The Earl of Shaftesbury reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of Part of the entailed Estate of Sir George Mackinzie Knight, deceased, lying in that Part of Great Britain called Scotland, and for purchasing other Estates, to be settled to the same Uses, and for other Purposes therein mentioned," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; That the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Wrotham Heath Road Bill.

The same Earl reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing the Road leading from The Royal Oak on Wrotham Heath, to the Town of Wrotham, in the County of Kent, and and from thence to the Village of Foots Cray, in the said County," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Edinburgh Duty on Beer, Bill

The said Earl made the like Report from the Lords Committees to whom the Bill, intituled, "An Act for enlarging the Term granted by Two several Acts of the Third and Ninth Years of His late Majesty's Reign, for continuing the Duty of Two Pennies Scots upon every Pint of Ale and Beer sold in the City of Edinburgh, for the Purposes therein mentioned, and for discontinuing Payment of the Petty Port Customs there," was committed.

D of Devonshire, Leave for a Bill

After reading, and considering, the Report of the Judges to whom was referred the Petition of William Duke of Devonshire, praying Leave to bring in a Private Bill.

The Lord Sandys presented to the House, pursuant to their Lordships Order of the 23d of January last, a Bill, intituled, "An Act for enclosing and dividing Wytham on the Hill in Field, in the County of Lincoln, and for settling a Stipend on the Vicar, in Lieu of Glebe and Tithes."

And the same was read the First Time.

Hodie 2^a vice lecta est Billa, intituled, "An Act to rectify a Mistake in an Act passed in the Twentyfourth Year of the Reign of His present Majesty, intituled, An Act for explaining and amending an Act passed in the Twenty-first Year of His present Majesty, intituled, An Act for the Relief of the Annuitants of the Wardens and Commonalty of the Mystery of Mercers, in the City of London, and for other Purposes therein mentioned."

Ordered, That the said Bill be committed to a Committee of the whole House, on Thursday next.

Benson's Divorce, Bill.

The Order of the Day being read, for the Second Reading of the Bill, intituled, "An Act to dissolve the Marriage of Thomas Benson Gentleman with Jane Board his now Wife; and to enable him to marry again, and for other Purposes therein mentioned," and for hearing Counsel, as well for as against the same.

Counsel was accordingly called in.

And the said Bill was read a Second Time.

But no Counsel appearing for Mrs Benson.

William Webly was produced, sworn, and examined as to the Service of the Order for giving Notice to her of this Proceeding.

And he, proving the same to be duly served, was directed to withdraw.

Then Mr. Evans, Counsel for the Bill, was heard, in order to make out the Allegations thereof, and called.

Samuel Swift, who, being sworn, proved the Marriage of the said Thomas Benson with the said Jane, in the Month of April, 1746.

Next was produced, and, being sworn, gave the House an Account of the said Two Persons cohabiting together at Chatham, of the just Suspicion he entertained of her from her Behaviour, heightened by a Letter intercepted from Captain John Shore, which was produced, and read.

Also Nathaniel Morgan was called, and examined upon Oath, in order to make out the Charge of Adultery against the said Mrs. Benson And he informed the House, "That himself, with the Husband, Mr Lewis, and others, surprized the said Captain Shore in naked Bed with the said Mrs Benson, at her Husband's House in Chatham, on the Second of January, 1747"

Likewise John Lewis was produced, and examined upon Oath to the same Matter. And he corroborated the Evidence of the last Witness.

Then the said was a Second Time called, and proved the Separation of Mr Benson and his Wife from that Time.

And the said Mr. Webly was again called; and gave an Account, "That a Daughter was born of Mrs Benson during the Cohabitation, and of the Death thereof," for a Proof of which, he produced a Copy of the Register And then gave the House an Account of a Verdict obtained in an Action at Law brought against the said John Shore, for Criminal Conversation with the said Jane.

And William Skelton, Register of the Consistory Court of the Bishop of London, being also called and sworn, produced a Definitive Sentence of Divorce from Bed and Board, against the said Mrs. Benson, for Adultery with the said John Shore, and read the same.

Which done;

The Counsel was directed to withdraw.

Ordered, That the said Bill be committed to a Committee of the whole House, on Thursday next.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act to empower the Committee or Committees of Thomas Southcote Esquire, a Lunatick, for the Time being, to make Leases and Copyhold Grants of his Estates, in the Counties of Berks, Essex, and Surrey, and for other Purposes therein mentioned," was committed. That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given their Consents, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Ordered, That the said Bill be engrossed.

Cirencester Road, Bill.

The same Earl reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing the Road from the Town of Cirencester to the Town of Stroud, and that Part of Rodborough Hill which leads to Dudbridge, and also the Road leading from Cirencester towards Bisley, so far as the Bottom of Gulph Hill, all in the County of Gloucester," was committed That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Greenwich Church, burying in, Bill.

His Lordship made the like Report from the Lords Committees to whom the Bill, intituled, "An Act to enable the Parishioners of the Parish of East Greenwich, in the County of Kent, to deposit Corps in the Vaults or Arches under the Church in the said Parish, and to ascertain the Fees that shall be paid for the same," was committed.

Upon reading the Petition of Richardo Gulielmo-Gasparo-Melchior Baltazaro Wynne, an Infant of about the Age of Nine Years, by the Right Honourable Robert Earl of Holdernesse, his next Friend, setting forth, "That there is a Bill depending in this House, for dividing and enclosing the Common Field called Wytham on the Hill in Field, in the County of Lincoln, which is within the Petitioner's Manor, and that the enclosing the same will be prejudicial to his Rights and Royalties there," and praying to be heard, by Counsel, at the Bar of this House, against the said Bill, at the Second Reading thereof, or in such other Manner as to their Lordships shall seem meet:

It is Ordered, That the said Petition do lie on the Table, till the said Bill be read a Second Time.
