Pleading: John Langwyth states that on 5 August 1440 Elizabeth Bate, when she was a single woman, bought from him 6 ells of black cloth called 'black of lyre' and 4 ells of musterdevillers for 40s, but she did not pay before her marriage and nor has her husband Thomas after their marriage, to his damage of 40s.

Pleading: TB comes in person and states that on the day of JL's original writ he was living in Coventry and not at Polsworth, as the writ supposes. He therefore seeks judgment on the writ. [No mention of Elizabeth, who is also named initially as a co-defendant.]

Pleading: JL states that on the day of his original writ, namely 10 March 1448, TB was living at Polsworth, as the writ supposes. Enquiry by country, sheriff of Warwickshire to have jury here at quindene of Michaelmas.

Pleading: John Hull states that on 28 February 1443 Thomas Dancourte bought from him 10lb almonds, 1½lb cinnamon, 2lb currants, 10lb dates, 27lb large raisins, 2lb sugar, 1oz saffron, a quarter of sanders (sandalwood), 36lb figs and 2lb rice, all for 18s 2d, and also borrowed a further 21s 10d, payable on request. However, TD has not JH paid any of this 40s, to his damage of 40s.

Pleading: TD states that he does not owe JH this 40s or any money as claimed. Order that he wager his law at the quindene of St John the Baptist, pledges for law named. Attorney to have him here.

However, he has not paid this total of £13 4s 4d, to his damage of £20.

Pleading: The Dean and Chapter of Chichester cathedral state that, by a certain indenture made between them and Thomas Aldhous, of which they show part in court, sealed by TA and dated in London on 1 August 1444, they demised at farm to TA and a certain William Gosselyn and John Bernard the rectory of Mendlesham, together with all tithes, fruits, rights and appurtenances, with the exception of an annual pension of 40s payable to them from the vicar, to hold from that date for 5 years, at an annual rent of £9, payable at the Translation of St Thomas Martyr (7 July). They were also to maintain and repair an old barn there called 'Peseber[n]'. And if the rent was ever in arrears, the Dean and Chapter may re-enter the property and make distraint to cover the arrears, and they may take back the property if they find insufficient goods there. The three men agreed to these terms, and obliged themselves to the Dean and chapter in £20 to abide by these term. They then held this property for the agreed period, but £9 of the rent, due on 7 July 1447 has not been paid, by which they are due the £20 penalty. However, TA has refused to pay this, to their damage of £20.

Pleading: [continued at Michaelmas 1449, rot 308] TA states that he paid the Dean and Chapter the £9 due on 7 July 1447 according to the terms of the indenture, namely at Mendlesham.

Pleading: William Islam states that on 10 November 1442 Thomas, abbot of Malmesbury, by John Andever, his fellow monk, bought from him, by the hand of his servant Thomas Berd, 1½ pieces of cloth called 'monkiscloth' containing 10 yards in length, and 9 yards of stamin, all for 22s 4d; on 10 July 1446, by John Bristowe, another fellow monk, he bought from him another 4½ pieces of 'monkiscloth', of which each piece contained 14 yards in length, for 47s 6d; on 22 December 1445, by Richard Herward, monk, he bought a piece of 'monkiscloth' measuring 12 yards in length, and another of 6 yards, all for 21s; on 10 July 1443, by William Malmesbury, monk, he bought one piece of 'monkiscloth' of 7 yards for 15s; on 10 August 1447, by John Palmer, monk, he bought 6 yards of black cloth called 'say' for 6s 8d; on 10 August 1446, by Richard Kyngiswode, monk, he bought a piece of cloth called 'blacksay' measuring 14 yards in length for 12s 6d; on 10 May 1443, by John Lynam, monk, he bought a piece of cloth called 'say' measuring 14 yards in length for 15s, and another piece of 'say' measuring 7 yards for 6s 8d, and another of 7 yards for 10s; on 10 June 1447, by John Maltby, monk, he bought a piece of 'say' measuring 14 yards for 14s. This amounted to £8 10s 8d, all payable on request, but the abbot has not paid, to his damage of £20.

Pleading: Simon Strete states that on 18 May 1439 Thomas Turges made nine bonds with him, four in 5m and five in 4m, the first payable at Epiphany 1440 and the rest at Epiphany in the years 1442-9. However, TT did not pay these during his life, and nor has John Cheyny, appointed at Aylesbury as administrator of the goods of TT by John Crosseby, commissary of William, Bishop of Lincoln, after the death of TT. This is to his damage of 100m. He shows the bonds in court.

Pleading: JC states that he should not owe this debt, as on the day of SS's original writ, and long before, at Marsworth in Buckinghamshire, he had made full administration of all the goods and chattels formerly of TT at the time of his death, and had none left in his hands.

Pleading: SS states that on the day of his original writ, namely 10 April 1449, JC had various goods formerly of TT still in his hands and not administered, sufficient to pay this debt of 40m, namely at Fowlmere in Cambridgeshire and elsewhere in the same county. Pleading: William Okeburn states that on [8 March 1448], Gerard Snarre, together with John Grove, William Steward and William Ives, by conspiracy between them, procured to have him arrested in Worcester on the charge that on 27 September 1447 at Broadway in Worcestershire he violently seized a certain Margaret Werkman of Marlborough and raped her, against the king's peace. As a result he was put him in the king's castle at Worcester until the justices of the peace could try the case, and remained there until he was delivered by John Wode and Richard Oseney, justices of gaol delivery, on 23 April 1449, when he was acquitted. This was against the form of the ordinance, and to his damage of £40.

Case notes: Same case against Grove appears on CP 40/755, rot 615d, and missing details supplied from there. Unlike most examples of trespass against the statute, no statute is cited in the preamble.
