A Message was brought from the House of Commons, by Mr. Hardinge and others.

With a Bill, intituled, "An Act for enabling George Oxenden Esquire and his Heirs to use the Surname, Arms, and Crest, of Dixwell, pursuant to the Will of Sir Basill Dixwell Baronet, deceased," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Papers from Trustees of Carlisle Road delivered.

The House being informed, "That Mr. Bigge, from the Commissioners and Trustees for putting in Execution an Act passed the last Session of Parliament, intituled, "An Act for laying out, making, and keeping in Repair, a Road proper for the Passage of Troops and Carriages, from the City of Carlisle, to the Town of Newcastle upon Tyne," attended"

He was called in, and delivered, at the Bar,

"Copy of the First Accompt of the Receipts and Disbursements of John Tweddell Gentleman, Clerk and Treasurer to and for the said Commissioners and Trustees, so far as the same relates to or concerns that Part of the said Road which lies in the County of Northumberland"

And also, "Copies of the several Orders, Contracts, and Agreements, made by the said Commissioners and Trustees, so far as the same relate to or concern that Part of the said Road which lies in the County of Cumberland"

And then he was directed to withdraw.

And the Titles thereof being read, by the Clerk.

Ordered, That the said Accompt and Copies do lie on the Table.

Proceedings, &c of Commissioners of Westminster Bridge delivered.

The House being informed, "That Mr Seddon from the Commissioners for building Westminster Bridge, attended"

He was called in; and delivered, at the Bar,

"A State of their Proceedings, from the 14th December 1750, to the 19th November 1751 (inclusive)."

Also, "Accompts of the Treasurer to the said Commissioners, from the 25th December 1750, to 29th September 1751"

And then he was directed to withdraw.

And the Titles thereof being read, by the Clerk.

Ordered, That the said State and Accompts do lie on the Table.

Mackenzie to enter into Recognizance for Ereskine.

The House being moved, "That Kenneth Mackenzie of the Parish of St Martin in the Fields Gentle man may be permitted to enter into a Recognizance for David Ereskine, on account of his Appeal depending in this House, he being in Scotland"

It is Ordered, That the said Kenneth Mackenzie may enter into a Recognizance for the said Appellant, as desired.

E Fitzwilliam takes the Oaths.

William Earl Fitzwilliam took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes, his Lordship having first delivered a Certificate of his receiving the Sacrament, to the Truth whereof Witnesses were sworn and examined.

D of Ancaster's Petition referred to Judges.

Upon reading the Petition of Peregrine Duke of Ancaster and Kesteven, praying Leave to bring in a Bill, to supply and remedy certain Omissions and Defects in a Marriage Settlement, in the Petition mentioned, of the 21st of May 1735, by enabling the Petitioner to make Provisions for Daughters, out of the Estates comprized in the said Settlement, and for other Purposes in the Petition expressed.

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Justice of the Court of Common Pleas and Mr Justice Burnett, who are forthwith to summon all Parties concerned in the Bill, and, after hearing them, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties who may be concerned in the Consequences of the Bill have signed the Petition, and also that the Judges, having perused the Bill, do sign the same.

Attestation of Devises of Real Estates, Bill.

The Lord Chief Justice of the Court of King's Bench, pursuant to an Order of this House of the last Session of Parliament, delivered a Bill, prepared by the Judges, intituled, "An Act for the Amendment of the Law relating to the Attestation of Devises of Real Estates."

And the same was read the First Time.

Ordered, That the said Bill be printed, and read a Second Time To-morrow Sevennight, the Lords to be summoned, and the Judges to attend.

Hall against Pease, Writ of Error.

The same Lord Chief Justice, in the usual Manner, brought up a Writ of Error, wherein Randall Hall is Plaintiff, and Joseph Pease Defendant.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for enabling George Oxenden Esquire and his Heirs to use the Surname, Arms, and Crest, of Dixwell, pursuant to the Will of Sir Basill Dixwell Baronet, deceased," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Stewart Mackenzie's Petition referred to Judges.

Upon reading the Petition of James Stewart Mackenzie Esquire and Lady Elizabeth his Wife, praying Leave to bring in a Bill, to enable the granting Leases of an entailed Estate, in the Petition mentioned, and for other Purposes therein expressed.

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Justice of the Court of King's Bench and Mr Justice Burnett, with the usual Directions, according to the Standing Order.

Lascelles's Divorce, Bill.

The Order of the Day being read, for the Second Reading of the Bill, intituled, "An Act to dissolve the Marriage of Daniel Lascelles, of London, Merchant, with Elizabeth Southwicke his now Wife, and to enable him to marry again, and for other Purposes therein mentioned," and for hearing Counsel, as well for as against the same.

Counsel were accordingly called in.

And the said Bill was read a Second Time.

But no Counsel appearing for Mrs Lascelles

William Bateson was produced, sworn, and examined as to the Service of the Order for giving Notice to her of this Proceeding.

And he, proving the same to be duly served, was directed to withdraw.

Then the Counsel for the Bill were heard at large, in order to make out the Allegations thereof, and called.

Elizabeth Limbrey, who was examined upon Oath, as to her Acquaintance with Mrs Lascelles in or about the Year 1740, and of her Marriage, of her cohabiting with her Husband, and any and what Familiarities that passed between the said Mrs Lascelles and one Henry Parminter Esquire And she informed the House of her being sometimes Bedfellow to Mrs Lascelles, and "That one Morning the said Parminter came into the Bed to them, and that adulterous Conversation passed between him and the said Mrs Lascelles"

And then she was directed to withdraw.

Next, Sarah Booty was sworn, and examined touching the same Matter, and acquainted the House of indecent Familiarities which passed between the said Parminter and Mrs Lascelles, and "That she had seen them in Bed together."

Also, Jane Carrier was produced, and examined upon Oath to the like Matter, she being a Servant to Mrs Lascelles, in order to corroborate the Testimony of the last Witness And she declared, "That (amongst other indecent Familiarities) she had likewise seen her Mistress in naked Bed with the said Parminter"

And then she was directed to withdraw.

After which, William Skelton, Register of the Consistory Court of the Bishop of London, being called, and sworn, produced the Definitive Sentence of Divorce from Bed and Board, against the said Mrs Lascelles, for Adultery with the said Parminter

And the same was read.

And North, being produced, and examined upon Oath as to the Allegations in the Bill of Mr Lascelles going to The East Indies, and the Time of his Return, and of Mr Parminter's being Prisoner in The Fleet, did acquaint the House of the Truth of those Two Particulars, and that the Reason why no Action of Damages was brought against the said Parminter was by reason of his Poverty.

And then the Counsel were directed to withdraw.

Ordered, That the said Bill be committed to a Committee of the whole House, To morrow.

A Message was brought from the House of Commons, by Mr Charlton and others.

With a Bill, intituled, "An Act for continuing and granting to His Majesty certain Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One Thousand Seven Hundred and Fifty-two," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

The said Bill was read the First Time.

Lascelles's Divorce, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to dissolve the Marriage of Daniel Lascelles of London Merchant, with Elizabeth Southwicke his now Wife, and to enable him to marry again, and for other Purposes therein mentioned."

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and made some Amendments thereunto, which he will be ready to report, when the House will please to receive the same."

Ordered, That the said Report be received on Friday next.

Upon reading the Petition of Richard Hopton Esquire, and Edward Cope Hopton Esquire his Eldest Son, and Mary the Wife of the said Edward Cope Hopton, praying Leave to bring in a Bill, for Sale of a Moiety of an Estate in the Petition mentioned, and laying out the Money arising thereby in the Purchase of another Estate, to be settled to the same Uses as the said Moiety stands settled.

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Baron of the Court of Exchequer and Mr Baron Clive, with the usual Directions, according to the Standing Order.

Bryne's Petition to receive Appeal rejected.

A Petition of Lawrence Bryne and others, was presented, and read, setting forth, "That the Petitioners were advised to appeal from an Order of the Court of Chancery in Ireland, in a Cause wherein they were Defendants, and by reason of the Prolixity of the Proceedings, some of which have not been transmitted till lately, such Appeal could not be prepared to be presented within the Time limited," and praying, "That the said Appeal may be now received."

Whereupon the Petitioners Agent was called in, and heard at the Bar.

But not being able to give a satisfactory Reason for receiving the said Appeal.

Ordered, That the said Petition be rejected.

Land Tax Bill.

A Message was brought from the House of Commons, by Mr Charlton and others.

With a Bill, intituled, "An Act for granting an Aid to His Majesty by a Land Tax, to be raised in Great Britain, within the Space of One Year, from the Twenty fifth Day of March One Thousand Seven Hundred and Fifty-two," to which they desire the Concurrence of this House.

A Message was brought from the House of Commons, by Mr. Fox Secretary at War and others.

With a Bill, intituled, "An Act for punishing Mutiny and Desertion, and for the better Payment of the Army and their Quarters," to which they desire the Concurrence of this House.

The said Bills were both read the First Time.

Lascelles's Divorce, Bill.

The Earl of Warwick (according to Order) reported from the Committee of the whole House to whom the Bill, intituled, "An Act to dissolve the Marriage of Daniel Lascelles of London Merchant, with Elizabeth Southwicke his now Wife, and to enable him to marry again, and for other Purposes therein mentioned," was committed, the Amendments made by the Committee to the said Bill.

And the same, being read Twice by the Clerk, were agreed to by the House.

Ordered, That the said Bill, with the Amendments, be engrossed.

Upon reading the Petition of Philip Southcote Esquire, for and on the Behalf of himself and of Thomas South cote Esquire, his Brother, a Lunatick, of whose Person and Estate he is Committee, praying Leave to bring in a Bill, to enable the Petitioner, and such Persons as shall for the Time being be appointed the Committee of the Estate of the said Lunatick, during his said Lunacy, to make Copyhold Grants of such of the Estates as are Parcel of the Manor of Drayton, in the County of Berks, in the Petition mentioned, and for other Purposes therein expressed.

The House being informed, "That Mr Clancy attended, in order to deliver in Copies of divers Papers, Pleadings, and Proceedings, in the Cause wherein Francis Earl of Kerry and Lixnaw is Appellant, and John Viscount Fitzmaurice Respondent"

Pleadings proved.

He was called in, and delivered, at the Bar, the said Copies, and attested upon Oath, "The same were true, he having examined them with the Originals in the proper Offices in Ireland"

Upon reading the Petition of Lady Frances Bland, Widow and Relict of the late Sir John Bland Baronet, deceased, Sir John Bland Baronet, Eldest Son and Heir of the said Sir John Bland, deceased, by the said Lady Frances, Hungerford Bland Younger Son of the said Sir John Bland, deceased, by the said Lady Frances, and of Ann Bland and Elizabeth Bland, Daughters of the said Sir John Bland, deceased, by the said Lady Frances Bland, praying Leave to bring in a Bill, for vesting certain Estates in Lancashire and Cheshire, in the Petition mentioned, in the Petitioner Sir John Bland, in Fee Simple, and for settling an Estate in the County of York, in the Petition also mentioned, in Lieu thereof, and in Exchange for the same.

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to Mr Baron Clive and Mr Justice Foster, with the usual Directions, according to the Standing Order.

Upon reading the Petition of Joseph Pease, Defendant in a Writ of Error brought into this House the 9th Day of this Instant December, in which Randall Hall is Plaintiff, praying, "In regard the said Plaintiff has not assigned Errors within the Time limited by the Standing Order of this House, that the said Writ of Error may be Non pros'd, with Costs.

It is Ordered, That the Petitioner do forthwith enter a Non pros on the said Writ of Error, as desired, and that the Record be remitted to the Court of King's Bench, to the End Execution may be had upon the Judgement given in that Court, as if no such Writ of Error had been brought into this House, and further, That the Plaintiff in Error do pay, or cause to be paid, to the Defendant in Error, the Sum of Twenty Pounds, for his Costs by reason of the Delay of the Execution of the said Judgement.

He, after a short Introduction in relation to the Malt and Land Tax Bills, delivered the same to the Clerk, who brought them to the Table, where the Clerk of the Crown read the Titles of those and the other Bills ready for the Royal Assent, as follow, (videlicet,)

"1 An Act for continuing and granting certain Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One Thousand Seven Hundred and Fifty-two."

"2. An Act for granting an Aid to His Majesty, by a Land Tax, to be raised in Great Britain, within the Space of One Year, from the Twenty fifth Day of March One Thousand Seven Hundred and Fiftytwo."

To these Bills the Royal Assent was severally pronounced, in these Words, (videlicet,)

"3. An Act for punishing Mutiny and Desertion, and for the better Payment of the Army and their Quarters."
