Message from the H. C. with an Ordinance;

A Message was brought from the House of Commons, by Mr. Nobe:

1. To present to their Lordships an Ordinance concerning the Excise, wherein they desire their Lordships Concurrence, with a Schedule of particular Commodities upon which the Ordinance is to work upon.

and for a Conference about Hull.

2. To desire a Conserence, touching some Matters of Importance concerning Hull.

The Answer returned was:

Answer.

That their Lordships will give a present Conference, touching Hull, in the Painted Chamber; concerning the Excise, their Lordships will take the same into speedy Consideration, and return an Answer by Messengers of their own.

Wincot Kester and Chapman.

Ordered, That the Cause between Kester and Chapman, &c. is deferred till Monday next.

Message from the H. C. about the Preachers at the Fast.

A Message was brought from the House of Commons, by Sir Rob't Harley:

That whereas their Lordships have appointed Mr. Bowles and Mr. Gattaker to preach before the Assembly on Friday next, Mr. Gattaker hath petitioned the House of Commons to excuse him, in regard of his great Age; the House of Commons have dispensed with him, and have thought of Mr. Newcomen to preach in his room, wherein they desired their Lordships Concurrence.

The Answer returned was:

Answer.

That their Lordships do agree with the House of Commons, in nominating Mr. Newcomen to preach in the room of Mr. Gattaker.

Committee sent to the Ld. General could not reach him, for Fear of the King's Forces.

The Earl of Holland and the Lord Howard reported to the House, "That they, with the Committee of the House of Commons, have been at Aylsebury, towards their Journey to the Lord General, according to the Command of this House, to hear what he would propose to them concerning the Army; and at Aylsebury their Lordships received a Letter from the Lord General, to inform them that the King's Forces are abroad, therefore it would be dangerous for them to come further, and other Letters from Mr. Pym and Mr. Nicholls; and upon this the Committees returned."

Message to the H. C. to acquaint them with it.

A Message was sent to the House of Commons, by Sir Edward Leech and Doctor Heath:

To desire, at this next Conference, their Lordships may communicate unto them a Letter which the Committee received from the Lord General, that caused their speedy Return.

Earl of Bodford's Witness concerning Whittlesea, released from Arrests. Earls of Suff. and Carlisle to attend the House.

Ordered, That the Witness that came out of Wittelsea, in Behalf of the Earl of Bedford, and is arrested, shall be released, and all Proceedings (fn. 1) thereupon vacated.

Ordered, That the Earls of Suff. and Carlile shall be sent for, to attend this House as (fn. 2) Peers.

The Messengers sent to the House of Commons return with this Answer:

That they are contented that they are to have the Letters communicated at the next Conference.

Sir Tho. Hampson's Saddle-horse returned.

Lieutenant Petty sent for.

Upon Information to this House, "That Sir Thomas Hampson Baronet hath expressed his Affection in a liberal Manner to the Parliament, and hath sent in Horses to the Lord General; yet one Lieutenant Petty, on Saturday last, took away his Pacing-mare, which was for his own Saddle:" Hereupon this House Ordered, That the said Mare shall be restored to the said Sir Thomas Hampson, upon Sight hereof; and the said Lieutenant Petty to appear before this House To-morrow Morning to answer the same.

Beagles to the Prince.

Ordered, That a Pass shall be granted, to permit Three Boys to carry to Oxford some Beagles, for the Prince his Highness.

Message from the H. C. to sit a while;

A Message was brought from the House of Commons, by Mr. Herb't Marley; which consisted of these Particulars:

1. To desire their Lordships to sit a while.

to defer the Conference about Hull;

2. That their Lordships will please to put off the Conference for a while, (fn. 3) in regard that there is a Gentleman lately come from Hull.

for an Answer about the Great Seal;

3. To desire a speedy Answer concerning the Propositions concerning the Great Seal.

to summon the Queen to answer her Impeachment; and for Answers concerning Two Ordinances.

4. That their Lordships would please to issue out Summons for the Queen to answer the Impeachment.

5. To desire an Answer concerning the Ordinance touching Sir Peter Ricault's Adventure in the East India Company.

6. To desire an Answer concerning the Order for Sir David Watkins's Indemnity.

The Answer returned was:

Answer to the H. C.

That their Lordships will sit a while, and have put off the Conference for a while; and touching the rest of the Particulars, their Lordships will take them into Consideration, and return an Answer by Messengers of their own.

It was moved, "That a Committee might be appointed, to consider what Things have passed this House, and sent down to the House of Commons, which concern the Good of the Kingdom, whereof this House hath received no Answer from them."

Committee to consider of what Things have been sent to the H. C. concerning which they have returned no Answer.

And the House Ordered these Committees following.

The Committees are:

Their Lordships, or any Five, to meet on Wednesday next, at Three of the Clock in the Afternoon.

Lord Saldine, a Pass.

Ordered, That the Lord Saldin shall have a Pass, to go into France.

Message from the H. C. that they are ready for a Conference.

A Message was brought from the House of Commons, by Sir Beachamp St Johns:

To let their Lordships know, that the House of Commons are ready for a Conference, presently.

The Answer returned was:

That their Lordships will give a Meeting, at a Conference, presently, in the Painted Chamber.

The House was adjourned during Pleasure, and the Lords went to the Conference; which being ended, the House was resumed.

The Portuguese Ambassador, a Pass.

Ordered, That the Portugall Ambassador shall have a Pass, to go to Oxford, and from thence to the Queen, to condole for the Death of the French King, provided he carry no Monies with him to supply the King withall.

Order for apprehending Rioters in Dorsetshire.

"Whereas, upon Information given unto this House, That divers Persons had riotously assembled themselves, in great Numbers, about Meere, Sha'sbury, Gillingham, Knoyle, Motcombe, and Froome Zellwood, and other Places thereabouts, in the Counties of Dorsetts, Som'setts, and Wilts, being armed with Muskets, Fowling-pieces, and other Weapons, as well offensive as defensive, and broken open Houses, thrown down Inclosures, and robbed and spoiled divers of the King's Subjects, and committed many Outrages, to the Disturbance of the Peace and Quiet of those Counties; and whereas several Orders have been made by this House, for the apprehending and suppressing of the said riotous Persons, which have not taken so good Effect as was expected and desired; and forasmuch as the said riotous Persons do still continue their insolent and lewd Courses, in breaking open the Houses, and cutting and destroying the Inclosures, of divers of His Majesty's good Subjects, in and about the Towns and Places aforesaid, and in compelling divers of His Majesty's good Subjects to pay unto them several Sums of Money, to redeem their Cattle, which such riotous Persons take in and about the Towns and Places aforesaid, to the great Damage of His Majesty's well-affected Subjects, and Disturbance of the Peace of the Kingdom, as by Examination of Witnesses taken upon Oath, and returned to this House, and there remaining of Record, appeareth: These are, therefore, to require you, Captain Edmund Ludlowe, that, with all possible Speed, you apprehend the Bodies of Hugh King, Robert Vanum, Christofer Smart, Christoper Bremon, Jonathan Bowles, Rob't Cleeve, George Garland, Richard Sheane, Robert Wilkins, Rob't Ellen, Robert Barnes of Meere, Rob't Petty alias Johnson, Warner Sudehall, Thomas Alfordy, John Sudehall Junior, Thomas Butt, John Mathewe, and Thomas Brodden of Gillingham, William Bonne, David Beadle, Thomas Ridgley, John Exton, Silvester Deacon, Allexander West, Richard Dowding, Walter Cheesman, Thomas Gatehouse the Younger, and Tristram Luxon of Motcombe, who, by the Examinations aforesaid, appear to be notorious Offenders in the Premises; and that you detain the Persons of those whom you shall apprehend, in your own Custody, within Wardour Castle, of which you are now Governor, until such Order shall be taken with them as by the Lords in Parliament shall be thought fit, or else to convey them safely to the Port of South'ton, there to be shipped, and to be brought to London, to be delivered to the Gentleman Usher attending this House, that such Course may be taken in the Premises as to Justice shall appertain; and all Justices of Peace, Constables, and other His Majesty's Officers and loving Subjects, are hereby required to be aiding and assisting in the said Service, as they will answer the contrary to this House at their Perils."
