Better Maintenance of the Ministry.

HODIE the Earl of Westmerland reported the Bill for better Maintenance of the Ministry fit to pass, with some Amendments, and a Proviso to be added. The which were presently Twice read, and allowed of, and the Bill to be ingrossed.

L. Newark introduced.

Hodie Robertus Pierpoint, Vicecomes Newarke, introductus est, Robis suis Parliamentaribus indutus, per Vicecomites Say et Seale et Wimbleton, Garter præeunte; He was placed between the Lord Viscount Conway and the Lord Viscount Bayninge.

The Lords being put in Mind of the Businesses appointed for this Day, concerning the Liberties of the Subject; the House was adjourned, ad Libitum.

Report from the Committee appointed to consider of the Liberty of the Subject.

The House being resumed again; the Lord Archbishop of Cant. reported, That the Committee appointed for the great Business have thought sit, That a Message be sent unto the Commons, for a present Conference, between the former Committees. His Grace further reported, That the said Committee thought (fn. 1) it fit to be declared unto the said Commons at the said Conference, That the Lords have considered of their Proposition: That they have not denied the same: That they have thought good to propound somewhat unto them, which is not yet voted here by their Lordships, but presented unto them as a Ground alone for further Conference; and that the Commons shall have Liberty to add unto the same, or to alter or take away any Part of it, as they think good: That we are neither out of Love with their Propositions, nor in Love with our own."

Message to the H. C. for a Conference on this Business.

This Report ended; the Message was sent to the Commons, for a present Conference accordingly, by the Two Lords Chief Justices.

The said Proposition was also read, in hæc verba: videlicet,

Propositions to be offered to the Commons, touching the Liberty of the Subject.

"1. That His Majesty would be pleased graciously to declare, That the good old Law, called Magna Charta, and the Six Statutes, conceived to be Declarations or Explanations of that Law, do stand still in Force, to all Intents and Purposes.

"2. That His Majesty would be pleased graciously to declare, That, according to Magna Charia and the Statutes afore-named, as also according to the most ancient Customs and Laws of this Land, every Free Subject of this Realm hath a Fundamental Propriety in his Goods, and a Fundamental Liberty of his Person.

"3. That His Majesty would be graciously pleased to declare, That it is His Royal Pleasure to ratify and confirm, unto all and every His Loving and faithful Subjects, all their ancient several just Liberties, Privileges, and Rights, in as ample and beneficial Manner, to all Intents and Purposes, as their Ancestors did enjoy the same, under the Governments of the best of His most Noble Progenitors.

"4. That His Majesty would be further pleased graciously to declare, for the good Contentment of His Loyal Subjects, as for the securing of them from future Fears, That, in all Cases within the Cognizance of the Common Law, and concerning the Liberty of His Subjects, His Majesty will proceed according to the Common Law of the Land, and according to the Laws established in the Kingdom, and in no other Manner or Use.

"5. And as touching His Majesty's Royal Prerogative, intrinsical to His Sovereignty, and entrusted Him from God, ad communem totius Populi Salutem, et non ad Destructionem; His Majesty would resolve not to use or divert the same to the Prejudice of any His Loyal People, in Propriety of their Goods or Liberty of their Persons; and in case, for the Security of His Majesty's Royal Person, the common Safety of His People, or the Peaceable Government of His Kingdom, His Majesty shall find just Cause, for Reason of State, to imprison or restrain any Man's Person, His Majesty would graciously declare, That, within a convenient Time, He shall and will express a Cause of his Commitment or Restraint, either general or special; and, upon a Cause so expressed, will leave him immediately to be tried, according to the common Justice of the Kingdom."

Answer from the H. C. touching the Conference.

The Messengers returned Answer, That the Commons will presently attend this Conference.

The House was thereupon again adjourned, ad Libitum; and the said Committee being returned from the Conference;

Resumed.

Report of the Conference.

The Lord Archbishop of Cant. reported, That, after a Preamble used by his Grace, prout antea, the said Proposition was delivered unto the Commons in Writing, with Liberty for to add, alter, or take away, any Part of it. And that one of the Committee for the Commons expressed their great Joy for this Manner of Proceeding, and rendered the Lords most hearty Thanks.

Adjourn.
