Ld. Macdonald against Macleod et al.
After hearing Counsel, as well on Wednesday last as this Day, upon the amended Petition and Appeal of Sir Alexander Macdonald of Macdonald, Baronet, (now Lord Macdonald) complaining of Part of an Interlocutor of the Lords of Session in Scotland of the 17th of July 1771, and also of Part of another Interlocutor of the said Lords, of the 19th of June 1772, and praying, "That the same might be reversed, varied or altered, or that the Appellant might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom should seem meet;" as also upon the Answer of Norman Mac Leod and his Guardians put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:
Interlocutors affirmed with Costs.
It is Ordered and Adjudged by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be and is hereby dismissed this House, and that the said Interlocutors therein complained of be and the same are hereby affirmed: And it is further ordered, That the Appellant do pay or cause to be paid to the said Respondent the Sum of One hundred Pounds for his Costs in respect of the said Appeal.
Johnston against Chalmers and Watson, Petition of Agent to receive Appeal.
A Petition of Mr. John Spottiswoode, Agent for the Reverend Mr. David Johnston, was presented and read; setting forth, "That by the Post which arrived from Scotland on Monday last, the Petitioner received a Petition of Appeal to their Lordships, on Behalf of the Reverend Mr. David Johnston Minister, and the Remanent Members of the Kirk Session of North Leith from several Interlocutors pronounced by the Court of Session in Scotland; that at the Time of pronouncing the last Interlocutor their Lordships House was adjourned for the Christmas Holydays, and the Appellant's Agent in Scotland believed and understood that the Twenty Days limited by their Lordships Standing Order, No. 55, were to be accounted during the Time their Lordships were actually sitting, and did not commence till their Meeting after the Recess; that it will be a great Loss to the said Mr. David Johnston, if from any Misapprehension of the Effect of their Lordships Order, his Purpose of appealing in this Session should be defeated, and he should be under the Necessity of delaying it till next Session of Parliament, the Matter in Dispute being the Tythe of Fish, a principal Part of his Stipend, as Minister serving the Cure in the Parish of North Leith;" and therefore praying their Lordships, "That he may be at Liberty to present the said Appeal for the said Reverend Mr. David Johnston and others, and their Lordships will receive the same, and make the usual Order to the said James Chalmers and John Watson to answer the same:"
And thereupon the Agent was called in, and heard at the Bar; and being withdrawn,
Ordered, That the Petitioner be at Liberty to present the said Appeal as desired.
Smyth's Naturalization, &c. Bill.

Pinnock's Petition referred to Judges.
Upon reading the Petition of Elizabeth Pinnock Widow and Relict of Henry Pinnock, late of New Windsor, in the County of Berks, Gardener, deceased, for and on Behalf of Ann Pinnock their only Child, an Infant of the Age of Three Years; praying Leave to bring in a Bill for the Purposes in the said Petition mentioned:
It is Ordered, That the Consideration of the said Petition be, and is hereby referred to Mr. Justice Buller and Mr. Baron Perryn, who are forthwith to summon all Parties concerned in the Bill, and after hearing them are to report to the House the State of the Case, with their Opinion thereupon, under their Hands; and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition; and also, that the Judges, having perused the Bill, do sign the same.
Hingham Enclosure Bill.
The Lord Bishop of St. Davids reported from the Lords Committees, to whom the Bill, intituled, "An Act for dividing and enclosing the Commons and Waste Lands within the Parish of Hingham, in the County of Norfolk," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made some Amendments thereto."

Johnston against Chalmers and Watson.
Upon reading the Petition and Appeal of the Reverend Mr. David Johnston Minister, and the Remanent Members of the Kirk Session of North Leith, complaining of Three Interlocutors of the Lord Ordinary in Scotland, of the 23d of July, the 29th of November, and 16th of December 1777; and also of Two Interlocutors of the Lords of Session there, of 18th of November and 5th of December 1780, in so far as they find the Defenders not liable for the Tiend or Duty of Fish, which have paid Tiend elsewhere, or shall be afterwards exported; and praying, " That the same may be reversed, varied or altered, or that the Appellant may have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, seem meet; and that James Chalmers Merchant, and John Watson Cooper in Leith, may be required to answer the said Appeal:"

Stratford, &c. Road Bill:
Hodie 3a vice lecta est Billa, intituled, " An Act for continuing the Term of an Act made in the Twenty-seventh Year of the Reign of His late Majesty, "for repairing and widening the Roads from the Borough of Stratford-upon-Avon, in the County of Warwick, through Alcester in the said County, and Feckenham to a Place called Bradley Brook, in the County of Worcester, and from Alcester through Great Coughton and Crab's Cross, in the said County of Warwick, and through Hewell Lane and Burcott to the Cross of Hands on a Common called The Leekhay, and out of Hewell Lane through Church Lane and Tutnell, to Bromsgrove, in the said County of Worcester."
The Question was put, "Whether this Bill shall pass?"
It was resolved in the Affirmative.

This Day George Lord De Ferrars, and Robert Lord Romney, took the Oaths, and made and subscribed the Declaration; and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.
Butler against Butler et al.
A Petition of Sarah Butler Widow, and Robert Bryan Esquire, and Sarah Elizabeth his Wife, Respondents to the Appeal of James Butler Esquire, was presented and read; setting forth, "That the Appellant James Butler, in the Month of November 1779, presented his Appeal to their Lordships, from a Decree or Order of the Court of Chancery in Ireland, of the 28th of April 1774, which Appeal came on to be heard before their Lordships on the 31st Day of May last, when Counsel for the Petitioners, but no Counsel appearing for the Appellant, their Lordships were pleased to dismiss the said Appeal, and to affirm the said Decree or Order with Fifty Pounds Costs; that on bringing the said Appeal, Mr. Joseph Hickey, the Appellant's Agent, entered into the usual Recognizance for Payment of such Costs as their Lordships should appoint; that the Petitioners have caused the said Appellant, James Butler, to be served with a Copy of their Lordships Order of the 31st of May last, and have also caused a Demand to be made upon the said Appellant for the said Sum of Fifty Pounds by the said Order directed to be paid as aforesaid, but the said Appellant hath absolutely refused to pay the same, and the said Joseph Hickey hath also refused to pay the said Fifty Pounds, although the Petitioners have caused him also to be served with their Lordships said Order of the 31st of May last, and have caused a Demand in like Manner to be made upon him for such Sum of Money;" and therefore praying their Lordships, That the said Recognizance entered into by the said Joseph Hickey may be estreated into His Majesty's Court of Exchequer, for the Benefit of the Petitioners, or to give them such other Relief in the Premises as to their Lordships shall seem meet."
Whereupon Mr. Lane, the Agent for the Respondents, was called in; and being sworn, acquainted the House, "That he applied to the said Mr. Hickey, a few Days after their Lordships Judgment was pronounced, for the said Costs, who told him he would write to Ireland about it; that he has applied to him several Times since, but he refused to pay the same; that on the 3d of July last he wrote a Note to him, acquainting him that he would apply to the House to have the Recognizance estreated:" Mr. Lane then produced and read at the Bar an Affidavit of Denis Leeson of Cullum in the County of Kilkenny in Ireland, of his having served the said Appellant James Butler, on the 19th of December 1780, with a Copy of the Judgment of the House, and of his having demanded the said Costs of the Appellant, who refused to pay the same.
He was directed to withdraw.
Recognizance estreated.
Ordered, That the Recognizance entered into by the said Joseph Hickey to His Majesty in the Sum of Two hundred Pounds for the Payment of such Costs as this House should appoint in case the said Decree from which the said James Butler appealed, should be affirmed, be estreated into His Majesty's Court of Exchequer for the Benefit of the Petitioners.
Causes put off.
Ordered, That the Hearing of the Cause wherein John Ambrose is Appellant, and the Reverend Robert Hodgson Clerk and Catherine his Wife, and Catherine Belchier, are Respondents, which stands appointed for this Day, be put off to Wednesday next, and that the Judges do then attend; and that the rest of the Causes be removed in Course.

Copies of the Judgements and Decrees of the Commissioners appointed pursuant to an Act passed in the Twentieth Year of His present Majesty's Reign, intituled, "An Act to vest certain Messuages, Lands, Tenements and Hereditaments in Trustees, for the better securing His Majesty's Docks, Ships and Stores at Plymouth and Sheerness, and for better defending the Passage of the River Thames at Gravesend and Tilbury Fort;" so far as the same relate to the Purchase of the Messuages, Lands, Tenements and Hereditaments necessary for the better securing His Majesty's Docks, Ships and Stores at Sheerness, and for better defending the Passage of the River Thames at Gravesend and Tilbury Fort."
Also, "Copies of the Judgements and Decrees of the Commissioners appointed pursuant to an Act passed in the Twentieth Year of His present Majesty's Reign, intituled, "An Act to vest certain Messuages, Lands, Tenements and Hereditaments in Trustees, for better securing His Majesty's Docks, Ships and Stores at Chatham."
And the Titles thereof being read by the Clerk;

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act for continuing the Term, and altering and enlarging the Powers of Two Acts of the Ninth and Twenty-eighth Years of His late Majesty King George the Second, for amending and keeping in Repair such Part of the Roads described in the last mentioned Act, as leads from the End of Culham Bridge next to Culham, in the County of Oxford, to the End of Burford Bridge next to Abingdon, in the County of Berks; and from the Mayor's Stone at the End of Boar Street, in the Town of Abingdon aforesaid, to Shippon, in the said County of Berks, and from thence to the West End of the Town of Fyfield, in the same County," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for naturalizing John Herman Kater," was committed.
Chasseaud's Naturalization Bill.
The Lord Scarsdale made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for naturalizing Peter Chasseaud," was committed.

The Lord Scarsdale also made the like Report from the Lords Committees, to whom the Bill, intituled, "An Act for naturalizing James Mary Siordet and John Lewis Hooffstetter," was committed.
