The Earl of Northumb. reported, "That the Committee concerning Sir Wm. Withypoole's Business have met, and heard Counsel on both Sides, and have drawn up an Order, as their Resolution, which they offer to their Lordships Approbation."

Letters to The States of The United Provinces.

Next, Five Latin Letters were read, (fn. 1) and were Agreed to:
1. To The States Generall.

3. To The States of Sealand.
4. To The States of Utrect.
5. To The Town of Amsterdam.

Bickley versus Nuttall and Verdon.

Upon reading the Petition of Anne Bickley, and the Affidavit of James Symes: It is Ordered, That Thomas Nuttall and Ric'd Verdon shall appear before this House on Tuesday next, to shew Cause why they do not pay their Debts to Bickly, according to the Order of this House of the 9th of September, 1643, at which Time Bickley is to be heard concerning the Execution of the said Order.

Ordinance for Mr. Aske to be Coroner in the King's Bench.

The Ordinance concerning Mr. Aske to be appointed to be Coroner and Attorney of the King, in the Court of King's Bench, in the Place of Tho. Fanshaw Esquire, was read the Second Time; and being committed to a Committee of the whole House, the House was adjourned during Pleasure, to take the same into Consideration.

The House being resumed;

The said Ordinance was read the Third Time, and Agreed to, with an Amendment; instead of ["holding it during his Natural Life"], to be, ["during the Pleasure of both Houses of Parliament"].

Message to the H. C. that the Lords agree to it;

A Message was sent to the House of Commons, by Sir Rob't Rich and Mr. Page:

To let them know, that this House agrees with them in the Ordinance concerning Mr. Aske, with an Alteration, wherein their Lordships desire their Concurrence.

about the Dutch Ambassadors having an Audience; and with Sir John Conyers's Petition.

2. To put them in Mind of the Message concerning The States Ambassadors.

3. To deliver unto them the Petition of Sir John Conyers, with this Sense, "That this House agrees to the enlarging of his Time, as is desired."

Lady Hatton versus Johnson, for erecting a Building near her House.

Next, Johnson a Carpenter was brought to the Bar, as a Delinquent, for Contempt of an Order of this House, in proceeding to erect an unlawful Cottage upon the Wall of the Lady Hatton, contrary to the Order of this House, of 22th December, 1643.

And James Toovie, upon Oath, deposed, "That he served the said Order of this House upon Johnson, to forbear building of it; but since, the Building hath gone (fn. 1) on, by Johnson."

And it being urged by the Counsel, that this House is erected against Law: It is Ordered, That the next Justice of the Peace is hereby to proceed against the said Johnson, for the pulling down the said Cottage, according to the Law.

White, for printing a scandalous Pamphlet.

Captain Awdley, the Author.

Thomas White a Printer, appointed to appear before this House, for printing a Pamphlet, called "The Kingdome's Intelligencer, &c." wherein some Things were scandalous to the Earl of Stamford; a Member of this House, was called to the Bar; and the Pamphlet being shewed him, he confessed he printed the same; and it being asked who brought it unto him, he said one Captain Awdley; and Captain Awdley being called in, he confessed he did write the said Book, but with no ill Intention.

The House taking this as a great Contempt, in making or printing any Thing concerning the Parliament, without Order of both Houses, or of either House respectively;

Both to put in Bail.

Ordered, That the said Captain Awdley, and Robert White Printer, shall put in Bail, to appear before this House on Friday Morning next; and then this House will take this Business further into Consideration.

Committee to consider of the Abuses in Printing.

Ordered, That the Committee for taking into Consideration some Course for preventing the Abuse of Printing shall (fn. 2) meet on Friday next, at Three of the Clock in the Afternoon.

E. of Salisbury's Parks in Hertfordshire discharged from Assissments, &c.

Upon Information to this House, "That the Earl of Sarum, a Member of this House, finds himself much grieved by the Taxes and the Assessments made by the Committee at Hertford, upon his Parks in the County of Hertford, being Parks that are ancient, and not liable formerly to any Taxes, and no Profit made of them:" It is Ordered, That a Declaration be sent from this House to the Committee at Hertford, to let them know, that their Lordships are of Opinion, "That the Parks of the Earl of Sarum, in the County of Hertford, ought to be discharged from Assessments and Taxes, being ancient Parks, and no Profit made of them." And for this Business in general, this House will take it into Consideration hereafter.

Lord Mountague's Funeral.

Ordered, That a Pass shall be granted, for carrying the Corps of Edward Lord Mountague of Boughton into the County of North'ton, to be buried, with such Attendants, Coaches, and Horses, as there shall be a Particular delivered in.

Sir William Withypoole and Devereux.

This Order cars Date 9 Junii.

The Cause upon the Cross Petitions between Sir Wm. Withipoole Knight, and Mr. Devereux and others, being this Day heard by the Lords Committees, in the Presence of the Parties and their Counsel, their Lordships for the present did think fit, That Mr. Devereux should deliver upon Oath to Mr. Browne, Clerk of the Parliament, all the Bonds and Writings of the said Sir Wm. Withipoole, and all the Deeds and Evidences which have come to the Hands of him, or of any other by his Procurement, concerning any of the Manors, Lands, and Tenements whatsoever, of the said Sir Will'm Withipoole; and that then the same shall be perused by One of the Counsel of either Side; and that such of them as may set forth the Title touching the Manors and Lands of Sudborne, Orford, Chilisford, and Gedgrave, shall be produced before the Lords Committees at their next Hearing of this Cause, for their Lordships better Information, as well touching the Title as Value of the said Manors and Lands; and the other Bonds, Writings, and Evidences, which concern not the Lands in Question, shall forthwith be delivered to the said Sir Will'm Withipoole; and touching all such Goods of the said Sir Wm. Withipoole which the said Mr. Devereux or any others by his Appointment have taken away, their Lordships do think fit that Mr. Devereux shall cause the same, being, as he alledgeth, at some Place in or about the City of London, to be delivered by Inventory to the said Sir Will'm Withipoole, or such as he shall appoint; and their Lordships, at their next Meeting, will give further Order, as well touching the said Manors, Lands, and Evidences, as also touching other the Matters contained in the said Petition.

Ordinance for Mr. Aske to be Coroner and Attorney in the King's Bench.

Whereas Thomas Fanshaw Esquire, Coroner and Attorney of the King, in His Highness's Court of King's Bench, and lately a Member of the House of Commons, hath, contrary to his Duty, deserted the Parliament, and neglected the Execution of his said Office, and is put out of the House of Commons, and his said Office or Offices sequestered, and his Estate therein avoided by Authority of Parliament: It is Ordered, by the Lords and Commons in Parliament assembled, That the Commissioners of the Great Seal of England shall pass a Patent, under the said Great Seal, in Form usual, unto Rich'd Aisk Esquire, of the said Office or Offices of Coroner and Attorney of the King, in His Highness's said Court of King's Bench, to hold and enjoy the same during the Pleasure of both Houses of Parliament: And it is hereby further Ordained, That the said Rich'd Aiske shall hold and enjoy the said Office or Offices, with all the Profits and Advantages thereunto belonging, as fully and amply as the said Thomas Fanshaw, or any other Person, heretofore held or enjoyed the same; and the Justices of the said Court of King's Bench, and every of them, are and is hereby required to swear and admit the said Richard Aisk unto the said Office or Offices accordingly."
