Ordered, That the said Bill be committed to the Consideration of the Lords Committees aforenamed:

Their Lordships, or any Five of them, to meet on Monday next, at the usual Time and Place; and to adjourn as they please.

Malt Bil.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for continuing and granting to His Majesty certain Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One thousand seven hundred and eighty-seven."

After some Time, the House was resumed:

And the Lord Scarsdale reported from the Committee, That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Land Tax Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for granting an Aid to His Majesty by a Land Tax to be raised in Great Britain for the Service of the Year One thousand seven hundred and eighty-seven."

After some Time, the House was resumed:

And the Lord Scarsdale reported from the Committee, That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Canterbury Paving Bill.

A Message was brought from the House of Commons, by Mr. Charles Robinson and others:

With a Bill, intituled, "An Act for paving, cleansing, lighting, and watching the Streets, Lanes, and other public Passages and Places within the Walls of the City of Canterbury and the Liberties thereof, and also several Streets and other Places near or adjoining to the said City, and for removing and preventing Encroachments, Obstructions, Nuisances, and Annoyances therein;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Pucklechurch Roads Bill.

The Lord Scarsdale reported from the Lords Committees to whom the Bill, intituled, "An Act for more effectually repairing the Roads leading from Mead Brook, which divides the Parishes of Pucklechurch and Mangotsfield in the County of Gloucester, to Christian Malford Bridge in the County of Wilts, and from Pucklechurch aforesaid to certain Coal Mines in the said Parish," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Motion that no Address or Resolution of the House can be binding in its Legislative Capacity:

Moved to resolve, "That no Address to the Throne, and no Resolution of this House, can bind this House in its Legislative Capacity, or bar the Subject's Right of Petitioning this House upon any Bill depending in Parliament, though such Bill be founded upon and conformable to Resolutions to which this House has previously agreed."

Which being objected to;

After Debate,

Message and Resolutions of H. C. respecting Trade with France, House in Committee thereon.

It was moved, "That the Order of the Day for the House to-resolve itself into a Committee to take into Consideration the Message and Resolutions communicated by the Commons at a Conference on Friday last, and for the Lords to be summoned, be now read."

The same was accordingly read by the Clerk.

Then the House was adjourned during Pleasure, and put into a Committee thereupon.

After some Time, the House was resumed:

And the Lord Scarsdale reported a Progress.

Ordered, That this House will this Day, at Twelve o'Clock, resolve itself into a Committee of the whole House to consider further of the said Message and Resolutions communicated by the Commons at a Conference on Friday last; and that the Lords be summoned.

Causes put off.

Ordered, That the Hearing of the Cause, wherein Alexander Clerk Merchant in Aberdeen, is Appellant, and Hugh Gordon is Respondent, which stands appointed for this Day (Friday), be put off to Monday next; and that the rest of the Causes be removed in Course.

A Message was brought from the House of Commons, by the Lord Charles Spencer and others:

With a Bill, intituled, "An Act for dividing and enclosing the Open Common Fields, Common Meadows, Cow Commons, Linchets, and Pieces or Parcels of Waste Land or other Ground intermixed with or adjoining to the said Common Fields and Common Meadows, situate in the Parish of Goring in the County of Oxford;" to which they desire the Concurrence of this House.

Harlow Road Bill.

A Message was brought from the House of Commons, by Mr. Bramston and others:

With a Bill, intituled, "An Act for continuing and enlarging the Term and Powers of several Acts made in the Tenth Year of the Reign of King George the First, the Sixteenth Year of the Reign of King George the Second, and the Ninth Year of the Reign of His present Majesty, for repairing the Road from the North Part of Harlow Bush Common in the Parish of Harlow to Woodford in the County of Essex; and for repairing and widening the Road from Epping through the Parishes of Northweald Bassett, Bobbingworth, High Ongar, Chipping Ongar, and Shelley, to the Four Want Way in the said Parish of Shelley, and from thence through the Parishes of High Ongar and Norton Mandeville to the Parish of Writtle in the said County;" to which they desire the Concurrence of this House.

The said Two Bills were, severally, read the First Time.

His Majesty being seated on the Throne, adorned with His Crown and Regal Ornaments, and attended by His Officers of State (the Lords being in their Robes), commanded the Gentleman Usher of the Black Rod to let the Commons know, "It is His Majesty's Pleasure, that they attend him immediately in this House."

Who being come with their Speaker;

He, after a short Introduction in relation to the Money Bills to be passed, delivered them to the Clerk who brought them to the Table, where the Deputy Clerk of the Crown read the Titles of those and the other Bills to be passed, severally, as follow; (videlicet)

1. "An Act for continuing and granting to His Majesty, certain Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One thousand seven hundred and eighty-seven."

To these Bills the Royal Assent was pronounced, severally, by the Clerk Assistant, in these Words; (videlicet)

Canterbury Paving Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for paving, cleansing, lighting, and watching the Streets, Lanes, and other Public Passages and Places, within the Walls of the City of Canterbury and the Liberties thereof, and also several Streets and other Places near or adjoining to the said City, and for removing and preventing Encroachments, Obstructions, Nuisances, and Annoyances therein," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Kessingland, &c. Enclosure Bill.

The Lord Scarsdale also reported from the Lords Committees, to whom the Bill, intituled, "An Act for dividing and enclosing, the Commons and Waste Lands, within the Parishes of Kessingland and Covehithe, otherwise North Hales in the County of Suffolk," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Pughsagainst Goodtitle, in Error, Judges to attend.

Ordered, That the Judges do attend this House on Monday the 30th Day of April next, upon arguing the Errors assigned upon the Writ of Error, wherein Evan Pugh and Samuel Pugh are Plaintiffs, and Joseph Goodtitle is Defendant.

Report from Committee, on Message and Resolutions of H. C. respecting Trade with France.

The Order of the Day being read for receiving the Report from the Committee of the whole House, to whom was referred the Consideration of the Message and Resolutions, communicated by the Commons at a Conference on the 23d of February last; and for the Lords to be summoned:

Dillingham and Gordon's Petition referred to Judges.

DISSENTIENT.

Because though we are at all Times desirous to join in Expressions of Gratitude to His Majesty for His gracious Intentions to promote the Welfare of His People, we cannot concur in the Address proposed. Our regard for the Principles of the Constitution will not permit us to say that we have taken into our most serious Consideration the Provisions of a Treaty which must undergo a more serious Consideration in the regular Progress of a Bill, nor to give Assurances that we shall take such Steps as may be necessary for giving Effect to a System which it will be our Duty freely to discuss in all the Stages of Deliberation, that by the Rules of Parliament must precede Decision.

The Observance of these Rules is more particularly necessary, when a System is proposed, repeatedly declared by solemn Acts of the Legislature to be pernicious and apparently opposite to that Course of Policy, by which, for a Century past, this Nation has increased its Navigation and Commerce, maintaining always an independent and sometimes an eminent Station amongst the Powers of Europe.

Complaint relating to Stoppages in the Streets.

Complaint was made to the House by the Yeoman Usher of the Black Rod, "That John Leeke Cooper, did this Day, contrary to and in contempt of their Lordships' Order for preventing Stoppages and Obstructions in the Streets and Passages leading to this House, insult and abuse Henry Smallwood, the Constable, and William Shipman, Marshalman, then attending their Duty, pursuant to the said Order, in Breach of the Privilege of this House."

And thereupon the said John Leeke was ordered to be brought to the Bar:

Henry Smallwood, the Constable, was called in, and examined upon Oath at the Bar, in relation to the Matter of the said Complaint. And the said John Leeke was asked, "What he had to say in his Defence?" And being heard:

After hearing Counsel as well on Wednesday and Thursday last as this Day, upon the Petition and Appeal of Alexander Clerk Merchant in Aberdeen, complaining of Three Interlocutors of the Lord Ordinary in Scotland, of the 25th of January, 23d of February, and 10th of March 1785, and also of Three Interlocutors of the Lords of Session there, of the 29th of November and 14th and 17th of December 1785; and praying, "That the same might be reversed, varied, or altered, or that the Appellant might have such other Relief in the Premises as to this House, in their Lordships' great Wisdom, should seem meet;" as also upon the Answer of Hugh Gordon, Watchmaker in Aberdeen, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Cause remitted.

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this Cause be remitted back to the Court of Session in Scotland, without Prejudice, with Liberty to the Defender to produce such Proofs as he can, that James Clerk, on the 30th of September 1778, was entitled to the Debt of Sixty Pounds due by Raitt, or the Trustees of Raitt, mentioned in the Pleadings, reserving such Objections to the Competency of the Evidence, as the Nature of the Evidence itself or the Period of the Cause in which it is produced may be liable to.

The Lord Chancellor reported, "That both Houses of Parliament did Yesterday present to His Majesty their humble Address; to which His Majesty was pleased to return the following most gracious Answer:

Harlow Road Bill:

Hodie 3a vice lecta est Billa, intituled, " An Act for continuing and enlarging the Term and Powers of several Acts made in the Tenth Year of the Reign of King George the First, the Sixteenth Year of the Reign of King George the Second, and the Ninth Year of the Reign of His present Majesty, for repairing the Road from the North Part of Harlow Bush Common, in the Parish of Harlow, to Woodford in the County of Essex; and for repairing and widening the Road from Epping, through the Parishes of Northweald, Bassett, Bobbingworth, High Ongar, Chipping Ongar, and Shelley, to the Four Want Way in the said Parish of Shelley, and from thence through the Parishes of High Ongar and Norton Mandeville, to the Parish of Writtle in the said County."

A Petition of Archibald Taylor Plaintiff in a Writ of Error depending in this House, and of John Blain Defendant thereto, was presented and read; setting forth, That this Cause by other Causes having been delayed, now stands for Hearing on Wednesday next; that it is a Cause of Consequence to the Public Revenue, and to many Individuals, the Question being, "Whether Coal carried in Boats or Vessels upon the River or Firth of Clyde in North Britain be, according to the Construction of the several Statutes, liable to pay the Duties laid upon Coal carried to Sea;" that Mr. Solicitor General of Scotland, Counsel for the Defendant in Error, and Mr. Wight who was of Counsel for the Plaintiff in the Court below, and has settled his Case, and who means to argue the Cause before their Lordships, are to be in London in the Course of the ensuing Week, but the Petitioners are apprehensive that they may not arrive in Time to prepare themselves, if the Cause should be heard before Monday the 19th instant;" and therefore praying, "That their Lordships will be pleased to delay the Hearing of this Cause till Monday the 19th instant, or till such other Day as their Lordships think most proper."

And thereupon, the Agents on both Sides were called in and heard at the Bar:
