Term: Hilary 1480
County: Essex
Writ type: Debt (bond)
Damages claimed: 20m
Case type: Bond

Pleading: Robert Lyme and his wife Juliana, also called Juliana Boynton lately of London, widow, claim that William Baldewyn Sen. owes them £40 on a bond made between WB and JL while she was a single woman. RL and JL say that though often requested William Baldewyn Sen. did not pay this money to JL while she was a single woman, nor has William Baldewyn Sen. paid this money to JL and RL since their marriage. Damages are claimed at 20m. Bond shown in court.

Pleading: WB defends and says that the force of the bond ought not hold. He ways that after the time of the bond's making, while JL was still a single woman, a certain indenture was made between himself and JL, at West Ham, Essex, one part of which William Baldewyn Sen. presents to the court. This indenture says that if William Baldewyn Sen. and a certain William Baldewyn Jr. should pay JL £17 in payments of: £3 6s 8d at the Nativity of St John the Baptist 1479, £3 6s 8d at Michaelmas 1479, £3 6s 8d at Christmas 1479, Easter 1480, £13 4d at the Nativity of St John the Baptist 1480 [note this only amounts to £14], then the aforesaid bond shall be null and void. William Baldewyn Sen. says that he paid each of these sums in accordance with the terms of the indenture, namely at West Ham, Essex, and therefore the bond should be null and void.

Pleading: RL and JL say that neither William Baldewyn Sen. nor William Baldewyn Jr. paid them any sum of money, of the sums of money specified in the indenture. RL and JL say that neither William Baldewyn Sen. nor William Baldewyn Jr. paid JL the aforesaid £3 6s 8d due in the feast of the Nativity of St John the Baptist 1479, and so the bond ought to be enforced.

Pleading: William Baldewyn Sen. says that he did pay JL the £6 6s 8d due in the feast of the Nativity of St John the Baptist 1479, at West Ham, Essex, and puts himself upon the country, and RL and JL put themselves likewise. Order to the sheriff of Essex to make a jury come in Easter term 1479. Pledges named for the defendant.

Term: Hilary 1480
County: London
Writ type: Debt (bond)
Damages claimed: 100s
Case type: Bond; Real action / rents / damage to real estate

Pleading: John M. claims that John C. owes him £10 per a bond. Damages are claimed at 100s. Bond shown in court.

Pleading: JC says that the force of the bond ought not hold because at the time of the bond's making he was a layman of little learning and the bond was explained to him in English to contain the condition that if he, during the space (per spacium) of three years next following the making of the bond, should grant to JM and indemnify against all men one acre of wood in Hughenden, Buckinghamshire, which he lately sold to JM, then the bond would be null and void. JC says that he sealed the bond and delivered it to JM believing that it contained this condition, and so if it does not contain this condition then it is not of his making. Concerning this JC puts himself upon the country, and JM puts himself likewise. Order to the sheriff of London to make a jury come in Easter term 1480. The bond is given to chief clerk John F. for safe keeping.

Case type: Loan; Sale of goods

Pleading: William W. claims that Richard M. owes him 5m arising from the sale of cloth worth 22s 7d which RW bought but did not pay for, and an unpaid loan of 44s 6d. WW says that both the sale of goods and loan were transacted on 15/12/1477, and payable on request. The cloth which RM bought was, namely: 12 yards of cloth called Holland Cloth; 2 yards of fustian called 'Holmys' (this probebly refers to fustian of Ulm, Germany, a centre of production), and ten yards of buckram. [Note: The two sums, for the sale and loan, add up to slightly more than the supposed debt. In the manuscript, the sum for he supposed loan is written in as a later interlineation and so probably is in error.] Damages are claimed at 4m

Pleading: Richard M. says that he does not owe WW the aforesaid 5m nor any other monies and puts himself upon the country, and WW puts himself likewise. Order to the sheriff of London to make a jury come in the octave of the purification of St Mary 1480 (late in Hilary term 1480).

Pleading: WH comes in his own person, defends and seeks licence to imparl as far as Easter term 1480.

Pleading: [Further information drawn from CP40/872 rot.334 - Easter 1480] WH says that at the time of the bond's making he was a lay man of little learning and so the contents of this bond were explained to him in plain English to contain the conditions that: if WH, prior to Christmas 1474, should deliver to CL and RL four woollen broad-cloths each containing 24 yards in length with criniled borders [of] agreed quality and colour [as] four cloths of two penny hue (quator pannos laneos continentes videlicet quemlibet eorum viginti et quatuor virgas in longitudine cum crunled listes concordates bonitate et colore quatuor pannis de two peny hewe) which the said WH lately delivered to Galeoto Centuriono; or if not delivering these cloths to CL and RL should instead pay to CL and RL £12 in Christmas 1474 and also deliver to them four similar cloths in the following Christmas (1475); or, if JH should pay to CL and RL £12 in each Christmas thereafter until he should deliver four similar cloths or payment of £12 sterling in exoneration of WH himself concerning the said £60; then the sum of £60 specified in the bond should in delivery on the cloths of payment of moneys be null and void. WH says that believing the bond to contain these conditions he sealed it and delivered it to CL and RL. WH says that if the bond does not contain these conditions then it is not of his making and puts himself upon the country, and the plaintiffs, CL and RL, put themselves likewise. And upon this CL and RL say that they are aliens, and that WH is indigenous [English], and therefore, in accordance with the statute they seek to have a jury as much of aliens as of indigenous [English] persons. Therefore the sheriff of London is ordered to make a jury, as much of aliens as of indigenous [English] persons, come in Trinity term 1480

Court of Common Pleas, CP 40/871, rot. 212

Term: Hilary 1480
County: Devon
Writ type: Debt (other)
Damages claimed: £40
Case type: Bond; Contract (general); Loan

Pleading: Richard W. is in mercy for many defaults. RW was summoned to respond to John G. in a plea that, whereas JG had entered into a bond, for £17, payable to a certain John W. and William B at a certain feast named within the same bond, and long before the feast on which the £17 bond was due, RW assumed responsibility to pay this £17 to JW and WB at Exeter, and to recover the bond from them, thus exonerating JG of the said debt of £17. However, RW did not pay this money to JW and WB, or recover the bond, which then led to various legal actions by JW and WB against RW for the recovery of the aforesaid £17, to the trouble of RW and his damage of £40. In this manner, JG comes by his attorney John K., and defendant RW comes by his attorney Richard D., and day is given between the parties at the octave of the Purification 1480.

Postea text: To this day comes John G. and offers himself on the fourth day against RW, who does not come, and therefore distaint is to be made against RW so that he is before the court at the quindene of Easter term 1480.

Postea text: [Further information drawn from CP40/872 rot.254d. - Easter 1480] Both plaintiff JG and defendant RW come, by their attorneys, and day is given between the parties at the quindene of Trinity 1480.

Postea text: To this day comes John G. and offers himself on the fourth day against RW, who does not come. Therefore, distraint is to be made against RW so that he should be here in Michaelmas term 1480.

Postea text: The sheriff of London does not send the writ and so, just as before, RW is to be distrained to be to this court in Hilary term 1481.

Pleading: John D. claims that Richard F. owes him £10 on a bond which was made at London on 03/07/1476 between RF on the one part and JD together with a certain William R, now deceased, on the other part, payable in the feast of the nativity of St John 1478 (24/06/1478). Damages are claimed at £10. Bond shown in court.

Pleading: RF says that the force of the bond ought not hold because the late WR, at London on 20/07/1476, released and quitclaimed to a certain John H., similarly named in the same aforesaid bond and similarly obliged to JD and the late WR in the aforesaid £10, all debts, actions, etc. RF presents this release to the court.

Pleading: JD says that the late WR never released and quitclaimed to the aforesaid JH all debts, actions, etc., and seeks inquiry upon the country. RF seeks likewise. (Essentially, JD is saying that the release presented in this court is not of the late WR's making) Order to the sheriff of London to make a jury come in the octave of the Purification 1480 (late in Hilary term 1480).

Postea text: postea 1 - the sheriff of London does not send the writ and so the case is forwarded as far as Easter term 1480. And it is understood (Et sciendum est) that the release has been given to clerk John F. for safe keeping.

Postea text: postea 2 - the sheriff of London does not send the writ and sot he case is forwarded as far as trinity term 1480.

Postea text: postea 3 - the jury is placed in respite as far as the morrow of St John the Baptist 1480 (late in trinity term 1480) unless the case is first heard before chief justice Thomas Bryan at the assize of St Martin le Grand on 10/06/1480.

Postea text: postea 4 - To this day (the morrow of St John the Baptist 1480) comes JD in his own person, RF by his attorney, and chief justice Thomas Bryan; who sends record of the case as heard at the assize of St Martin le Grand on 10/06/1480 before chief justice Thomas Bryan himself and associate justice Thomas W. Of the jury of assize, some of the jurors came, and others of the jurors did not come. And certain of them who appeared, namely Thomas S., Henry N., and Richard S., were set forth as jurors. And the remainder of jury within named remains to be taken because the residue of those jurors appearing have nothing within the ward of Billingsgate, within which the contested release is supposed to have been made. Therefore the jury is placed in respite as far as the octave of Michaelmas term due to default of jury. The sheriff of London is again ordered to make a jury come etc.

Postea text: postea 5 - the case is placed in respite as far as Michaelmas term in one month unless the case should first be heard at the assize of St Martin le Grand before chief justice Thomas Bryan on 20/10/1480.

Postea text: postea 6 - to this day (Michaelmas term in one month 1480) comes plaintiff JD, and chief justice Thomas Bryan send record of the case as heard at the assize of St Martin le Grand on 20/10/1480 before chief justice Thomas Bryan himself, and associate justice TW. To this assize came plaintiff JD by his attorney (Humphrey C.), and defendant RF by his attorney, Andrew P., as well as a jury who said on oath that the late WR did not release RF concerning the aforesaid £10 debt by way of the said release. Therefore JD is to recover the aforesaid debt plus damages of 60s and costs of £5. RF is in mercy.

Term: Hilary 1480

Writ type: Debt (bond)
Damages claimed: £20
Damages awarded: £3
Costs: 6m
Case type: Bond

Pleading: Francisco Savaige, James Abrebys, and John Carpenter claim that John Shukburgh owes them £40 on two bonds of £20 each. Both of these bonds were made at London, one being due in the feast of Christmas 1469 (25/12/1469), and the other being due at Christmas 1470 (25/12/1470). Damages are claimed at £20. The bonds are shown in the court.

Pleading: John Shukburgh says that the force of the aforesaid bonds ought not hold because after the time of their making plaintiff John Carpenter issued him a receipt of payment for the same £40 specified in the aforesaid bond, namely at Westminster, Middlesex. John Shukburgh presents this receipt to the court. It was given at Westminster on 04/04/1474 by John Carpenter, who by the same receipt acknowledged himself to have received and had by the day of the making of the same receipt, £100 from a certain Thomas Risby as payment of five bonds which were made on 24/01/1462, and of which the final payment was to have been made in Christmas then preceding (25/12/1473 - the wording is 'Natalic domini tunc ult', this final word could be either ultima [last] referring to the Christmas before the making of he receipt, or ultra [beyond/in the future] referring to the Christmas after the making of the bonds) to John Carpenter and others, concerning which same £100 the same John Carpenter acknowledged himself to be paid (fatebatur se fore solviter), so that TR and his heirs were made quit by the same receipt. John Shukburgh says that the two bonds, for £40, on which he is being sued in this present suit are two of the five bonds mentioned in the above receipt, pertaining to £40 of the £100 mentioned in the same receipt, and so seeks judgement.

Pleading: John Carpenter says that the aforesaid acquittance (receipt) is not of his making and seeks inquiry upon the country, and John Shukburgh seeks likewise. Further, Francisco Savaige, James Abrebys, and John Carpenter do not acknowledge themselves to have received or had from Thomas Risby the aforesaid £100, nor any other monies by that writing, as John Shukburgh has alleged and seek inquiry upon the country, and John Shukburgh seeks likewise. Order to the sheriff of Middlesex to make a jury come in the octave of the purification of St Mary 1480 (late in Hilary term 1480).

Postea text: postea 1 - the sheriff of Middlesex does not send the writ and so the case is forwarded as far as Easter term 1480.

Postea text: postea 2 - continuance between the parties as far as Michaelmas term 1480.

Postea text: postea 3 - Plaintiffs Francisco Savaige, James Abrebys, and John Carpenter come, as well as defendant John Shukburgh. Some of those jurors empanelled appear, and some do not appear. Of those jurors appearing, namely: Nicholas Norton, Robert Norton, John Chalton, Thomas Burgeys, Nicholas Knyght, William Blakenale, Robert Stowell, Richard Hoberd, Richard Burton, John Cokeryk, and Thomas Nicoll, have been set forth as jurors in this case. And other jurors appearing, namely: John Manfeld, Roger Frende, William Askewe, John Dogett, Thomas Lamberd, and John Pratte, have been discharged because they were found to be suspicious by the parties in the case. Lastly, the other jurors which were empanelled did not come, and therefore the case is placed in respite as far as he morrow of Martinmas 1480 (late in Michaelmas term 1480) and the sheriff of Middlesex is ordered to supply more jurors (decem tales).

Postea text: Postea 4 – to this day come the plaintiffs, Francisco Savaige, James Abrebys, and John Carpenter, defendant John Shukburgh, and a jury of the country. This jury says on oath that the aforesaid receipt is not of John Carpenter’s making. The jury also says that John Carpenter did not acknowledge receipt of £100 from Thomas Risby nor any other monies by the said writing. Therefore the jury finds that plaintiffs Francisco Savaige, James Abrebys, and John Carpenter are to recover the aforesaid debt plus damages of £3 and costs of 4m. Additionally, the court awards the plaintiffs a further 26s 8d in costs awarded by the court. John Shukburgh is in mercy.

Postea text: postea 5 - 12/02/1481 a writ of error is recorded, which writ was given in the name of the king on 12/11/1480 and directed to chief justice Thomas Bryan etc.

Pleading: Nicholas T. claims that Richard H. and his wife Margaret H., herself executor of the will of Hugh C., owe him 20m on a bond which was made between NT and the late HC. NT says that the late HC did not pay this 20m during his lifetime, nor did MH pay it while a single woman, nor have RH and MH paid it since their marriage. Damages are claimed at £10. Bond shown in court.

Pleading: RH and MH defend, and seek licence to imparl as far as Easter term 1480.

Pleading: [Further information drawn from CP40/872 rot.443. - Easer 1480] MH and RH say that they should not be held to the aforesaid bond because the late HC, by way of a certain writing made during his lifetime at Exeter, Devon, gave to MH, while she was a single woman, all of his goods and chattels, by which writing MH was possessed of the same goods and chattels. HC then later died, and MH was married to RH, on which pretext MH and RH came to be possessed of the same goods and chattels. MH was not the executor HC's will, nor did she have administration of the goods and chattels which were of HC at the time of his death, as has been claimed by NT. This they are prepared to verify etc.

Pleading: NT says that, after the death of HC, the aforesaid MH did administer goods and chattels which were of the late HC at the time of his death, namely at Exeter, and seeks inquiry upon the country. Pleading: Thomas H., Hugh H., Robert A., and William H., administrators of the goods and chattels of Gilbert P. who died intestate, claim that Simon L. owes them £8 on three bonds which were made between SL and the late GP. The plaintiffs say that all three of these bonds were made at London in the parish of St Nicholas Shambles, Farringdon ward within. The first of these bonds, in 60s was made on 11/04/1476 and due on 10/05/1476. The second of these bonds, in £ 10s, was made on 20/11/1476 and due in Easter 1477 (06/04/1477). Term: Hilary 1480
County: London
Writ type: Debt (other)
Damages claimed: 10m
Case type: Real action / rents / damage to real estate

Pleading: Prior Gilbert S. claims that William W. owes him £20 by way of a certain indenture made at London on 07/04/1472 by which the same prior and convent of the hospital of Elsing Spital granted to WW, at farm, all of the hospital's tenements in the parish of St Augustine by St Paul's, London, which lie between: the hospital's tenement then inhabited and held at farm from the same hospital by John W. on the western part; the tenement then inhabited by Thomas B. on the eastern part; the king's street called 'Watling Street' on the southern part; and one 'place of land' belonging to the hospital on the northern part. Prior GS says that, by this indenture, this property was granted to WW at farm from the feast of Easter 1471 (14/04/1471) for 25 years. In return, WW was to pay to the prior and convent of the hospital an annual rent of 46s 8d in equal portions at the principal annual terms in London (presumably Christmas, Easter, nativity of St John, and Michaelmas). During this period WW was to maintain the property and keep it in good repair, empty the latrines, and make all necessary repairs to the pavement of the king's street at his own expense; excepting to the same prior and his successors whatever should be necessary towards wind and rain (contra ventum et pluviam), namely in roofing and plaster, and the lead gutters. During the period of this farm, WW was not to sell, demise, or alienate any part of the said property without the licence of the said prior etc. The prior etc. retained, by the said indenture, right of distraint in any part of the property should the whole or any part of the rent due at any term fall more than 8 days in arrears. And should any part of the rent due in any term fall more than 15 days in arrears, then the prior retained the right to re-enter the same property etc. And to the fulfilling and observing of all and singular agreements, grants, and payments aforesaid on the part of WW, the same WW obliged himself and his heirs to the said prior in £20. Prior GS says that after the demise at farm of the aforesaid property to WW, under the terms aforesaid, WW later and without the prior's licence, on 13/12/1477 at London in the parish and ward aforesaid, demised the aforesaid tenement with appurtenances to a certain Richard B. for the remainder of the aforesaid farm. Hence, by breaking the terms of the original farm, WW obliged himself to prior GS in the said £20. Damages are claimed at 10m.

Pleading: WW defends and seeks licence to imparl as far as Easter term 1480.
