58 BOSVILLE V SAVAGE

Sir Henry Bosville of Eynsford, co. Kent, knt v William Savage of the same

November 1637 - February 1638

Abstract

Bosville petitioned that Savage had said 'that the boye that cryed spratts was fitter to bee a justice of peace; that he would buy the baker's asse of Aynesford and add 3 more and then ride in a coach as Sir H. Bosvile did', and 'that he would take place of him if he were assessed more then he'. Process was granted on 30 November 1637; but Bosvile died soon after and Savage petitioned that as no libel had appeared his bond should be returned and the cause dismissed.

13/2a, Defendant's petition

'Sir Henry Boswell kt. long before his death did preferr his suite against yr peticoner in the Court of Honour upon pretence of some wordes which your peticoner should speake to his disparagement; and upon your peticoner's appearance he entred into bond to answeare the suite according as in like case is used'. He prayed that since Henry Boswell was now dead 'and soe the suit is at an end & noe libell put in against your petitioner that your honour wilbe pleased to give order that the petitioner's bond may be delivered up unto him.'

Summary of proceedings

Dr Duck acted as counsel for Bosville and Dr Eden for Savage. On 12 February 1637/8 Savage was due to appear before the earl of Arundel and Lord Maltravers.

Notes

Sir Henry Bosville of Eynsford married Isabella, daughter of Sir Thomas Wiseman of Rivenhall, co. Essex, knt, and his son Henry Bosville, esq., appeared in the 1663-8 Visitation of Kent as married to Mary, daughter of Thomas Petley of Halstead, co. Kent, esq. Sir Henry Bosville was acting as a justice of the peace in a saltpetre case in Kent in March 1637. Another relative, Sir Thomas Bosville of Eynsford was knighted by Charles I in the north prior to becoming a leading Kent royalist in the civil wars.
