Lady Goldsmith versus Sir Hen. Martin.
This Day the Cause was heard, by Counsel on both Sides, between the Lady Gouldsmith and Sir Henry Marten, for joining with her one Mr. Only, in the Administration of the Personal Estate of Sir Edward Only, (fn. 1) Brother to the said Lady Gouldsmith, to whom by Law it wholly appertained, and for forcing her to an Agreement contrary to Law, by which she was prejudiced Fifteen Hundred Pounds, for which she required Damages.
A Message was brought from the House of Commons, by the Lord Viscount Faulkland:
Message from the H. C. for a Conference touching the King's Journey to Scotland.
To desire a Conference, by a Committee of both Houses, as soon as may stand with their Lordships Conveniency, touching His Majesty's Journey into Scotland.
The Answer returned was:
Answer.
That their Lordships will give a Meeting presently, as is desired, in the Painted Chamber.
Lords to report the Conference.

Private Causes put off.
Ordered, That no Private Causes shall be heard at this Bar until the Affairs of the Kingdom be settled against the King's Journey into Scotland; neither shall any Private Causes be heard when Public Bills are appointed to be treated of, nor Committees to sit when this House sits.
Sir Hen. Marten Leave to go into the Country.
Ordered, That Sir Henry Marten shall have Leave to go into the Country for his Health Sake, provided he appoint some Agent to attend the Causes depending in this House against him.
Plusher's Cause re-committed.
Ordered, That the Cause of Simon Plusher, against Sir Henry Marten and others, is re-committed to the Committee for Petitions.
Conference concerning the King's Journey to Scotland.
This House was adjourned during Pleasure, and the Lords went to the Conference; which being ended, the House was resumed.
Ordered, That the Report of this Conference shall be made this Afternoon; and the Debate to be Tomorrow Morning.

The Earl of Dover reported the Bill concerning Shipping-money, as fit to pass, without Amendments.

Hodie 2a vice lecta est Billa, An Act to enable Sir Alexander Denton, Knight, to sell the Manor of Great Barvard, alias Barford St. Michaell, and other Lands in this present Act mentioned, for the Payment of his Debts, and Preferment of his younger Children.
Committed to these Lords following: videlicet,
Any Five or more to meet on Wednesday Morning next, at Eight a Clock, in the Painted Chamber.
Conference concerning the King's Journey to Scotland, and a Regency, reported.
Then the Lord Privy Seal reported the Conference with the House of Commons this Morning, concerning the Custos Regni; and, after he had cited many Pre cedents, which were delivered by Mr. Selden, his Lordship read Two Resolutions, made by the House of Commons, which they desired this House to join with them in: videlicet,
"1. To join in Petition to His Majesty, That He would be pleased to grant a Commission to One or more Person or Persons, to have the Power of a Custos Regni, or Locum tenens, during His Absence out of this Kingdom; and, amongst other Things in special, to grant to such Person or Persons Power to give the Royal Assent in Parliament, and to do such other Things as the King might do in Parliament, if He were present.
"2. That His Majesty be petitioned, That an Act of Parliament may pass, to this Effect: That such a Commission shall not be determined until His Majesty return from Scotland to the Cities of London or Westminster, or be present in full Parliament."
Mr. Smart's Cause.
Ordered, That Mr. Smart's Cause be further heard on Monday Morning next.
Trial of Lord Morley.
Ordered, That the Committee for Privileges do meet on Monday next, in the Afternoon, and consider of the Manner and Proceedings of the Trial of the Lord Morley.
Sir Robert Mansell versus Batson.
Ordered, That the Cause between Sir Robert Mannsell and Richard Batson, shall be referred to the Committee for Petitions; and that the Patent of Sir Robert Mannsell, touching the sole making of Glasses, shall stand and be in the same Condition and Validity as now it is, until the Parliament shall determine the contrary. And further, that the said Richard Batson shall give Security to attend before the Lords Committees, and answer such Complaints as the said Sir Robert Mannsell shall bring in against him, before their Lordships, and be released of his present Restraint.
