. An Ordinance touching Allowance of Debts and Incumbrances upon the Estate, which was settled, by Order of the Council of State, upon Mrs. Mary Deane, Relict of General Deane, and her Children.

30. An Ordinance for Payment of Three thousand Four hundred Seventy-three Pounds Five Shillings, to Francis Thomson and Henry Cannon, in Recompence of their Interest in the Little Park at Windsor, the King's Meadows, and Bushy Bark.

30. An Ordinance for Satisfaction of the Creditors of Peter Smart deceased, out of the Remainder of Deans and Chapters Lands.

Resolved, That it be referred to a Committee, to consider of the Ordinance, intituled an Ordinance for settling the Estates of several Persons in Scotland in Trustees, to the Uses herein expressed upon the Debate now in the House; and also touching the Donatives given to several Persons in Ireland by the Parliament; and report something therein to the House, for their Consideration: Viz. to Lord Broghill, Mr. Secretary Thurloe, Colonel Cooper, Colonel Jones, Mr. Disbrow, Colonel Blackwell, Colonel Zanchy, Major General Whalley, Colonel Hewson, Master of the Rolls, Major General Goff, Sir Rich. Onsloe: To meet To-morrow at Seven of the Clock; and report the same to the House To-morrow Morning.
