Freeman et al. v. Fairlie et al: Freeman et al. v. Oldham et al: Petition of W. Smith et al. to be made Respondents to 1st Appeal, & for an early Day for hearing both, referred to Appeal Com ee.

Upon reading the Petition of William Smith of Kingston, in the County of Surrey, and Charlotte his Wife, and Elizabeth Oldham of Hornsey Lane, in the County of Middlesex; praying their Lordships, "That they may be made Respondents, or be at liberty to appear as Respondents, to the Appeal depending in this House, wherein Ann Freeman, and others, are Appellants, and William Fairlie, and others, are Respondents, in the Place and Stead of John Eborall deceased; and that they may be at liberty to appear by their Counsel at the Bar of this House to defend the same; and that the Appellants may be ordered to proceed with the said Appeal, and also with the Appeal wherein the said Ann Freeman, and others, are Appellants, and the said Elizabeth Oldham, and others, are Respondents, by printing and delivering their Cases within such Time as their Lordships shall think proper; and that the said last-mentioned Appeal may be advanced in the Paper of Appeals, and that the said Two Appeals may come on together to be heard before their Lordships; and that their Lordships will be pleased to fix such Day as to them shall seem meet for the Hearing of the said Appeals:"

The King's Answer to Addresses.

The Earl of Shaftesbury (in the Absence of the Lords with White Staves) reported, "That they had (according to Order) waited on His Majesty with their Lordships Addresses of the 8th and 14th of this instant June; and that His Majesty was pleased to receive the same very graciously, and to say, He would give Directions accordingly."

M. of Donegall et al. v. Grattan et Ux.

Upon reading the Petition and Appeal of The Most Noble George Augustus Marquess of Donegall, The Right Honorable George Hamilton Chichester, commonly called Earl of Belfast, the eldest Son of said Marquess, and Frederick Richard, commonly called Viscount Chichester, eldest Son of the said Earl of Belfast, and a Minor; complaining of several Decrees or Orders of the Court of Chancery in Ireland, of the 12th Day of December 1831, and which said Decrees or Orders were signed and entered on the 25th Day of May 1832, and made in Two certain Causes, in the First of which the said Marquess of Donegall, Earl of Belfast and Viscount Chichester were Plaintiffs, and Henry Grattan Esquire and Mary O'Kelly Grattan his Wife were Defendants; and in the Second, the said Henry Grattan Esquire and Mary O'Kelly Grattan his Wife were Plaintiffs, and the said Marquess of Donegall, Earl of Belfast and Viscount Chichester were Defendants; and praying, "That the said Decrees or Orders may be reversed or varied, or that the Appellants may have such Relief in the Premises, as to this House, in their Lordships great Wisdom, shall seem meet; and that the said Henry Grattan and Mary O'Kelly Grattan may be required to answer the said Appeal:"

Regent's Park Acts Amendment Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to extend the Jurisdiction of the Commissioners acting in the Execution of Three Acts for paving and regulating the Regent's Park, and several Streets and Places in Westminster, to certain other Streets and Places in Westminster; and for other Purposes."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Newcastle upon Tyne, &c. Railway Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to accelerate the raising by The Newcastle upon Tyne and Carlisle Railway Company of a certain Sum for the more speedy Prosecution of the Undertaking."

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Fletcher's Estate Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to vest a Part of the Entailed Estate of Saltoun and others, in the County of Haddington, in Trustees, to sell the same, and apply the Price thereof, or the Securities to be granted thereon, towards satisfying the Debts contracted for Money laid out in the Improvement of the said Entailed Estate; and for feuing certain Parts of the said Entailed Estate in the County of Edinburgh."

The Question was put, "Whether this Bill shall pass?"

With a Bill, intituled, "An Act to apply the Sum of Four Millions out of the Consolidated Fund to the Service of the Year One thousand eight hundred and thirty-two;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Chorlton Row Improvement Bill.

A Message was brought from the House of Commons, by Lord Stanley and others;

To return the Bill, intituled, "An Act for improving and regulating the Township of Chorlton-upon-Medlock, in the County of Lancaster;" and to acquaint this House, That they have agreed to their Lordships Amendments made thereto.

King's County Assizes Bill.

The Order of the Day being read for the Second Reading of the Bill, intituled, "An Act for holding the Assizes for the King's County, in Ireland, Twice in every Year, at Tullamoore, instead of Philipstown;"

The said Bill was accordingly read a Second Time.

Ordered, That the said Bill be committed to a Committee of the Whole House.

Ordered, That the House be put into a Committee upon the said Bill on Monday next.

Representative Peers (Scotland) Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to enable Peers of Scotland to take and subscribe in Ireland the Oaths required for qualifying them to vote in any Election of the Peers of Scotland."

After some Time, the House was resumed:

And The Earl of Shaftesbury reported from the Committee, "That they had gone through the Bill, and made several Amendments thereto, which he was ready to report, when the House will please to receive the same."

Ordered, That the said Report be received on Monday next.

Aston Vicarage (or King's) Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to authorize the Patrons or Patron for the Time being of the Vicarage of Aston juxta Birmingham, in the County of Warwick, to appropriate and assign any Part of the Tithes and Vicarial Dues belonging to the said Vicarage, or any Rent-charge issuing out of the same, for endowing certain new Churches within the said Vicarage if converted into District Parishes or Vicarages, and for selling the Advowsons of the same Churches or new Benefices."

Then an Amendment was made to the said Bill.

The Question was put, "Whether this Bill shall pass?"

It was resolved in the Affirmative.

Customs Wharfs Sale Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act to enable the Commissioners of His Majesty's Treasury to convey certain Premises, the Property of the Crown, situate between London Bridge and the Tower of London."

Then the following Amendment was made to the said Bill:

Pr. 6. L. 35. After ("do") insert Clause A.

"Clause A. And whereas the Premises herein lastlybefore mentioned are subject to Two several Leases for the respective Terms of Sixty-one Years commencing the Twenty-fifth Day of March One thousand eight hundred and twenty: And whereas the Rents in the said Leases were fixed upon the Principle that the said Two Annual Sums should be paid out of the said Consolidated Customs, and not by the Lessees or their Assigns; be it enacted, That during the Continuance of the said Leases no other Sums than those lastly hereinbefore mentioned shall be charged or chargeable on the said Premises on account of the Rates of which those Sums are composed during the Continuance of the said Leases; and that if the said Sums shall at any Time during such Continuance be paid by the Occupier of the said Premises, it shall be lawful for such Occupier to retain all such Sums so paid out of any Rent due and payable or that may become due and payable in respect of the same; and such Payment shall for so far be a Discharge to such Occupier as between him and the Person or Persons entitled to receive the Rent of such Premises."

The Question was put, "Whether this Bill, with the Amendment, shall pass?"

It was resolved in the Affirmative.

Upon reading the Petition of the Landed Proprietors, Landholders and Inhabitants of the United Parishes of Stamullen, Moor-Church and Julianstown, whose Names are thereunto subscribed; praying their Lordships "to abolish altogether the present System of Tithes in Ireland, and to place at the Disposal of Government all the Church Property, to be managed as they may judge most proper for the Interests and Happiness of the People of that distracted Country:"

Reform (Ireland) Bill, Petition from Dungarvan to extend the Franchise & Limits of the Borough.

Upon reading the Petition of the Freeholders and Householders of the Borough and Manor of Dungarvan, County Waterford, Ireland, whose Names are thereunto subscribed; taking notice of a Bill to amend the Representation of the People in Ireland, and complaining of the Curtailment to less than One Eighth of the Extent of the Limits of the Borough and Manor, as proposed by the said Bill, and praying their Lordships "to leave the Petitioners in Possession of their Rights and Privileges by not disfranchising the Five Pound Householders, nor circumscribing the ancient Limits of their Borough:"

Magistracy, & County Expences, Petition from Cheshire respecting.

A Petition of the Rate Payers of the County of Chester was presented and read; praying their Lordships "forthwith to introduce a Bill to abolish in this County the Practice of allowing Magistrates to transact Public Business in Private Rooms, a Practice fraught with every oppressive Abuse, and put an End to in the better administrated Counties of York, Devon, Essex, &c: That their Lordships will be pleased to include Cheshire in the General Police Bill said to be now under Consideration, and thereby rid the Petitioners of the Grievance of their Local Act; and that, during the intervening Period that this Local Act remains in force, some Provision may be made to ensure speedy and cheap Justice to those who may have to complain (as the Petitioners have done at a great Expense and in vain) of its needless, arbitrary and vexatious Enforcement: That as the Magistrates, in the late adjourned Sessions at Chester, held on the 2d Day of February last, unanimously decided that the Rate Payers were not competent Judges of the Necessity of applying the new Police Act to the Districts in which their Property is situated, for the Defence of which Property the new Law was professedly intended, that such Powers may no longer remain vested in such Hands without some Provision to ensure a more just Exercise of them; also, that the Petitioners may be placed on the same Footing as their Fellow Countrymen in Scotland, where no Person who is not possessed of Real or Assessable Property of his own in the County is permitted to take any Part in taxing the Property of his Neighbours: And lastly, that a Law may be passed to prevent the Clergy from the Liability of being withdrawn from their Spiritual Duties by receiving Commissions to act as Justices of the Peace; and that their Lordships will be pleased to take such other Measures for the Redress of the Petitioners various Grievances, and for the Improvement of the Administration of Justice, as in their Wisdom may seem fitting:"

Ordered, That the said Petition be received as the Petition of "I. H. Leeke High Sheriff," who only has signed it.

Church Property, Petition of Northern Political Union for Sale of.

Upon reading the Petition of the Members of the Council of the Northern Political Union, whose Names are thereunto subscribed; praying their Lordships "to pass a Bill directing the Sale of any Church Property in the Diocese of Durham, or in any other Diocese in the United Kingdom, which shall appear to their Lordships to be unnecessary and useless to the Advancement of the Religion of the Church of England; but to vest the Proceeds of such Sales in the Hands of Commissioners who shall be appointed to employ the same in the Liquidation of the National Debt, and for no other Purpose whatsoever:"

Turnpike Road Returns to be forthwith delivered, or certain Clerks of the Peace to attend.

Ordered, That the Clerks of the Peace of the Counties of Derby, Hants, Middlesex, Monmouth, Oxford and Stafford do forthwith lay before this House, A Copy of the Receipt and Expenditure of all Turnpike Roads that were transmitted to their respective Offices for the Year ending Michaelmas 1829, with the Name and Place of Abode of the Clerks of each of such Turnpike Roads; also, A Return to certain Questions to be obtained from the Clerks of the said several Turnpike Roads; and also, A Return to certain Questions to be obtained from the Surveyors of the said several Turnpike Roads, pursuant to the Orders of this House of the 17th of January last; or, in default thereof, do attend this House on the 30th of this instant June.

Norfolk Assizes Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for holding the Assizes for the County of Norfolk, and for the City of Norwich and County of the same City, Twice in every Year at Norwich."

Hastings Improvement Bill.

The Earl of Shaftesbury reported from the Lords Committees, to whom the Bill, intituled, "An Act for paving, lighting, watching, cleansing and improving the Town and Port of Hastings, in the County of Sussex, and for establishing and regulating Markets therein, and for supplying the Inhabitants thereof with Water; and for other Purposes," was committed; "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Glasgow & Carlisle Road Bill.

The Earl of Shaftesbury made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for amending and enlarging the Powers and renewing the Term granted by certain Acts passed for improving the Communication between the City of Glasgow and the City of Carlisle," was committed.

Evan Water Road Bill.

The Earl of Shaftesbury also made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for amending and continuing the Acts relating to the Road from Elvan Foot, in the County of Lanark, to Beatock Bridge, in the County of Dumfries," was committed.

Court of Exchequer, (Scotland,) Returns respecting, Ordered.

Ordered, That there be laid before this House, "A Return of the Number of Writs of Subpona requiring Parties to appear as Defendants before the Court of Exchequer in Scotland, issued during each of the last Ten Years respectively, including the Number of Rules granted for Parties to shew Cause before the said Court, the Number of Informations of Seizure, the Number of Writs of Scire facias, and the Number of Suits arising under Writs of Extent, during the aforesaid Period; distinguishing each Year:"
