Destruction of Chattels House-breaking Taking of Goods |
Meldreth < Cambridgeshire < England |
Court of Common Pleas, CP 40/805, rot. 305
Term: Trinity 1462
County: London
Writ type: Trespass (force and arms)
Damages claimed: £500
Case type: Assault; Imprisonment; Taking of goods; Usurpation / abuse of rights
Pleading: Thomas Banes, prior of Folkestone, states that on 25 May 1462 Robert Percy, Thomas More, Thomas Burgeys and John More, together with Edmund, abbot of Westminster, Thomas Ruston, a monk of Westminster, and Thomas Stacy, forcibly assaulted him at Westminster, beating and wounding him, and imprisoned him for five days, against the peace and to his damage of £500.
Pleading: RP, TM, TB and JM, the defendants, state that Westminster Abbey is an ancient foundation, and the abbey, church, and precinct has many liberties and privileges, situated within the town of Westminster. Long ago, King Edgar, by his charter shown here in court, granted that any fugitives fleeing to the precinct or church of Westminster, on foot or horse, from the king's court or any town or city, may not be removed without the permission of the abbot and monks. Similarly, St Edward [the Confessor], by his charter which they also show in court, granted, amongst other things, that neither he nor his successors, nor any bishops or other jurisdiction may remove anyone from that place without the permission of the abbot and monks. [Followed by long recollection of the right of sanctuary, granted and confirmed by various kings and popes.] The present abbot, like his predecessors, has a court within the precinct to hear all trespasses and other matters, whoever they may have been committed by, held before his commissary and no other justice or official. No royal writ runs in the sanctuary. Protesting that Thomas Banes, on Ash Wednesday (18 February) 1461, feloniously stole £24 in cash from John Gybon, and threatened his life and limb, for which reason the defendants, by order of the abbot, took TB and imprisoned him, this being the assault of which TB complains, the defendants state that the trespass of which TB complains took place within the sanctuary at Westminster, and not outside. They also say that the present abbot, long before this original writ and the supposed trespass, according to custom, constituted by his letters George Norwych, Richard Breynt, Thomas Pomeray, John Amettesham, William Milton, Thomas Ruston and William Chartesay as his commissioners within the sanctuary to hear all pleas of debt, trespass, etc, according to the customs, and they were and still are commissioners according to his grant.
Pleading: Prior TB states that the plea given by the defendants is insufficient in law to exclude him from his plea, and he does not need to respond. Since the defendants did not deny the trespass, and made no response, he seeks judgment on the writ and damages.
Pleading: The defendants state that since they made sufficient response to deny the jurisdiction of this court in this matter, which TB did not deny nor make any response, they seek judgment, and that the king's court here has no jurisdiction. The justices wish to be advised on this before proceeding further, day is given to all parties at octave of Michaelmas.
