Pleading: JN states that he should not be bound to this debt, as at this time he was imprisoned by HH and his associates at Islip in Northamptonshire, and detained there until he made this bond under duress.

Pleading: William Dodesham states that, whereas he and his ancestors have always been free men, William Michell, in order to injure his reputation, extort his property and totally destroy him, has claimed that he is his villein, and has lain in wait to take and imprison him. He states that in order to do this, WM came to London on 10 November 1446, and from that day until the day of his original writ, namely 8 November 1446, he has lain in wait for him, such that he has been unable to conduct his business, namely going to St Paul's to speak with sergeants and other lawyers on various matters, and with clients for whom he is acting as attorney in the King's Bench and Common Pleas, and in going to Westminster for these clients, so that all this business is left undone, to his damage of £1000.

Pleading: WM, protesting that he is and was seised of the manor of West Perry in Somerset, as of fee tail of the gift of Simon Michell, from Matthew Michell senior, whose heir he is, as son of Thomas, son of Matthew, son of Matthew Michell senior, of which manor WD is and was a villein of WM, states that WM is and was a villein of him at the manor of West Perry, and says that at various times at Cannington he did lie in wait to take him, as he is entitled, but he did not do this in London, as WD has claimed.

Pleading: WD, not acknowledging anything said by WM, states that he does not have to respond to this plea, and seeks judgment and damages.

Pleading: WM, since he has made sufficient plea to exclude the action, and WD has not denied this or responded, seeks judgment and that WD be excluded from his action. Justices wish to seek advice, day given at quindene of Trinity. WD appoints William Daweson or William Praers as his attorney.

Postea text: Day given at octave of Michaelmas.

Postea text: Parties come, justices report that the plea of WM is not sufficient in law to exclude WD from his action, and WD ought to recover his damages. Since they do not know what damage WD has suffered in this, they order that the sheriff of London is to inquire by sufficient men of that parish as to the damage sustained, both due to the trespass and the costs incurred, and return this here by the octave of Hilary.

Postea text: WD came, sheriff sent record of an inquisition, held at the Guildhall on Wednesday 10 January 1448, whereby the inquest found that JD suffered damages and costs of £50 in this matter. Order that WD recover damages at £50. WM to be taken.

JH occupied this property for that period, but has not paid the rent, or repaid the 20s loan, to his damage of £10.

He says that he is a man of little learning, and when this bond was read to him as being for £10, he sealed it, believing it to be such. Therefore this bond for £20 was not of his making. Both parties on the country. And regarding the bond of 30 April, he also says that this bond is not of his making. Both parties on the country. Sheriff to have jury here at octave of St John the Baptist. Documents to remain in custody of Robert Darcy for safe-keeping.

Pleading: Richard and Joan Bruyn, citing the terms of the statute of 1 Henry V against the creation and use of false or fraudulent documents to disturb possession of land, state that on 16 December 1440, at Rochester, Hugh Caundyssh made various false documents concerning their possession of property in London, namely a deed by which HC gave to John Lane, Thomas Pyke, John Caundyssh, John Welden, Richard Hungate, William Hunte, John Stafford, Benedict Forster and John, son of John Belne certain property, namely three messuages in St Dunstan in the East parish in London, and another document stating that HC appointed Thomas Harlaw as his attorney to make delivery of this property, all in order to disturb them of their possession. As a result of this they have been disturbed of their possession, in contempt of the king, contrary to the statute and to their damage of £300.

Pleading: [continued at Trinity 1447, rot 126] HC states that the plaintiffs ought not maintain their action, since he states that he was formerly seised of these three messuages with appurtenances in his demesne as of fee, and thus seised by a true and sufficient charter granted them to the aforesaid JL, TP, JC, JW, RH, WH, JS, BF and JB, and Thomas Harlawe was appointed by a true deed to make delivery of the property. The documents were therefore good and sufficient, and not false as claimed by the plaintiffs, and he is not guilty of this fraud as claimed.

Having heard this, TB states that he is a servant of JB, and was on the day of JW's original writ.

Pleading: JW states that his case should proceed, as on the day of his original writ, namely 12 October 1446, TB was an apprentice in law staying in St Dunstan in the West, London, and was not a servant of John Bate.

Pleading: William Cantelowe and Joce Faukes, administrators of the goods of Edmund, late earl of March, state that Hugh Cresset was receiver of money for the earl of March from Michaelmas 1424 until 19 January 1425, and received in London, in the parish of St Mary Colechurch, various sums from various people [names and amounts detailed], to the use and profit of the earl, for which he was to render reasonable account. However, the earl then died intestate, and HC has refused to render this account. In the Parliament held at Westminster in 12 Henry VI (1433), by a petition granted by the advice of the lords, it was ordered that administration of the Earl's goods be granted by Henry, then archbishop of Canterbury, to WC and JF, by letters patent shown in this court, dated 6 December 1433 [recited in full, including full recital of original petition (in French) to the Commons from the creditors of the Earl asking that administrators be appointed urgently (TNA SC 8/26/1296, Rot. Parl., IV, pp.470-1)]. The plaintiffs state that they are the same people appointed, and show in court the letters of Henry, archbishop of Canterbury, dated at Lambeth on 4 December 1433 (sic), granting them administration. By this it seems to them that they are entitled to the account of HC, but he refuses to provide this, to their damage of £5000.
