Ordered, That the Earl of Stamford, the Lord North, and the Lord Robertes, are excused for their Absence from attending this House this Day.

Message from the H. C. with Additions to the Ordinance for sending Delinquents from London, and for the Westminster Militia.

A Message was brought from the House of Commons, by Mr. Alderman Atkins; who brought up several Particulars, wherein their Lordships Concurrence is desired:

1. An Addition to the Ordinance for turning out Delinquents out of the late Lines of Communication.

2. An Addition to the Committee of the Militia for Westm. &c.

Agreed to.

3. An Addition to the Ordinance for the Militia for Westm. &c.

The Answer returned was:

Answer.

That this House agrees to the Addition of the Names to the Committee for the Militia of Westm.: To all the rest, their Lordships will send an Answer by Messengers of their own.

Votes to prevent any further Application to the King:

The Earl of Denbigh reported a Paper from the Committee appointed Yesterday to offer something to this House, upon the Debates upon the Votes concerning the King; which Paper contained a Preamble to go before the Votes brought from the House of Commons.

Then the House ordered the Votes should be first read singly; which were as follow, and passed:

"Resolved, That the Lords and Commons do declare, That they will make no further Addresses or Applications to the King.

Resolved, by the Lords and Commons assembled in Parliament, That no Application or Address be made to the King, by any Person whatsoever, without the Leave of both Houses.

Resolved, by the Lords and Commons assembled in Parliament, That the Person or Persons that shall make Breach of this Order shall incur the Penalties of High Treason.

"Resolved, That the Lords and Commons do declare, That they will receive no more any Message from the King; and do enjoin, that no Person whatsoever do presume to receive or bring any Message from the King, to both or either of the Houses of Parliament, or to any other Person."

Protest against them:

These Lords following, before the passing of the Four aforesaid Votes, desired Leave of this House to enter their Dissents, if the said Votes were carried in the Affirmative: Which being granted, they did accordingly enter their Dissents, by subscribing their Names.

Next, the Preamble was read.

And the Question being put, "Whether to agree to it?"

It was Resolved in the Affirmative.

Next, these Votes were read, and passed; videlicet,

Committee for England and Ireland at Derby House

Resolved, by the Lords and Commons assembled in Parliament,

That the Powers formerly granted by both Houses to the Committee of both Kingdoms, relating to the Kingdoms of England and Ireland, be now granted and vested in the Members of both Houses only that are of that Committee, with Power to them alone to put the same in Execution accordingly.

New Members added to it.

Resolved, by the Lords and Commons assembled in Parliament,

That Mr. Nathaniell Fiennes be added to this Committee, instead of Sir Phillip Stapilton.

Resolved, by the Lords and Commons assembled in Parliament,

That Sir John Evelyn of Wilts be added to this Committee, instead of Mr. Recorder.

Resolved, by the Lords and Commons assembled in Parliament,

That the Earl of Kent be added to this Committee, in the stead of the Earl of Essex."

Preacher at the Fast.

Ordered, That Mr. Obadiah Sedgwicke do preach the next Fast, before the Lords, in the Place of Mr. Callamy.

Message to the H. C. that the Lords agree to the Votes, to prevent Applications to the King; and about the Committee at Derby House.

A Message was sent to the House of Commons, by Mr. Baron Atkins and Mr. Serjeant Fynch:

To let them know, that this House agrees in the Votes lately brought up, concerning the King, with a Preamble to precede the said Votes, in which Preamble their Concurrence is desired.

2. That this House agrees in the Votes for reviving the Committee at Derby House for England and Ireland; and adding the Earl of Kent, Mr. Nath. Fiennes, and Sir John Evelyn, to that Committee.

Parnacot and Teate.

Upon reading the Report of Mr. Baron Atkins, and Mr. Justice Godbolt: (Here enter the Report.)

It is Ordered, That the Judgement given in the King's Bench, in the Cause between Parnacott and Teate, is affirmed; and the Transcript of the Record to be returned into the Court of King's Bench, that Execution may be taken out.

Ordinance for 1000 l. for Munster.

An Ordinance for sending One Thousand Pounds into Munster, was read, and Agreed.

Members added to the Committee of Militia for Westminster.

Ordered, by the Lords and Commons in Parliament assembled, That Alexand'r Rigby, Phillip Smith, and Nicholas Love, Esquires, be added to the Committee of the Militia of Westm'r."

Parnacot and Teate.

"Inter Humfrid. Parnacott & Hesteram Teate.

According to your Lordships Order of the Thirtieth of December last, we have, at several Days appointed by us, heard Counsel on both Sides, upon the Matters alledged and assigned for Error; and thereupon, and upon Perusal of the Record thereof, and due Consideration of them had, we are of Opinion, That the Judgements in the King's Bench were rightly given, and ought to be affirmed; humbly leaving the same unto your Lordships Judgement.

Order for 1000 l. for Munster.

Ordered, by the Lords and Commons in Parliament assembled, That the Sum of One Thousand Pounds, that is come in upon the late Ordinance for Adventurers for Ireland, be forthwith paid unto the Vice Treasurer at Wars for Ireland, and by him sent into Munster in Ireland, together with the Letters and Orders of the Committee for the Affairs of Ireland at Derby House; the said Sum of One Thousand Pounds to be accounted as Part of the Sum of Ten Thousand Pounds assigned by former Order, for Relief of the Forces in Munster."

Jennings to be instituted to Combes;

Ordered, That Doctor Aylett give Institution and Induction unto Richard Jennings, to the Rectory of Combes, in the County of Suff. void by the Death of Thomas Sotheby Clerk, the last Incumbent; salvo, &c. Edmund Dandy Patron.

Lidston to St. Mell;

Ordered, That Doctor Heath give Institution and Induction unto John Lidston Clerk, Master of Arts, to the Rectory and Parish Church of St. Mell, in Com. Cornwall, void by the Death of the last Rector; salvo Jure, &c. Mr. Wm. Coriton Patron.

Parker to Wrotham;

Ordered, That Doctor Heath give Institution and Induction unto Wm. Parker Clerk, to the Rectory of Wrotham, in the County of Kent, or to the Vicarage of Wrotham, in the said County, now void; salvo Jure, &c. Granted by the Great Seal.

and Wallis to Gedding Parva.

Ordered, That Doctor Aylett give Institution and Induction unto Edward Wallis Clerk, Master of Arts, to the Rectory of Geding Parva, in Com. Huntingdon, void by the Death of the last Incumbent; salvo Jure cujuscunque: Granted by the Great Seal.
