Hatfield Chace Drainage Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for better draining and preserving certain Lands and Grounds within the Level of Hatfield Chace and Parts adjacent, in the Counties of York, Lincoln, and Nottingham."

Beverley Road Bill.

Margate Pier Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for rebuilding the Pier of Margate, in the Isle of Thanet, in the County of Kent; for ascertaining, establishing, and recovering certain Duties in Lieu of the antient and customary Droits for the Support and Maintenance of the said Pier; for widening, paving, repairing, cleansing, lighting, and watching the Streets, Lanes, Highways, and Public Passages in the Town of Margate and Parish of Saint John the Baptist in the said Isle of Thanet; for settling the Rates of Porters, Chairmen, Carters, and Carmen within the said Town; and for preventing Encroachments, Nuisances and Annoyances therein."

Sarsden, &c. Enclosure Bill.

Kirbymalzeard Enclosure Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for dividing and enclosing certain Moors, Commons, or Waste Grounds in the Parish of Kirkbymalzeard in the County of York," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Parker against Wells, in Error:

The Order of the Day being read for the Judges to deliver their Opinions upon the Questions of Law put to them on Thursday the 3d Day of this instant May, upon arguing the Errors assigned upon the Writ of Error, wherein John Dewye Parker is Plaintiff, and John Wells Defendant:

Judges Opinion delivered:

The Lord Chief Baron of the Court of Exchequer delivered the unanimous Opinion of the Judges present, upon the said Questions as follow:

Upon the First Question, in the Negative."

Upon the Second Question, That a Writ of Venire facias de Novo ought to be awarded."

And with respect to the Third Question, they prayed the Direction of the House, whether, having delivered their Opinion upon the Two First Questions, as before stated, it was necessary for them to answer the same?"

It was resolved in the Negative.

Then the following Order and Judgement was made:

Whereas by Virtue of His Majesty's Writ of Error, returnable into the House of Lords in Parliament assembled, a Record of the Court of King's Bench was brought into this House the 23d Day of March 1786, wherein John Dewye Parker Esquire is Plaintiff, and John Wells Defendant; and Counsel having been heard on Wednesday the 2d and Thursday the 3d Days of this instant May, to argue the Errors assigned upon the said Writ of Error, and the unanimous Opinion of the Judges having been delivered upon Questions of Law to them proposed; and due Consideration had of what was offered on either Side in this Cause:

Judgements reversed, and a Venire Facias de Novo awarded.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgement given in the said Court of King's Bench, reversing a Judgement given in the Court of Common Pleas, be and the same is hereby reversed; and that the Judgement given in the said Court of Common Pleas be and the same is hereby also reversed, and that the Special Verdict given by the Jury being uncertain and insufficient be vacated and annulled: And it is further Ordered, That the said Court of King's Bench do award a Venire Facias de Novo and proceed according to Law, and that the Record be remitted to the said Court of King's Bench.

The Tenor of which Judgement to be affixed to the Transcript of the Record is as follows:

Pugh against Goodtitle, in Error.

The Order of the Day being read for the Judges to deliver their Opinions upon the Question of Law put to them on Friday the 4th Day of this instant May, upon arguing the Errors assigned upon the Writ of Error, wherein Evan Pugh and Samuel Pugh are Plaintiffs and Joseph Goodtitle is Defendant:

Judges Opinion delivered.

The Lord Chief Baron of the Court of Exchequer delivered the unanimous Opinion of the Judges upon the said Question as follows:

That no Person took any Estate under the Will mentioned in the Special Verdict by Way of Devise and Purchase."

Then the following Order and Judgement was made.

Whereas by Virtue of His Majesty's Writ of Error, returnable into the House of Lords in Parliament assembled, a Record of the Court of King's Bench was brought into this House the 12th Day of June 1786, wherein Evan Pugh and Samuel Pugh are Plaintiffs, and Joseph Goodtitle on Demise of Bailey and others are Defendants, and Counsel having been heard on Friday the 4th Day of this Instant May, to argue the Errors assigned upon the said Writ of Error, and the unanimous Opinion of the Judges having been delivered upon a Question of Law to them proposed; and due Consideration had, of what was offered on either Side in this Cause:

Judgement reversed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgement given in the said Court of King's Bench be and the same is hereby reversed.

The Tenor of which Judgement to be affixed to the Transcript of the Record is as follows:

And afterwards to wit, on Tuesday the Fifteenth Day of May in the Twenty-seventh Year of the Reign of our said Lord the King, before our said Lord the King and the Peers in this present Parliament assembled at Westminster, in the said County of Middlesex, come, as well the said Evan and Samuel Pugh, as the said Joseph Goodtitle in their proper Persons, upon which all and singular the Premises having been seen, and by the said Court of Parliament here fully understood, and as well the Record and Process aforesaid, as the Judgement thereon rendered, as the other Matters and Causes by the said Evan and Samuel above assigned for Error, being fully examined and seen, and mature Deliberation thereon had; it appears to the said Court of Parliament now here, that in the Record and Proceedings aforesaid, there is manifest Error, and that the Judgement thereupon given in the Court of the said Lord the King of the Bench is erroneous; therefore it is considered by the said Court of Parliament now here, that the said Judgement for the said Errors, and other Errors in the Record and Proceedings aforesaid, be reversed, annulled, and entirely set aside, and that the said Evan and Samuel be restored to all Things that they have lost by Occasion of the Judgement aforesaid: And thereupon the said Record, and also the Process respecting the said Premises had in the said Court, by the said Court of Parliament are remitted to the Court of our said Lord the King, before the King himself wheresoever, &c. And the same now remain in the said Court (to wit), at Westminster, in the said County of Middlesex, &c.

Navigation Act of Ireland delivered.

The Lord Sydney (by His Majesty's Command) laid before the House,

Attested Copy of an Act for the further Increase and Encouragement of Shipping and Navigation of the Parliament of Ireland.

Ordered, That the said Copy do lie on the Table.

East India Company against Tod in Error.

The Earl of Mansfield, Lord Chief Justice of the Court of King's Bench, in the usual Manner, delivered in at the Table a Writ of Error, wherein

Sussex Gaol Bill:

Hodie 1^a vice lecta est Billa, intituled, "An Act for vesting the Scite, Buildings, and other the Premises belonging to the Old Gaol, or Prison of the County of Sussex, in Trustees, for the Purpose of conveying the same to the Right Honourable Frances Viscountess Irwin, and her Heirs, and to declare the New Goal or Prison lately built, to be the Common Gaol for the said County."

Referred to Judges.

Ordered, That the Consideration of the said Bill be and is hereby referred to Mr. Justice Ashhurst and Mr. Baron Hotham, who are forthwith to summon all Parties concerned therein, and, after hearing them, and perusing a Copy of the Bill attested by the Clerk of the Parliaments, are to report to the House the State of the Case with their Opinion thereupon, under their Hands.

Ashborne Road Bill.

Hodie 2^a vice lecta est Billa, intituled, "An Act for enlarging the Term and Powers of an Act made in the Sixth Year of the Reign of His present Majesty King George the Third, for repairing and widening the Road from Ashborne to Sudbury, and from Sudbury to Yoxhall Bridge, and from the Turnpike Road upon Hatton-Moor to Tutbury, in the Counties of Derby and Stafford."

Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

After hearing Counsel as well on Monday and Tuesday last as this Day, upon the Petition and Appeal of William Sibbald Merchant in Leith, and William Brown Merchant in London; complaining of an Interlocutor of the Lord Ordinary in Scotland, of the 12th of July 1786, and also of an Interlocutor of the Lords of Session there, of the 17th of November 1786; and praying, That the same might be reversed, altered, varied, or amended, or that the Appellants might have such other Relief in the Premises as to this House, in their Lordships great Wisdom, should seem meet;" as also upon the Answer of Andrew Dewar, Cashier to the Merchant Banking Company of Glasgow, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Interlocutors affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal, in Parliament assembled, That the said Petition and Appeal be and is hereby dismissed this House; and that the said Interlocutors therein complained of be and the same are hereby affirmed.

With a Bill, intituled, "An Act to amend an Act passed in the Nineteenth Year of the Reign of His present Majesty, intituled, "An Act to enable the Chancellor and Council of the Duchy of Lancaster to sell and dispose of certain Fee-Farm Rents, and to enfranchise Copyhold and Customary Tenements within their Survey, and to encourage the Growth of Timber on Lands held of the said Duchy, and to enable the said Chancellor and Council to discharge Incumbrances affecting the Possessions of the said Duchy;" to which they desire the Concurrence of this House.

Pitferran Coals Bill.

A Message was brought from the House of Commons, by Mr. Rose and others:

With a Bill, intituled, "An Act to enable the Lords Commissioners of His Majesty's Treasury to purchase of the Proprietors of Coal Mines and Coal Works on the Estate of Pitferran in the County of Fife, the Right of Exemption from Payment of the Duty on Coals exported;" to which they desire the Concurrence of this House.

Indemnity Bill.

A Message was brought from the House of Commons, by Mr. Rose and others:

With a Bill, intituled, "An Act to indemnify such Persons as have omitted to qualify themselves for Offices and Employments; and to indemnify Justices of the Peace or others who have omitted to register or deliver in their Qualifications within the Time limited by Law; and for giving further Time for those Purposes; and to indemnify Members and Officers in Cities, Corporations, and Borough Towns, whose Admissions have been omitted to be stamped according to Law, or having been stamped have been lost or mislaid, and for allowing them Time to provide Admissions duly stamped; and to give further Time to such Persons as have omitted to make and file Affidavits of the Execution of Indentures of Clerks to Attornies and Solicitors;" to which they desire the Concurrence of this House.

Sandwich Paving, &c. Bill.

With a Bill, intituled, "An Act for the better repairing, paving, cleansing, lighting, and watching, the Highways, Streets, and Lanes of and in the Town and Port of Sandwich in the County of Kent, and in the several Parishes of Saint Peter the Apostle, Saint Mary the Virgin, and Saint Clement, in the said Town, Port, and County, and for removing and preventing Encroachments, Nuisances, Obstructions, and Annoyances in the said Highways, Streets, and Lanes, and on the Common Quay belonging to the said Town and Port, and in the Haven adjoining to the said Quay, and the Bridge built over the said Haven; and for regulating the Births and Moorings Places of Vessels at the said Quay, and the proper Times for Vessels to pass through the said Bridge;" to which they desire the Concurrence of this House.

Clyde Navigation Bill.

With a Bill, intituled, "An Act for altering and extending the Line of the Cut or Canal authorized to be made and maintained by so much of several Acts made in the Eighth, Eleventh, Thirteenth, and Twenty-fourth Years of the Reign of His present Majesty, as authorizes the making and maintaining a Navigable Cut or Canal from the Frith or River of Forth, at or near the Mouth of the River of Carron, in the County of Stirling, to the Frith or River of Clyde, at or near a Place called Dalmuir Burnfoot, in the County of Dumbarton, and also a Collateral Cut from the same to the City of Glasgow; for deepening the said Cut or Canal; and for explaining and amending so much of the said Acts as relates to the making and maintaining the said Cut or Canal;" to which they desire the Concurrence of this House.

Edinburgh Surgeons Bill.

With a Bill, intituled, "An Act for confirming a Charter or Letters Patent, granted by His Majesty to the Royal College and Corporation of Surgeons of the City of Edinburgh, so far as relates to a Scheme of raising a Fund for a Provision for the Widows and Children of the Members of the said Corporation, and of their Clerk with certain Alterations, and for establishing the said Scheme, and empowering the Corporation and the Trustees and Officers elected for managing the Fund effectually to carry the said Scheme into Execution;" to which they desire the Concurrence of this House.

Lastingham Enclosure Bill.

Walsall Road Bill.

With a Bill, intituled, "An Act for enlarging the Term and Powers of an Act passed in the Sixth Year of the Reign of His present Majesty, for repairing and widening the Road from Muckley Corner to Walsall and Wednesbury, and to Leigh Brook and Ocker Hill, and several other Roads in the County of Stafford, so far as the same relates to the Two first Districts of Road therein comprized;" to which they desire the Concurrence of this House.

Hursley Roads Bill.

With a Bill, intituled, "An Act to continue the Term, and alter and enlarge the Powers of an Act made in the Sixth Year of the Reign of His present Majesty, for repairing and amending the Road from the present Turnpike Road in the Parish of Hursley, in the County of Southampton, through the Borough of Andover to the Town of Newbury, in the County of Berks, and from Newbury to Chilton Pond and Newtoun River; and for amending and keeping in Repair the Road from the South End of Bartholomew Street, in the said Town of Newbury, to the Turnpike Road at Speenhamland, in the said County of Berks;" to which they desire the Concurrence of this House.

Clyde Navigation Bill.
