Certificate made by the deputy of the justice of Ireland, the chancellor, and the king’s treasurer there, and by them returned before the king in his chancery in England, by virtue of his writ directed to them.
Transcript of writ to the said justice &c. as above, 20 June, 16 Edward III, on the complaint of the abovesaid William de Bohun, earl of Northampton, and Elizabeth his wife, John de Ver, earl of Oxford, and Maud his wife, William de Roos of Hamelak and Margery his wife, and John Tybetot and Margaret his wife, that, whereas the king lately took their homage for all the lands &c. which the said Giles held of the king in chief in England, and commanded their several pourparties to be delivered to them, and it was found, by an inquisition taken in Ireland, and returned into the chancery there, that the said Giles held of the king in chief on the day he died divers lands &c. in the lordship of Tothemond and elsewhere in Ireland, and divers other lands &c. there of other lords, whereby the wardship of all the said lands &c. of the said Giles in fee pertained to the king, and for that cause were taken into the king’s hand, and, for a certain fixed sum to be rendered yearly to him, were by the king’s council there committed to Maurice son of Thomas, earl of Dessemond; and the said earls, William and John, for themselves and their wives, made suit that the said justice &c. might take care (curaretis) to make their pourparties of the aforesaid lands &c. and deliver the same to them. They [the said justices &c.], however, because it was found by a certain inquisition, which Thomas, bishop of Hereford, then guardian (custos) of Ireland, demanded to be taken at the suit of the said Maurice, who alleged (suggerentis) that all the said lands &c. in Ireland, of which the said Giles died seised in fee, were held of the said Maurice, and not of the king, and who schemed (machinantis) to disinherit the king of the said wardship, that the said lands &c. were held of the said Maurice, on pretext of which inquisition he detains and occupies them, applying the issues to his own use, have not taken care (non curastis) to make the pourparties of the said earls, William and John, and of their wives, of the said lands &c. as the custom is, and to deliver the same to them, although the king and his progenitors have been seised without interruption of the wardship and marriage of the heirs of the said inheritance, and of the wardship of the lands &c. thereof, from the time the same came to the hands of the ancestors of the said Giles, and to those heirs who were minors, and of the homage of the same heirs successively, from heir to heir, as fully appears by the rolls and memoranda in the king’s treasury in Ireland, but have permitted the same lands &c. to be detained for a long time out of the king’s hand, and still permit it, to the king’s hurt and damage, and to the manifest disherison of his crown; wherefore the king has been prayed to cause fitting remedy to be provided, as well for himself as for the said heirs. They are commanded, if on examination of the rolls and other memoranda, they find that the said lands &c. in the parts of Tothemond and elsewhere in Ireland are held of the king, or partly of him and partly of others, and that, by reason of the king’s prerogative, after the deaths of the said Giles and his ancestors, the king and his progenitors were seised of the wardship of all the said lands &c., and of the homage of the said heirs in times past, to cause the said lands &c. to be resumed into the king’s hand, and to cause due and speedy justice to be done to the said earls, William and John, and their wives, on their suit for restitution of the said lands &c. as of right, and according to the law and custom of Ireland, causing all those who have occupied the said lands, &c. from the time of the said Giles’s death, to come to the said exchequer, and to answer for the issues of all the said lands &c. from the time of the said death, certifying into the chancery of England what they have done in the matter. Whereupon the king’s writ of the chancery of Ireland was sent to the treasurer, barons, and chamberlain of the exchequer at Dublin as follows:—
Transcript of writ to the said treasurer &c. to the same effect as above, 8 June, 17 Edward III. Teste, John Moryz, deputy of John Darcy, justice of Ireland. By writ of England.
By virtue of this writ the said treasurer &c. remitted into the Irish chancery a certificate as follows:—
