1. An Ordinance for Advance of One Thousand Pounds, for the Garrison of Abingdon.

The Answer returned was:

That this House will send an Answer by Messengers of their own to the Ordinance for sending One Thousand Pounds to the Garrison of Abingdon, and the Persons to be added to the Committee at Leycester: To all the rest, their Lordships do (fn. 1) agree.

The Earl of Manchester reported what the Committee hath drawn up to be offered to the House, concerning the List of Officers; which was read, as followeth:

Resolutions concerning the List for the new Model of the Army.

"The Lords do adhere to their Exceptions against such Persons nominated by Sir Thomas Fairefax in this List, to be Officers in the new Model of the Army, against whom they did formerly except; and in regard, by the Ordinance of Parliament concerning the raising of this new Army, the approving or disapproving of such as Sir Thomas Fairefax shall nominate is left free to the Houses of Parliament, they conceive that, as far as this Power relates to them, they have discharged their Duty, by their excepting against those Persons left out in this List; and this they have done with due Regard to the Defence and Safety of the Kingdom.

"They further conceive it may prove very inconvenient to declare and publish the Grounds and Reasons of their Votes and Resolutions in Things Personal, which may tend much to the nourishing of Differences, unto the protracting of Time.

"And they hold it necessary to be the more circumspect at this Time in their Approbation of such Officers as shall be employed in this Army, because this Army is intended to be the chief visible Strength upon which we are to rely for the Safety of the Parliament and Kingdom.

"The Lords do wave their former Recommendation to Sir Thomas Fairefaix, and leave it to him to nominate Persons in the Places of those whom they have excepted."

Ordered, That this be communicated to the House of Commons at a Conference.

Ordered, That a List be made, against Monday Morning next, of such Lords as have Passes to go beyond the Seas.

Parker's Petition, for Money due to him.

A Petition of Henry Parker was read, touching Two Hundred and Forty Pounds owing to him by the State, for Service done; and Ordered to be recommended to the House of Commons.

Ordinance for Martial Law.

Next, the Ordinance concerning Martial Law was read the Third Time, and approved of; and Ordered to be sent to the House of Commons, for their Concurrence.

Message to the H. C. for a Conference about the new Model of the Army.

A Message was sent to the House of Commons, by Sir Edw. Leech and Mr. Page:

To desire a Conference, concerning the List of the Officers.

Sir Edw. Leech, &c. returns with this Answer:

That the House of Commons will give a present Conference, as is desired.

Mr. Serjeant Fynch returned with this Answer:

That the House of Commons agrees to the Alteration in the Ordinance concerning One Thousand Pounds to be sent to Abingdon. To the rest of the Particulars, they will send an Answer by Messengers of their (fn. 2) own.

E. of Chesterfield to be sent to, about a Suit in Chancery against him.

It was moved, "That the Commissioners of the Great Seal desired to know of this House, whether they should write and send a Letter to the Earl of Chesterfield, who is a Prisoner to the Parliament, to answer and appear in the Chancery, to a Suit commenced against him there, at the Prosecution of."

And the House Ordered, That, in this Case, the Commissioners may send a Letter to him to that Purpose.

The Lords went to the Conference; and the House was adjourned till Monday Morning, at Four a Clock.

Ordinance for continuing and paying the Kentish Regiment at Plymouth.

"Whereas the County of Kent hath not only, upon all Occasions, manifested a Readiness to defend their own Liberties, but, out of their singular good Affections, have extended their Assistance to the remotest Parts of this Realm, where Need was, and have levied of themselves, and paid, a Regiment under the Command of Colonel Birch, in the Town of Plymouth, being a Place of great Importance and Consequence, which Regiment hath done good Service there; and the Committee for the Safety of the said Town of Plymouth having taken into their serious Considerations all Wants and Means to defend the said Place, and finding that the same cannot be done without the Continuance of further Assistance from the said County of Kent for some longer Time, the Wealth of the Inhabitants of the said Town being totally exhausted by Two Years and a Half Siege, Decay of Trade, Free Billet, and other heavy and great Pressures on them, did treat with the Committee of the said County of Kent for some Aid in that Behalf; and whereas the Committee for the said County, upon the said Treaty, have condescended to pay all Arrears due to the said Regiment till the First Day of February last past, and also to recruit and pay the same for Four Months next ensuing the said First Day of February, if the Garrison of Plymouth shall be so long continued, provided that there be allowed to the said County of Kent, out of the Proportion assessed and charged upon the said County, by the Ordinance for the new Model, as followeth; that is to say, out of the Seven Thousand and Seventy Pounds charged by the said Ordinance upon the said County, for the Tenth and last Month, so much as shall be laid out and disbursed by the Committee of the said County for the present Recruit of the said Regiment, and for the Pay thereof for the said Four Months, and as shall be laid out for the Return of the said Regiment with their Arms to the said County at the End of the said Time: The Lords and Commons assembled in Parliament, having taken the Premises into their serious and weighty Consideration, do Ordain and Declare, and be it hereby Ordained and Declared, That the said Committee for the County of Kent, in Consideration of the Premises, shall be allowed, out of the Tenth Month's Proportion, so much as shall be disbursed by them for the said Recruit, Pay of the said Regiment for the said Four Months, and for the Return of the said Regiment and Arms unto the County of Kent at the End and Expiration of the said Time; and the Committee of the said County of Kent are hereby authorized and impowered to call back the said Regiment, at the End of the said Four Months; and it is Declared and Ordained, That the said Regiment, being so called back, shall be, and are hereby, discharged from any further Service in the said Garrison at Plymouth; and in case it shall be thought fit, by the said Committee of the said County of Kent, at the Instance of the said Committee for the Safety of Plymouth (the Necessity and Juncture of Affairs so requiring), that the said Regiment shall not be returned, with their Arms, at the End of the said Four Months, to the said County of Kent, that then the said Committee of the said County of Kent be also allowed, out of the said Tenth Month's Proportion, such Charges as they have disbursed for raising and arming the said Regiment; and the said Lords and Commons do hereby accept, approve, and confirm, all and singular the Premises, and the Readiness and Good-will of the said County of Kent; and do Ordain and Declare, That the said County of Kent be allowed, out of the said Tenth Month, according to the Propositions aforementioned, and that they be enabled hereby to recruit, pay, and re-call, the said Regiment as aforesaid, to reimburse themselves as aforesaid: And the said County of Kent, being so reimbursed as aforesaid, if there shall then be any Overplus of the said Tenth Month's Proportion remaining, it is hereby Ordained and Declared, That the said Overplus be accounted for by the said Committee of the County of Kent, unto the Use of the Commonwealth."

Ordinance to continue the One for the additional Duty on Currants to be employed for the Defence of Plymouth.

"The Lords and Commons in Parliament assembled, finding it most necessary, as they are most willing that all Means formerly provided for the Relief and Maintenance of the Town, Garrison, and Fort of Plymouth, and the Island of St. Nicholas, should be continued and be paid, for the Supportation and Subsistence of the same, do Order and Ordain, That the Ordinance of the 23th of September, 1644, for and concerning One Tenth Part added more of Customs and Subsidies for the Defence of the Town and Fort of Plymouth, and the Isle of St. Nicholas, which was to have Continuance, from the 29th Day of the same September, for and during the Space of Six Months, and no longer, shall be, and is hereby Declared and Ordained to be, in Force, and to have Continuance, until the 29th Day of September, which shall be in the Year of our Lord 1645.

"Provided always, and it is further Ordained, That all Currants imported into this Kingdom shall be liable to pay, and shall pay, all such Customs and other Duties, and under such Penalties and Seizures, as any Goods, Wares, or Merchandize, doth or shall pay, for or towards the Relief or Defence of the Town or Fort of Plymouth, the Isle of St. Nicholas, the Town of Poole, and Lyme, and Places adjacent."

Ordinance for a Maintenance for Gloucester, out of the Duty on Currants.

"Whereas, by Ordinance of Parliament, bearing Date Die Veneris, 21 Februarii, 1644, it is Ordained (inter alia), That One Third Part of the Profit that shall arise out of the Customs payable upon Currants shall be appropriated to the Garrison of Gloucester: It is this Day Ordered, by the Lords and Commons assembled in Parliament, That the Commissioners of the Customs shall, from Time to Time, during the Continuance of the said Ordinance, pay over all the said Third Part of the Profit that shall arise out of the Customs payable upon Currants, unto Nathaniell Stephens, Thomas Hodges, and Thomas Pury, Esquires, Members of the House of Commons, for the Use of the Garrison of Gloucester, upon Accompt (if the said Garrison be continued a Garrison), taking their Receipts for the same; which shall be to the said Commissioners, and every of them, a sufficient Discharge in that Behalf."
