Petition of Merchants trading to Scotland, relating to the Bill for regulating the Currency of the Scotch Bank Notes.

Upon reading the Petition of the several Persons whose Names are thereunto subscribed, being the principal Merchants and Traders to Scotland; taking Notice of Bill depending in this House, for the better Regulation of the Paper Currency in that Part of Great Britain called Scotland; setting forth, That the many Difficulties and Delays, added to the Expense, of getting Scotch Bank Notes exchanged for Specie, is not only inconvenient and troublesome, but attended with great Hazard to the Credit of all Merchants dealing to that Part of the Kingdom; and, unless a speedy and effectual Remedy be provided thereto, so as to make their Bank Notes payable on Demand, in the fame Manner as those in England, and summary Execution to proceed thereon, in the fame Manner as when Protest is taken on Foreign Bills, without any Sift or Demurr, it will be impossible for them to carry on their different Branches of Trade any longer, with Safety to themselves, or Advantage to their Correspondents, being obliged to be at a very considerable Expense to pay for those Delays, which enhances the Price of Wares and Merchandizes, and consequently diminishes the Consumption; the Nature of these Bank Notes being such, that they cannot have reasonable Returns if a sudden Demand should come upon them, being not only liable to be distressed by the Advantage taken of the optional Clause, but the Exchange is often so great, that no Trade or Manufacture can endure it; and therefore praying their Lordships, to provide a Remedy for there great Evils, by which their Commodities are grievously taxed, and they greatly distressed:

It is Ordered, That the said Petition be referred to the Committee of the whole House to whom the Bill, intituled, An Act for regulating the Currency and due Payment of Notes and Bills, issued by the Banks, Banking Companies, and Bankers, in that Part of Great Britain called Scotland; and for restraining the Practice of issuing Notes and Bills, for Sums less than Twenty Sillings, by such Banks, Banking Companies, and Bankers, stands referred.

PRAYERS.

The House was adjourned during Pleasure, to robe.

The House was resumed.

The King present:

His Majesty, being seated on the Throne, adorned with His Crown and Regal Ornaments, and attended by His Officers of State (the Lords being in their Robes); commanded the Gentleman usher of the Black Rod to let the Commons know, It is His Majestys Pleasure, they attend Him, immediately, in this House.

Who being come, with their Speaker;

The Deputy Clerk of the Crown read the Titles of the Bills to be passed, as follow; (videlicet,)

Bills passed:

1. An Act to confirm all Leases already made, by Archbishops and Bishops, and other Ecclesiastical Persons, of Tithes and other Incorporeal Hereditaments, for One, Two, or Three, Life or Lives, or Twenty-one Years; and to enable them to grants such Leases, and to bring Actions of Debt for Recovery of Rents reserved, and in Arrear, on Leases for Life or Lives.

2. An Act for enlarging the Times limited for executing and performing several Provisions, Powers, and Directions, in certain Acts of this Session of Parliament.

To these Bills the Royal Assent was pronounced by the Clerk, as follows; videlicet,

Le Roy le veult.

Then His Majesty was pleased to speak as follows:

His Majestys Speech, recommending the Consideration of a Regency Bill:

My Lords, and Gentlemen,
The tender Concern which I feel for My faithful Subjects makes Me anxious to provide for every possible Event, which may affect their future Happiness or Security.

My late Indisposition, though not attended with Danger, has led Me to consider the Situation in which My Kingdoms and My Family might be left, if it should please God to put a Period to My Life, whilst My Successor is of tender Years.

The high Importance of this Subject, to the publick Safety, good Order, and Tranquillity; the Paternal Affection which I bear to My Children, and to all My People; and My earnest Desire that every Precaution should be taken, which may tend to preserve the Constitution of Great Britain undisturbed, and the Dignity and Lustre of its Crown unimpaired; have determined Me to lay this weighty Business before My Parliament: And, as My Health, by the Blessing of God, is now restored, I take the earliest Opportunity of meeting you here, and of recommending to your most serious Deliberation the making such Provision as would be necessary, in case any of My Children should succeed to the Throne before they shall respectively attain the Age of Eighteen Years.

To this End, I propose to your Consideration, whether, under the present Circumstances, it will not be expedient to vest in Me the Power of appointing, from Time to Time, by Instrument in Writing, under My Sign Manual, either the Queen, or any other Person or My Royal Family usually residing in Great Britain, to be the Guardian of the Person of such Successor, and the Regent of these Kingdoms, until such Successor shall attain the Age of Eighteen Years; subject to the like Restrictions and Regulations as are specified and contained in an Act passed upon a similar Occasion, in the Twenty-fourth Year of the Reign of the late King My Royal Grandfather: The Regent so appointed to be assisted by a Council, composed of the several Persons, who, by reason of their Dignities and Offices, are constituted Members of the Council established by that Act, together with those whom you may think proper to leave to My Nomination.

Then His Majesty was pleased to retire.

And the Commons withdrew.

The House was adjourned during Pleasure to unrobe.

The House was resumed.

Message to H. C. to continue sitting;

A Message was sent to the House of Commons, by Mr. Montagu and Mr. Holford:

To desire that they will continue sitting for some Time.

The Lord Chancellor reported His Majestys Speech:

And the same being read by the Clerk.

Order for an Address on His Majestys Speech:

Ordered, That an humble Address be presented to His Majesty, To acknowledge the peculiar Goodness expressed in His most Gracious Speech from the Throne.

To congratulate His Majesty on His Recovery from His late indisposition; and to express the most grateful Sense of the affectionate Regard which His Majesty has shewn to the Satisfaction of His Parliament, by taking the earliest Opportunity of giving them so pleasing a Proof of the Re-establishment of His Health.

To assure His Majesty, that the constant Tenor of His just and constitutional Government had already filled our Minds with a most cordial Sense of Gratitude; and that the new Proof which His Majesty is now pleased to give of His truly paternal Tenderness, by extending his Concern to the Stability, Dignity, and Lustre, of His Crown, and for the Happiness of His People, beyond the Period of His own Continuance amongst them, must inspire us with still higher Degrees, if possible, of Reverence and Affection.

To express our Admiration of that Magnanimity which enables His Majesty to look forward, with a cool Composure of Thought, to an Event, which, whenever it shall please God to permit it, must overwhelm His loyal Subjects with the bitterest Distraction of Grief.

To declare our just and grateful Sense of the Blessings we enjoy under His Majestys auspicious Reign; and our ardent Wishes to transmit them, under the same gracious Care and Protection, to our Children.

To assure His Majesty, that, feeling, as we do, the infinite Importance of perpetuating in all Events our happy Constitution, we will not fail to apply ourselves to the immediate Consideration of the momentous Object which He has been pleased to recommend to us; that our Deliberations concerning it will be animated by the most zealous Regard to the great Object of His Majestys salutary Designs, will be influenced by a just Confidence in His princely Wisdom and paternal Concern for His People, and shall be concluded with all the Dispatch compatible with the singular Importance of the Subject; most earnestly praying, that, by His Majestys living to form a worthy Successor to the Throne by His own Precepts (fn. 4) and Example, a Precaution so expedient in Prospect may become useless in the Event.

Then the Lords following were appointed a Committee, to prepare an Address pursuant thereto (videlicet,)

L. President.
L. Privy Seal. L. Abp. Canterbury. L. Le Despencer.
L. Botetourt.
D. Leeds. L Abp. York. L. Delamer.

E. Marchmont. L. Lovel & Holland.
E. Halifax.

E. Northumberland.
V. Townshend.
V. Weymouth.

V. Wentworth.

Their Lordships, or any Five of them; to meet immediately, in the Princes Lodgings near the House of Peers; and to adjourn as they please.

The House was adjourned during Pleasure; and the Committee withdrew, to prepare the Address.

After some Time, the House was resumed.

And the Earl of Halifax reported from the Committee an Address drawn by them, as follows; (videlicet,)

Address reported, and agreed to:

Most Gracious Sovereign,
We, Your Majestys most dutiful and loyal Subjects, the Lords Spiritual and Temporal in Parliament assembled, presume to approach Your Sacred Person, with our warmest Acknowledgements of the peculiar Goodness expressed in Your most gracious Speech from the Throne.

We humbly entreat Your Majestys Acceptance of our heartiest Congratulations upon Your Recovery from Your late Indisposition. Your Majestys Return to Your Parliament has dissipated all those anxious Sensations, which the Occasion of Your Absence had excited: And, as the Re-establishment of Your invaluable Health is an Object to Your faithful People of the sincerest Joy and Exultation: Your Majesty has shewn a most affectionate Regard to their Satisfaction, in condescending to take the earliest Opportunity of giving them so pleasing a Proof of it.
This great Mark of Your Majestys Attention demands our most sincere and dutiful Thanks: But we have before us a still more engaging Instance of Your watchful Solicitude for our future Security and Happiness.
The constant Tenor of Your just and constitutional Government, distinguished and endeared to Your Kingdoms, by an unwearied Application to the Advancement of their Interests and Prosperity, had already filled our Minds with a most cordial Sense of Gratitude: The new Proof which Your Majesty is now pleased to give us of Your truly Paternal Tenderness, by extending Your Concern for the Stability, Dignity, and Lustre, of Your Crown, with all the happy Effects of Your Love to Your Royal Children and to Your faithful Subjects, beyond the Period of Your own Continuance among them, must inspire us with still higher Degrees, if possible, of Reverence and Affection.
Whilst we contemplate with Admiration that Magnanimity which enables Your Majesty to look forward, with a cool Composure of Thought, to an Event which, whenever it shall please God to permit it, must overwhelm Your loyal Subjects with the bitterest Distraction of Grief; we cannot but be deeply affected with that compassionate Sentiment of Your Royal Heart, which suggests a Provision for their Comfort under so severe an Affliction.
May it please the Divine Providence to exempt us from the fatal Necessity of such a Consolation ! Your Majesty has shewn, from the First Day of Your auspicious Reign, so conscientious a Regard to the Laws and Liberties, the Religions and Civil Rights, of Your Kingdoms, that we should be insensible and unworthy of the Happiness we ourselves enjoy, if we did not ardently wish to transmit it under the same gracious Care and Protection to our Children.
Yet, feeling, as we do, the infinite Importance of every Measure that may tend to the perpetuating in all Events our happy Constitution; in Deference to Your Majestys Recommendation, and under a full Conviction of that consummate Prudence and beneficent Intention which were the Motives of it, we will not fail to apply ourselves to the immediate Discussion of the high and momentous Object which Your Majesty has been pleased to propose to our Consideration.
Our Deliberations concerning it will be animated by the Hopes of securing to our Posterity, under the Blessing of Almighty God, and in Concurrence with Your Majestys salutary Designs, the inestimable Blessing of a legal Protestant Succession to the Crown of these Realms in Your Royal Family; and will be influenced by a just Confidence in Your Princely Wisdom, and Paternal Concern for Your People.
We shall go into this Consultation with a sensible Anxiety; arising from the Subject of it: But we humbly assure Your Majesty, that we will conclude it with all the Dispatch compatible with its Angular Importance; repeating at the same Time our earnest Supplications, that, through the Mercy of God upon this Protestant Church and Nation, a Precaution so expedient in Prospect may become useless in the Event, by Your Majestys living to form, under Your own Instruction, a Successor worthy to inherit the Allegiance and Affections of a Free People, by a long and mature Attention to the Example of Your Royal Virtues.

The Order of the Day being read, for the Second Reading of the Bill, intituled, An Act to provide for the Administration of the Government, in case the Crown should descend to any of the Children of His Majesty being under the Age of Eighteen Years; and for the Care and Guardianship of their Persons.

The said Bill was accordingly read a Second Time.

The Question was put thereupon.

It was Resolved in the Affirmative.

Ordered, That the said Bill be committed to a Committee of the whole House.

Ordered, That the House be put into a Committee upon the said Bill on Thursday next; and the Lords summoned.

Then it was moved, That an humble Address be presented to His Majesty; humbly to acknowledge His Majestys great Goodness, in proposing to provide for the future Quiet and Peace of these Kingdoms, by making a proper Provision for that Purpose, in case (which God prevent) these Kingdoms should be deprived of His Majestys most invaluable Life before His Royal Issue shall attain the Age of Eighteen Years: And humbly to beseech His Majesty, out of His tender Regard for His People, to name the Person or Persons whom His Majesty would propose to the Consideration of His Parliament to be, in that Case, Guardians of His Royal Children, and Regents, of these Kingdoms; this House apprehending, that it is contrary to Precedent and the Usage of Parliament, to confer Regal Authority upon any Person not particularly named in the Bill.
