Balfour et al. against Scott et al:

After hearing Counsel as well Yesterday as this Day upon the Petition and Appeal of David Hay Balfour, of Leys and Randerston Esquire, and his Guardians, and of Lucy Hay the Widow of Patrick Moncrieff of Reidie, Esquire, deceased, complaining of an Interlocutor of the Lords of Session in Scotland, of the 16th of November 1787, in so far as it finds the Succession to David Scott's personal Estate in England falls to be regulated by the Law of England, and does not find and declare that Henrietta Scott is obliged either to collate the heritable Estate with the Petitioners and the other next of Kin, or to account for and pay over to them what she has received or may receive from the personal Estate of the said David Scott deceased, situated and being in England or elsewhere; and also of another Interlocutor of the said Lords, of the 17th of June 1788, adhering to the said former Interlocutors, on the Points reclaimed against, and refusing the Desire of the Petition; and praying, "That the said Interlocutors, so far as complained of, may be reversed, varied, or amended, or that the Appellants might have such other Relief in the Premises, as to this House, in Their Lordships' great Wisdom, should seem proper;" and likewise upon the Cross Appeal of Miss Henrietta Scott, of Scotstarvet, and her Guardians, complaining of a certain Part of an Interlocutor of the Lords of Session in Scotland, of the 16th of November 1787, and also of another Interlocutor of the said Lords, of the 17th of June 1788, adhering thereto; and praying "That the same might be reversed, varied or amended, or that the Appellants might have such other Relief in the Premises, as to this House in Their Lordships' great Wisdom, should seem meet;" as also upon the Answer of Miss Henrietta Scott, and her Guardians, put in to the said original Appeal, and the Answer of David Hay Balfour of Leys, Esquire, and his Guardians, and Mrs. Lucy Hay, otherwise Moncrieff, put in to the said Cross Appeal, and due Consideration had of what was offered on both Sides in these Causes:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said original Appeal be, and the same is hereby dismissed this House: And it is hereby further ordered and adjudged, That the said Interlocutors of the 16th November 1787, and 17th June 1788, complained of by the said Henrietta Scott in the said Cross-Appeal be, and the same are hereby reversed: And it is hereby declared, that the said Henrietta Scott is entitled to claim her Distribution Share, in the whole personal Estate of her said Uncle David Scott of Scotstarvet in Scotland, without collating his heritable Estate, to which she succeeded as Heir, insomuch as she claims the said Share of the said personal Estate by the Law of England, where the said David had his Domicil at the Time of his Death.

Godmanchester Road Bill.

With a Bill, intituled, "An Act to continue the Terms of two several Acts passed in the Eighteenth Year of the Reign of His late Majesty King George the Second, and in the Third Year of the Reign of His present Majesty, for repairing and widening the Road leading from Godmanchester, in the County of Huntingdon, through Fen Stanton and Cambridge, to the first Rubbing House on Newmarket Heath, in the County of Cambridge;" to which they desire the Concurrence of this House.

A Petition of William Gillespie and another, Appellants in a Cause depending in this House, to which Adeliza Hussey is Respondent, was presented and read; setting forth, "That the Petitioners appealed from an Interlocutory Decree of the Court of Session of the 28th of June 1791, adhering to the Interlocutors of the Lord Ordinary, whereby they were appointed to give in an Account of their Intromissions with the Rents of the Subjects mentioned and referred to in the Cause; that they included in their said Appeal and complained of a subsequent Interlocutor of the Lord Ordinary, dated the 8th of December 1791, pronounced in Prosecution of the said Interlocutory Decree of the Court, whereby his Lordship, in respect that the now Appellants had failed to give in the Accounts, decerned against them in Terms of the Libel; that this Interlocutor ought not to have been appealed from, because a Representation having been given in against the same to the Lord Ordinary, the Matter thereof remains undecided, and therefore the Appellants are advised to amend their Appeal, by striking out what relates to the last-mentioned Interlocutor of the Lord Ordinary;" and humbly pray, "That Their Lordships will be pleased to allow them to amend the said Appeal, by striking out from the same their Complaint against the said Interlocutor of the Lord Ordinary of 8th of December 1791:"

Shrewsbury Canal Bill.

Upon reading the Petition of the Governor and Company of Undertakers for raising Thames Water in York Buildings, Appellants in a Cause depending in this House, to which Alexander M^cKenzie, Writer to the Signet, is Respondent; setting forth, "That the Petitioners having presented their Appeal from certain Interlocutors of the Lords of Council and Session in Scotland, in a Cause at their Instance, for reducing the Purchase of Parts of the Estate of Winton, made by the Respondent Mr. M^cKenzie, then acting in the Character of common Agent for the York Buildings Company and their Creditors, and as such the Seller of the Estate so purchased by himself, and in which Purchase a Charge of Fraud is also made against the Respondent, an Answer was put in for Mr. M^cKenzie as far back as the 21st March last, and on his own Motion the Cause set down for Hearing on the 22d March: That this Question is much connected with the general Business of the York Buildings Company in Scotland, and the Issue of it will have a great Influence on the Funds of the Company, on which they and their Creditors are interested, and while it is undetermined it protracts the Conclusion of the classing of the Creditorson the Funds of the Company, and the Application of the Funds now lying in the Hands of the Court: That the Lord Advocate of Scotland was the leading Counsel for the Appellants in the Court of Session, and they wish for his Assistance before Their Lordships; and he must return to Scotland about the Middle of next Month; in this Situation, and the Question being one on which a great Body of Creditors are interested, and as such may appear entitled to summary Discussion, and besides of great Consequence to the Law of the Country;" the Petitioners humbly pray Their Lordships, "To appoint the said Cause to be heard on Monday the 13th of May next, or on such other Day as to Their Lordships shall seem proper:"

Upon reading the Petition of Warren Hastings Esquire, setting forth; "That the Petitioner once more makes his Appeal, in the Hope that it will be his last, to the Justice of Their Lordships; that he forbears to state the too well-known Hardships of his Case, or the Grounds on which he most solemnly asserts his Belief, that unless Their Lordships, feeling as he feels, the Enormity of the Delays which have attended his longprotracted Trial, shall resolve that it be brought to a Conclusion during this Session of Parliament, it will not, in the ordinary and permitted Course, be ended until the Adjournment of another Year shall have added to the Chances of its being brought to an End, by other Causes than the legal Verdict of Their Lordships, which Their Lordships have been told by one of the Managers of the Prosecution, must inevitably fall with Infamy, either on the Head of the Petitioner, or on those who have consumed so many Years of Their Lordships' Attendance, in labouring to establish their Allegations against him; that although it may not be possible for the Petitioner to know the Time which may be destined to the Duration of the present Session of Parliament, yet he cannot be insensible to the Reports which he has heard of the short Term which is assigned to it, and even its Uncertainty is to him a Source of continual Alarm; that, as an humble Individual, impressed with the firmest Conviction of Their Lordships' Justice and Humanity, he implores Their Lordships to grant to him that Grace which, as a British Subject, he might demand, as his undoubted and unforfeited Birthright, the Benefit of undenied and undelayed Justice; and that Their Lordships will not leave him a single Exception to the rest of his Fellow Subjects of this Kingdom, whose Hearts attest the Wisdom of its Constitution, and who boast of the Blessings which they enjoy under it; Blessings in which he cannot be said to participate, who, having been the Subject of a criminal Prosecution during Six Years, is yet doomed to linger out his Life in the same unmerited State of Suspense, Depression, and (but for the Breath of public Opinion, and the Hopes of Life, sustaining him) of universal and perpetual Ignominy;" and therefore most humbly and servently praying Their Lordships, on whose Justice and Honour he places his firmest Reliance, "To adopt such Measures as to Their Lordships' Wisdom may seem best calculated to accomplish the End which the Petitioner so anxiously solicits, namely, a Close of this long-depending Trial during the present Session of Parliament:"

Provided always, That nothing in this Act contained shall extend or be construed to extend to subject to any Pains or Penalties any Person, for any Act which shall be done in receiving or disposing of any Assignats required by him, as the Dividend on any Sum or Sums which he may possess in the Funds of France, so as the Rent of Lands which such Person may be entitled to on the 20th Day of April 1793, or which shall afterwards come to such Person by any other Title than such as is in this Act prohibited."

The Order of the Day being read for the proceeding further in the Trial of Warren Hastings Esquire, upon the Articles of Impeachment brought up against him by the Commons, for High Crimes and Misdemeanors:
