Prayers.

MR. Whitehead reports the Amendments to the Ordinance for raising and maintaining Forces in the County of Southampton: The which were twice read; and, upon the Question, assented unto: And the Ordinance, with the Amendments, passed, upon the Question; and ordered to be sent unto the Lords for their Concurrence.

A Pass for the Countess of Devon, to transport herself, with Ten Servants, a Coach and Four Horses, and Two Saddle-Nags, beyond the Seas, was this Day read; and, upon the Question, assented unto; and ordered to be sent unto the Lords for their Concurrence.

Resolved, &c. That the Lord Gray of Groby, upon Accompt, in Part of his Arrears, shall have the Benefit of those Two Assessments, for the Twentieth-Part, discovered by him to the Committee at Haberdashers-Hall, and not formerly discovered to the said Committee.

Sir Tho. Widdrington reports the Amendments to the Ordinance for the Associating of the several Counties of Yorke, Lancaster, Nottingham, Bishoprick of Durham, Northumberland, Cumberland, and Westmorland: The which were twice read.

The Question being put, Whether Mr. Nath. Fienis shall be of the Committee named in this Ordinance;

It passed with the Negative.

The Question being put, Whether Mr. Lionel Copley shall be of the Committee named in this Ordinance;

It passed with the Negative.

Resolved, &c. That the Lord Fairefaxe, and all the Members of this House that are of the several Counties of Yorke, Lancaster, Nottingham; Bishoprick of Durham, Northumberland, Cumberland, Westmorland, Town of Berwick, Newcastle, and Kingston upon Hull, shall be of the Committee named in the Ordinance for associating the said several Counties; which has the Power of ordering and directing the Forces of the said Association.

Resolved, &c. That Colonel Poynes shall be one of the Committee in this Ordinance, for the ordering and directing the War in the Northern Association.

Articles presented to the House, to be subscribed by the several and respective Persons to be named of the Committee in the Ordinance for the Northern Association, before any of them shall execute any thing as one of the said Committees, were read; and severally passed, upon the Question; and were in hæc verba; viz.

1. "That we are willing to take the National Covenant, and the several Oaths and Protestations, agreed upon by the Parliament."

2. "That we have not raised Arms against the Parliament."

3. "That we have not voluntarily sent in, given, or lent, any Money, Horse, Plate, or Arms, to any of the King's Party against the Parliament."

4. "That we did never sit for Execution of any Commission of Array; nor did ever voluntarily submit to any Commission of Array."

5. "That we never gave our Consents to be named of any Committee; nor did ever act in any Committee for the King's Party against the Parliament."

6. "That we have not given any Aid, Advice, Countenance, or Encouragement, to any other Person whatsoever, who hath taken up Arms for the King against the Parliament, to do the same."

7. "That we have not taken any Oath, or entered into any Act of Association, with any other of the King's Party, against the Parliament."

8. "That we have not imposed any Assessment, or caused any Assessment to be levied, nor willingly paid any Assessment, for maintaining the War against the Parliament."

9. "That we have not made any fraudulent Conveyance of any Part of our Estate, either in Lands or Goods, to avoid the Payment of Taxes and Assessments to the Parliament."

Resolved, &c. That the several and respective Persons, to be named of the Committee in the Ordinance for the Northern Association, shall subscribe the Articles abovesaid, before they shall be of any of the said Committees, or to act or execute any thing as one of the said Committees.

The Lords Concurrence to be desired herein.

Resolved, &c. That the Power in this Ordinance for assessing the Fifth and Twentieth-Part, in the several Counties of the Northern Association, shall be left out.

Resolved, &c. That the Town of Kingston upon Hull, and County of the same, shall stand and continue in the Ordinance for the Northern Association, as it is brought in upon the Report.

Provided, That this Ordinance, nor any thing therein contained, as to the Power for the ordering and directing the War within the said Association, shall not take Effect until the Twenty-fourth Day of June 1645; any thing in the said Ordinance contained to the contrary hereof in any wise notwithstanding.

Resolved, &c. That this Proviso be added to the Ordinance for the Northern Association.

The Amendments in the Ordinance for the Northern Association were assented unto: And the Ordinance, with the Amendments, passed, upon the Question; and ordered to be sent unto the Lords for their Concurrence.

Sir Robert Pye went to the Lords, to desire them to sit awhile.

Resolved, &c. That a Letter be written, from both Houses, to the Committee of both Kingdoms upon the Place, and the Earl of Leven, for the March of the Scotts Army Southwards forthwith: And that this Letter be sent by Two Members of this House.

And Mr. Holles, Mr. Recorder, and Sir Henry Vane junior, are to prepare this Letter.

Resolved, &c. That Sir Henry Cholmeley shall be one that shall go with this Letter.

Resolved, &c. That Mr. Antony Nicoll shall be one that shall go with this Letter.

And it is referred to the Committee of both Kingdoms to dispatch them away; and to furnish them with Money for their Journey: And they are to receive what further Instructions shall be necessary from the Committee of both Kingdoms.

A Message from the Lords, by Doctor Aylett and Doctor Heath;

The Lords have commanded us to bring you this Letter: They have appointed a Committee of Seven; whereof Three to be of the Quorum: The Particulars and Order are in this Paper: An Ordinance for Continuance of the Ordinance of 15 Julii 1644, concerning the Isle of Wight; to which the Lords do agree, with the Addition of these Names: An Ordinance for Mr. Bond to be Master of the Savoy; to which the Lords desire the Concurrence of this House: An Ordinance for Martial Law for Kent; to which the Lords do agree, with these Additions and Amendments.

They desire you to take into speedy Consideration the Repayment of One hundred Pounds belonging to the Earl of Lincolne, seized upon by the Directions from the Committee of the Safety.-

Sir Robert Pye brings Answer from the Lords, That the Lords will sit awhile.-

The Letter was from the Lord Digby: And the Order from the Lords, together with the Letter, was read: And the Order was in hæc verba; videlicet,

The Lords have sent down this Letter; and appointed a Committee of Seven; and Three of the Quorum; to meet on Monday Morning next, at Eight of the Clock, in the Lord Keeper's Lodgings; to examine the Matter thereof: And have invested the Committee with Power to send for and examine such Witnesses as they shall think fit; and to adjourn themselves from time to time, as they see Cause: And their Lordships desire this House to appoint a proportionable Number of their Members to join with the Committee of Lords; and to give them the same Power and Authority which the Lords have.

Mr. Pierpont, Mr. Sollicitor, Mr. Holles, Sir Henry Mildmay, Sir Thomas Widdrington, Mr. Ellys, Mr. Robert Goodwyn, Mr. Whitlock, Mr. Recorder, Sir Walter Earle, Mr. Maynard, Mr. Lisle, Sir Wm. Lewes, Sir Henry Vane junior;

This Committee (whereof Six to be of the Quorum) are to join with the Committee of the Lords, to examine the Matters in the Lord Digbye's Letter: And are to meet on Monday Morning at Eight of the Clock, in the Lord Keeper's Lodgings: With Power to send for, and to examine, such Witnesses as they shall think fit; and to adjourn themselves from time to time, as they see Cause.

Resolved, &c. That this House doth agree with the Lords, That Robert Dillington and John Worsley Esquires, Mr. Ringwood of Newport, and Mr. Thomas Legg, shall be added to the Committee named in the Ordinance of 15 Julii 1644, concerning the Isle of Wight.

The Ordinance for appointing Mr. Bond to be Master of the Perpetual Hospital of the Savoy was this Day read; and, upon the Question, assented to.

The Amendments to the Ordinance for Martial Law for Kent were read; and, upon the Question, assented to; and the Ordinance appointed to be printed.

Resolved, &c. That the One hundred Pounds seized by the Committee of the Safety belonging to the Earl of Lincolne shall be charged upon the Excise; and be paid to him in Course.

Answer returned by the same Messengers; That the House had taken their Message into Consideration; and do concurr with the Lords in the several Messages delivered by them: And have taken into Consideration the Business of the One hundred Pounds for the Earl of Lincolne.

Resolved, &c. That such Forces of the Eastern Association as shall be drawn out of their Association for the Service of the Publick, shall be paid by the Publick for the Time that they continue out of their Association: And it is referred to the Committee of the Association; who are required to meet this Afternoon, to consider of some Way to be offered to this House, for the Raising of Monies for the Pay of these Forces accordingly.

Ordered, That Sir Henry Mildmay and Mr. Corbett do prepare a Letter, to be sent to the several Committees of the several Counties of the Eastern Association, to draw what Horse and Dragoons they can, forthwith, to some Places nigh their Borders, with Foot proportionable, that they may be in Posture for Service, if sudden Occasion shall require: And that the House will take care for their Payment during the Time they shall continue out of the Association.

Resolved, &c. That this House doth approve of, and agree unto, the Exchange of Colonel Henry Tillier, Prisoner to the Parliament, for Sir Robert Pye junior, Prisoner to the King's Forces.

Resolved, &c. That this House doth approve of, and agree unto, the Exchange of Major Maxey, Prisoner to the Parliament, for Major Ennys, Prisoner to the King's Forces.

Resolved, &c. That this House doth approve of, and agree unto, the Exchange of Lieutenant-Colonel Stamford, Prisoner to the Parliament at Eccleshall Castle, for Captain Arnold and Captain Newman, Prisoners to the King's Forces.

Ordered, That the Manner of expediting these Exchanges, and returning the Prisoners exchanged, be referred to the Committee of both Kingdoms.

The humble Petition of Major James Ennys, on the Behalf of himself and Two hundred Officers and Soldiers, was this Day read: And

It is thereupon Ordered, That this Petition, together with Sir Robert Pye's Condition, be taken into Consideration on Tuesday next.

And it is further Ordered, That the Matter of this Petition, and any Treachery or Miscarriages concerning the Loss of Leicester, be referred to the Committee appointed to examine an Information from Mr. Purefoy, concerning the said Garison.

Mr. Holles presents, from the Committee, a Letter to be sent from both Houses to the Committee and Commissioners of both Kingdoms upon the Place, and to his Excellency the Earl of Leven, for the Advance of the Scotts Army Southwards: The which was read; and, upon the Question, passed; and ordered to be sent unto the Lords, for their Concurrence, by Mr. Holles.

A Message from the Lords, by Doctor Aylett and Doctor Heath;

The Lords have commanded us to tell you, That, upon your Desire, they sat a good while; and do intend to meet this Afternoon at Four of Clock; and will be then ready to receive any Thing from you.

Resolved, &c. That this House shall meet this Afternoon at Four of Clock.

An Ordinance for reimbursing the Commissioners of Excise One thousand Pounds, advanced and lent by them for the Service of the West, being Part of the Twelve thousand Pounds granted by Ordinance of Parliament for the Service of the West, was this Day read; and, upon the Question, passed; and ordered to be sent unto the Lords for their Concurrence.

The House being informed, That divers Aldermen, and others of the Common-Council, of London, were at the Door;

Who, in pursuance of an Order of the Common-Council of the Seventh Instant, did present to the House a Letter, received from the Mayor and Aldermen of Gloucester, directed to the Lord Mayor, Aldermen, and Common-Council of the City of London, concerning Colonel Massie's Removal from Gloucester; and likewise the Informations of divers Persons belonging to the City and County of Gloucester; with a Desire, That the House would take the said Letter, Informations, and the Safety of the City and County of Gloucester, into serious and speedy Consideration.

The Aldermen, and others of the Common-Council, were again called in: and Mr. Speaker, by Command of the House, acquainted them, That the House had considered of the Informations they had imparted to them concerning Gloucester; and had read the Letter brought in by them: And that the House doth approve of their Care; and do think they have done nothing but what besitted them in this Business: They have taken care for the Safety of the City and County of Gloucester, when Colonel Massie comes away from thence: And that many Things have been done by this House to that End since this Letter: And that Two of their Members are gone down thither.

THE Lords and Commons, in Parliament assembled, do Declare, That the Ordinance, bearing Date the Fifteenth Day of July 1644, concerning the Safety of the Isle of Wight in the County of Southampton, shall have Continuance for and during the Space of Six Months, from the Thirteenth Day of May 1645, and no longer.

Post Meridiem.

REsolved, &c. That, when this unnatural War shall be ended, the Town of Lancaster shall have and receive Eight thousand Pounds out of the Estates of such Papists and Delinquents, within the said County, as were actually at the Burning of the said Town, to be equally divided amongst the Inhabitants, proportionably to their Losses; the said Inhabitants themselves being no Delinquents.

Ordered, That an Ordinance for raising Monies in the County of Surrey for the Maintenance of the Forces in that County, be brought in on Monday Morning; and be taken into Consideration the first Business.

Mr. Holles brings Answer, That the Lords have assented to the Letter; and have commanded their Speaker to sign it: That they have agreed to the Pass for the Countess of Devon.

Resolved, &c. That the Committee of Surrey be desired to send an Hundred Dragoons for the Service of the West.

Resolved, &c. That the Committee of Sussex be desired forthwith to send a Troop of Horse, consisting of Fourscore, and an Hundred mounted Musqueteers, upon the present Expedition into the West.

Colonel Stapley, Mr. Shelley, and Mr. Hay, are required presently to take care herein; and to send this Order to the Committee.

Resolved, &c. That One hundred and Fifty Horse be sent out of Wilteshire for this present Expedition into the West.

Ordered, That Mr. Speaker do write a Letter to the Committee of Kent, to desire them forthwith to send what Force they can, of Horse and mounted Musqueteers, for the Relief of Colonel Welden, and the Brigade at Taunton.

Mr. Recorder is appointed to prepare the Letter:

Who reported the Letter: The which was read; and, upon the Question, assented unto.

Ordered, That Sir Henry Heyman, Captain Lee, and Colonel Blunt, do go with this Letter to the Committee of Kent, to employ their Endeavours for sending a Force of Horse and Dragoons upon this Expedition into the West.

Ordered, That it be referred to the Committee of the West, to take care that these Votes be forthwith put into effectual and due Execution: And that the Committee do presently send a Messenger to Colonel Massy, to acquaint him with the Resolutions that are taken for the several Counties to send present Force for this present Expedition into the West.

Resolved, &c. That Mr. Edward Ashe, Mr. Long, Sir Samuel Rolle, Sir John Evelyn, Sir Nevill Poole, and Sir Edward Hungersord, do, from this House, repair to the Committee of the Militia in London, to desire them presently to send Five hundred mounted Musqueteers, for the present Expedition into the West, for Relief of the Brigade at Taunton; and that they do likewise speak with such others as they think fit, for the Advance of any Horse or Dragoons upon this present Expedition into the West.

Ordered, That the Letters from Colonel Welden, Commander of the Brigade at Taunton, now with the Committee of both Kingdoms, be delivered unto Sir Henry Heyman and Captain Richard Lee: Who are to communicate them to the Committee of Kent.

Resolved, &c. That the Committee of Middlesex be desired to send a Hundred Horse, or a Hundred mounted Musqueteers, for this present Expedition into the West.

Mr. Gerard is desired to take care of this Business.

Ordered, That it be referred to the Committee of both Kingdoms, to appoint who shall command the several Forces designed for this present Expedition into the West, for the Relief of the Brigade at Taunton, until Colonel Massy come to them.

Ordered, That Thirty Pair of Pistols, with Holsters, and Thirty Saddles, with their Furniture, be forthwith furnished out of the publick Stores, now in the Custody of Owen Rowe, for the Service of Hants Horse: And that the said Pistols and Holsters, Saddles and Furniture, be delivered unto Colonel Rich. Norton.

Colonel Whitehead acquainted the House, That the Committee at Hants, and Colonel Norton, had conferred together; and that they had resolved to furnish One hundred commanded Horse, under the Command of Captain Thomas Bettisworth, to go upon this present Expedition into the West, for the Relief of the Brigade at Taunton.

Ordered, That Mr. Gilbert Gerard be added to the Committees in the several Ordinances of Parliament for the City of Westminster, and County of Middlesex.
