Mr. Page and the Clerk of the Crown return with this Answer from the House of Commons:

That they agree to the Three Ordinances concerning the Militia of Westm. Southwarke, and the Hamlets: (Here enter them.) To the Order concerning the Mayor of Worcester, they will send an Answer by Messengers of their own.

Message to them, that the E. of Portland's Sequestration may be taken off, in Consideration of the Government of the Isle of Wight being taken from him.

A Message was sent to the House of Commons, by Mr. Page and Dr. Aylett:

To deliver to them the Petition of the Earl of Portland, and put them in Mind of the Message sent down to them in Sep'r 24th, 1646, concerning his Lordship; and, in regard the Houses have disposed of the Governorship of the Isle of Wight, which was a great Part of his Lordship's Maintenance, to desire their Concurrence, that his Sequestration may be taken off, according to the Desire of the Petition.

A Message was brought from the House of Commons, by Humphrey Salwey Esquire:

1. He brought up the Ordinance for disabling such as have been in Arms to bear any Office, sent down from this House with a Proviso; in which Proviso they have made some Alteration, wherein their Lordships Concurrence is desired. (Here enter it.)

Upon the Petition of Dr. Wilson: It is Ordered, That he shall be bailed, to appear before this House this Day Fortnight; against which Time the Person that complains against him is to bring in Articles against him.

Ordinance for the Arrears of the Court of Wards.

Ordered, These Lords following shall prepare an Ordinance for bringing (fn. 1) in the Arrears of the Court of Wards, and present the same to this House:

Any Two; to meet when they please.

Ordinance to slight the Works about London;

An Ordinance for slighting the Lines of Communication, was read, and approved of; and to be sent to the House of Commons for Concurrence.

and One to sell the Materials:

An Ordinance for selling the Materials belonging to the Forts, was read, and approved of; and to be sent to the House of Commons for Concurrence.

These Two Ordinances were presently sent to the House of Commons, for their Concurrence, by Mr. Page and Dr. Aylett.

Tisdale and Ashdowne released.

Upon the Petition of Thomas Tisdall and Barth. Ashdowne: (Here enter them.)

It is Ordered, Upon this their Submission, they shall be released of their Restraint, and bring in the Bond into which Robert Browne entered.

Ordinance to disable Persons from bearing Offices that have been in Arms against the Parliament.

"Be it Declared, Ordered, and Ordained, by the Lords and Commons in Parliament assembled, That no Person whatsoever, that hath been in Arms against the Parliament, or hath been aiding or assisting the Forces of the Enemy, or hath been or is sequestered, shall be elected, constituted Mayor, Alderman, Bailiff, Sheriff, Justice of Peace, Steward of any Court, Constable, or any other Officer, in any County, City, Borough, or Town Corporate, within the Kingdom of England, Dominion of Wales, and Town of Berwick: And in case any such Persons as aforesaid be elected into any of the Offices aforesaid, in any of the aforesaid Places, the Lords and Commons do declare all such Elections to be void and null: Provided, That this shall not extend to any Person or Persons who have been, or shall be, unduly sequestered as Delinquents, and have been, or shall be, therefore discharged of the said undue Sequestration, by both Houses of Parliament, or by the Lords and Commons for Sequestrations."

Ordinance to continue Elvins Mayor of Worcester.

"Ordered, by the Lords and Commons assembled in Parliament, That Mr. Edward Elvins, that was Mayor of the City of Worcester the last Year, and yet is Mayor, shall continue Mayor until both Houses take further Order, notwithstanding any late Election made of any other: It is further Ordered, That no Person whatsoever shall be elected Sheriff, or have any other Office or Place of Trust within the said City, that hath been in Arms against the Parliament, or hath aided or assisted the Enemy, or hath been or is sequestered: Provided, That this shall not extend to any Person or Persons who have been, or shall be, unduly sequestered as delinquent, and have been or shall be, therefore discharged of the said undue Sequestrations, by both Houses of Parliament, or by the Committee of Lords and Commons for Sequestrations."

Ministers sent to Oxford, continued there.

"Ordered, by the Lords and Commons in Parliament assembled, That the Ministers sent down by Authority of Parliament to the University of Oxford, shall be continued there for Three Months longer; and have the same Allowance for their Maintenance which was formerly appointed to them.

Additional Members to the Admiralty Committee.

"Ordered, by the Lords and Commons in Parliament assembled, That Colonel Rainborough, Sir Henry Vane, Sir Henry Mildmay, Nathaniell Fyennies Esquire, and Henry Martin Esquire, be added to the Committee of the Admiralty and Cinque Ports."

Letter from the Scots Commissioners, desiring an Answer to a former One from the States of Scotland;—about the Affront offered to the Earl of Lauderdail; and for their future Security.

"To the Right Honnorable the Speaker of the House of Peeres, pro Tempore.

"Right Honnorable,

"Wee have many Tymes pressed ane Answere to the Letter of the Committee of Estates of the Kingdome of Scotland, beareing Date the 21th of August. This Day annother Expresse is comd to us, requireing us againe to call for ane Answere to that Letter. They are to send some more of their Number into this Kingdome, for the Publique Affaires: But when they consider what Entertainment some already imployed by them have lately received, they are the more earnest to have a sufficient Security for those that shall have their Warrant hereafter. In Obedience therefore to their Comaunds, wee doe most earnestly intreate ane Answere to that Letter of the 21th of August; and rests

Tisdale and Ashdowne's Petitions, who were committed for preventing Browne from paying the Minister of Hanworth his Dues.

"The humble Petition of Thomas Tisdall;

Sheweth,

"That your Petitioner, being an Officer to the Sheriff of Middlesex, did lately replevy certain Cattle of one Browne's, which were distrained for Tithes; which since hath appeared to be contrary to an Ordinance of Parliament.

"That, upon Examination thereof before your Honours, your said Petitioner for his Misdemeanor standeth committed.

"Your Petitioner, being sorry for his Offence, and having many Things to act of high Consequence from this Honourable Assembly, by the said Sheriff's Commandment, in your Petitioner's proper Liberty, humbly desireth to be released from his Imprisonment.

"And your Petitioner shall ever pray, &c.

"To the Right Honourable the Lords in Parliament assembled.

"The humble Petition of Bartho. Ashdowne, Gentleman;

"Sheweth,

"That your Petitioner, through Misinformation and his own Inconsiderateness, was lately requested, in the Behalf of one Browne, to act something which afterwards appeared to be contrary to an Ordinance of Parliament set forth in the Behalf of Ministers for Non-payment of Tithes: All which hath been at large examined before this Honourable Assembly; and your Petitioner (by reason thereof) remaineth under your Honours Displeasure, by Imprisonment.

"Your Petitioner, being grieved for his said Misdemeanor, humbly prayeth your Honours Clemency towards him, in restoring him to his Liberty.

"And your Petitioner shall ever pray, &c.

Ordinance to settle the Militia of Southwark.

"The Lords and Commons in Parliament assembled, taking into their serious Consideration the Estate and Condition of the Kingdom of England, and particularly of the Borough of Southwarke and Parts adjacent within the Line of Communication on the South Side of the River of Thames, in the County of Surrey, do ordain and declare, and be it Ordained and Declared by the Authority of Parliament, That Colonel George Thompson, Mr. George Snelling, Mr. John Corbett, Mr. Robert Houghton, Mr. Cornelius Cooke, Mr. Thomas Hudson, Colonel John Hardwicke, Mr. Richard Hartford, Mr. William Hickox, Mr. Samuell Hyland, Mr. Thomas Cooper, Mr. Francis Prichard, Mr. John Humphrey, Mr. William Simter, Mr. John Sandon, Mr. George Pashfeild, Mr. James Burton, Mr. Samuell Lynne, Mr. Ambrose Andrewes, Mr. Robert Banyard, Mr. Richard Luen, Mr. Peter Delanoy, Mr. Gowen Goldegay, Mr. Will'm Hester, or any Seven or more of them, be, and are hereby made, constituted, and appointed, a Committee for the Militia, of and within the Borough of Southwarke, and Parts adjacent within the Lines of Communication, on the South Side of the River of Thames, in the County of Surrey; and shall have Power, and are hereby authorized, to assemble and call together all and singular Person and Persons, within the said Borough of Southwarkes, and Parts adjacent as aforesaid, that are meet and fit for the Wars, and them to train, exercise, and put in Readiness; and them, after their Abilities and Faculties, well and sufficiently from Time to Time to cause to be arrayed and weaponed, and to take the Musters of them in Places most fit for that Purpose; and that they shall have Power to lead, conduct, and employ, the Persons aforesaid, arrayed and weaponed, for the Suppression of all Rebellions, Insurrections, and Invasions, that may happen, according as they shall from Time to Time receive Directions from the Lords and Commons assembled in Parliament; and that the said Committee, or any Seven or more of them as aforesaid, shall have Power, and are hereby authorized, to constitute and make Colonels, Captains, and other Officers; and shall have Power to remove and displace Colonels, Captains, and other Officers, from Time to Time, as they, or any Seven or more of them as aforesaid, shall see Cause and think fit; and that the said Committee, or any Seven or more of them as aforesaid, shall have the same Power and Authority, within the said Parts, as any Committee for the Militia of the City of London had the Twentieth Day July, Anno Domini 1647, by any Order or Ordinance of Parliament; and that all and every Person and Persons, who shall act or do any Act or Thing whatsoever by virtue of this or any former Order or Ordinance of Parliament concerning the said Militia, shall be saved harmless and indemnified concerning the same, by Authority of Parliament; and shall have the Benefit and Advantage of the Ordinances of the Lords and Commons lately made, for saving and (fn. 2) indemnifying all Persons as have acted by Authority and for the Service of the Parliament: And this present Ordinance is to continue until it shall be otherwise ordered by both Houses of Parliament."

Ordinance for settling the Trained Bands of The Tower Hamlets.

"Be it Ordained, by the Lords and Commons in Parliament assembled, That the Trained Bands and Auxiliaries of the Hamlets of The Tower shall be under the immediate Power and Command of Sir Thomas Fairefax Constable of The Tower, and his Lieutenant, as they were lately under the Militia of London; and that the said Sir Thomas Fairefax Constable of The Tower, and his Lieutenant, shall have Power to name a Sub-committee for the Militia of the Hamlets, as the Militia of London lately had."

Ordinance to slight the Works about London.

"Whereas the Committee of the Militia London, appointed by Ordinance of Parliament the Second of this Instant September, are directed, by several Ordinances of Parliament then and since made, to cause the Forts and Lines of Communication to be forthwith slighted and demolished: For the better enabling of them to perform the said Work; it is Ordained, That all Householders and other Persons, within the Lines of Communication and Parts adjacent, that are well-affected to the Freedom of Parliament and City, and Peace of the Kingdom, be, and are hereby, desired to begin on Monday next, and so to continue to come, or send what Men they can, with Tools, to such Parts of the Line as they shall be from Time to Time directed by the said Committee, to perform the said Work, till it be finished; and the several Committees of the Militia, which are or shall be established within the Limits aforesaid, are required to be aiding and assisting in the doing thereof in their respective Jurisdictions; and that this Ordinance be forthwith printed, and published the next Lord's-day in the several Parish Churches, within the Lines of Communication and Weekly Bills of Mortality, by the respective Ministers thereof, who are hereby required to take Notice hereof, and proceed accordingly."

Ordinance to sell the Materials belonging to them.

"Whereas the Committee of the Militia, London, appointed by Ordinance of Parliament the 2d of this Instant September, are directed, by several Ordinances of Parliament then and since made, to cause the Forts and Lines of Communication to be forthwith slighted and demolished: For the better enabling of them to perform the said Work, it is Ordained, That the said Committee shall cause all the Materials belonging to the said Forts and Lines to be forthwith sold, and the Proceed thereof to be employed towards the accomplishing of the said Work, and such other Public Services as they shall see necessary for the Discharge of the Trust committed to them."

Ordinance to settle the Westminster Militia.

"The Lords and Commons in Parliament assembled, taking into their serious Consideration the State and Condition of the Kingdom of England, and particularly of the City of Westm'r, and Parts adjacent, within the County of Middlesex, hereafter mentioned, do ordain and declare, and be it Ordained and Declared by the Authority of Parliament, That Sir Gregory Norton Knight, Humfrey Edwards, John Trenchard, Cornelius Holland, John Browne Clerk of the Parliament, William Ball, Richard Keble, George Manley, Josias Berners, Richard Graves, Nicholas Martin, John Hall, John Heylin, and Edward Dendy, Junior, Esquires, William Parker Doctor in Physic, James Prince, Silvanus Taylor, George Crompton, John Robinson, Noah Bankes, Peter Lindsey, Richard Bigg, Ralph Farmer, Nicholas Bond, Arthur Squib, John Honnor, Richard Bates, Samuell Smith, John Clendon, Francis Blake, Ralph Grey, John Frampton, Edward Neale, William Dashwood, William Duppa, William Stone, and Walter Frost, or any Seven or more of them, be, and are hereby made, constituted, and appointed, a Committee for the Militia, of and within the City of Westm'r, and the Liberties thereof, the Parishes of Mary Savoy, Clements Danes, Giles in the Feilds, Andrewe's Holborne, Sepulcher's, James Clerkenwell, Mary Islington, and Giles Creplegate, in the County of Middlesex, and every of them; and shall have Power, and are hereby authorized, to assemble and call together all and singular Person and Persons, within the said City, Liberties, and Parishes, that are meet and fit for the Wars; and them to train, exercise, and put in Readiness; and them, after their Abilities and Faculties, well and sufficiently, from Time to Time, to cause to be arrayed and weaponed, and to take the Musters of them in Places most fit for that Purpose; and that they shall have Power to lead, conduct, and employ, the Persons aforesaid, arrayed and weaponed, for the Suppression of all Rebellions, Insurrections, and Invasions, that may happen within the said Parts; and likewise shall have further Power and Authority to lead, conduct, and employ, the Persons aforesaid, arrayed and weaponed, as well within the said Parts, as within any other Part of this Realm of England, or Dominion of Wales, for the Suppression of all Rebellions, Insurrections, and Invasions, that may happen, according as they shall from Time to Time receive Directions from the Lords and Commons assembled in Parliament; and that the said Committee, or any Seven or more of them as aforesaid, shall have Power, and are hereby authorized, to constitute and make Colonels, Captains, and other Officers; and shall have Power to remove and displace Colonels, Captains, and other Officers, from Time to Time, as they, or any Seven or more of them as aforesaid, shall see Cause and think fit; and that the said Committee, or any Seven or more of them as aforesaid, shall have the same Power and Authority, within the said Parts, as any Committee for the Militia of the City of London had the Twentieth Day of July, Anno Domini 1647, by any Order or Ordinance of Parliament; and that all and every Person and Persons, who shall act or do any Act or Thing whatsoever, by virtue of this or any former Order or Ordinance of Parliament concerning the said Militia, shall be saved harmless and indemnified concerning the same, by Authority of Parliament; and shall have the Benefit and Advantage of the Ordinances of the Lords and Commons lately made, for saving harmless and (fn. 3) indemnifying all Persons as have acted by Authority and for the Service of the Parliament.
