Metropolis Police Act, Petition from Wapping for Repeal of.

The Earl of Shaftesbury reported from the Lords Committees, to whom the Bill, intituled, "An Act for naturalizing Peter Hubert Desvignes and George Desvignes," was committed; "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The Order of the Day being read for taking into further Consideration the Petition of John Joseph Lawson, the Printer of The Times, now in Custody; praying, "That he may be set at liberty by their Lordships;" and for the Lords to be summoned;

The said John Joseph Lawson was accordingly brought to the Bar, and reprimanded by The Lord Chancellor as follows;

"John Joseph Lawson,

"The Publication of which you have acknowledged yourself to be the Printer and Publisher has been pronounced by an unanimous Vote of this House to be a gross and scandalous Libel upon Edmund Henry Earl of Limerick, a Member of this House, and also to be a high Breach of the Privileges of this House.

"The Privileges of this House are conferred upon it by the Constitution of the Country, and recognized most amply in all Times by the Law of the Land, and they are possessed by this House, not for the Benefit of individual Members, not for the Aggrandizement and Power of the House collectively, but for the Defence and Protection of this Assembly, and for the better Execution of those high Functions which, for the Benefit of the State, the Constitution has conferred upon it.

"It would be a strange Thing indeed if Privileges which are possessed not only by the other, the inferior Branch of the Legislature, but by every Court of Record within the Realm, should be denied by the Constitution, by its Policy or by its Justice, to that Illustrious Assembly which combines within itself the Functions of the Hereditary Councillors of the Crown, of the higher Branch of the Legislature, and of the highest Court of Judicature within the Realm. These Functions of councilling the Crown, of partaking in giving Laws to the Realm, of deciding sole and supreme in the last Resort, without Appeal to any Human Authority, in all Causes Civil as well as Criminal,- these high Functions, these great Duties, these large Powers, are enjoyed by the House for the sake of the whole Country of England; and in order that they may be able to exercise those Duties, in order that the Country may continue to enjoy the Benefits which through them, from their Exercise of these Duties, are derived to it, it is absolutely necessary that its undoubted Privileges should remain unquestioned and unbroken.

"No Man who reads the scandalous Paragraph which you admit you have published as well as printed can maintain any Doubt for one Moment that it deserves the Appellations which the unanimous Judgment of the House has bestowed upon it: It is therefore their Duty, as well to the Country as to themselves, that their Lordships should proceed to deal with you as the acknowledged Culprit in this respect as so grave an Offence justly merits, to the end that you may be deterred by the Experience of Punishment from the Repetition thereof, and to the end also, the sound end, of all Punishment, that others may, by your Example, be deterred from offending in the like Behalf.

"But the House mingles Mercy with its Justice, and is anxious to take into its Consideration the mitigating Circumstances of the Situation in which you are placed. You have freely and at once confessed that you were guilty of the Offence; guilty in point of Fact, as the Printer and Publisher, and guilty in point of Law or Substance, because you have expressed your Contrition for having so offended. You have amply at that Bar, and by a subsequent Petition, made your Apology and Submission to the House, and tendered also your Apology to the Noble Earl against whom the Slander was vented in the Publication; moreover you have already suffered, though not a long, yet a close Imprisonment under the Authority of the House, and in the Custody of its Officer; and for these Reasons, and thus tempering with Mercy the Judgment which Justice demands of them, their Lordships have thought fit to command me to execute that painful Duty which I have now performed by reprimanding you, and you are hereby accordingly reprimanded, and by directing you to be forthwith discharged out of Custody, upon the Payment of your Fees."

Then the said John Joseph Lawson was taken from the Bar.

Ordered, Nemine Dissentiente, That what has been now said by The Lord Chancellor, in reprimanding the said John Joseph Lawson, be entered on the Journals of this House.

"Ordered, Nemine Dissentiente, That an humble Address be presented to His Majesty, to return our most grateful Thanks to His Majesty for graciously acquainting us with His Royal Consent that this House may proceed upon the said Bill, as now framed, in such Manner as they shall think fit: To assure His Majesty that this early Attention to the Ease and Welfare of His People, expressed in a Manner so gracious, and founded on Principles so generous, must imprint on the Mind of every British Subject the most loyal and ardent Affection towards His Majesty; and that this House begs leave most humbly to express their entire Conviction, that the same Considerations which have led His Majesty to make this most gracious Communication will invariably direct Him in the Promotion of the Happiness and Prosperity of an affectionate and loyal People."
