A Petition of Francis Scot, was presented, and read; setting forth, "That, on the 26th of April last, the Petitioner obtained an Order for amending his Appeal, by adding Parties, who were to answer by the 24th Instant, and has served the said Order on their Agent; and that only some of them have answered," and praying, "In regard the Cause stands for an Hearing To-morrow, that such Order may be made, in relation to this Matter, as to this House shall seem meet."

And thereupon the Agents on both Sides were called in, and heard.

And being withdrawn:

Ordered, That the said Hearing be put off till To-morrow Sevennight.

Campbell, alias Drummond, & al against Campbell & al & e contra

A Petition of Elizabeth and Jean Campbell and James Drummond, Husband of the said Elizabeth, was presented, and read, setting forth, "That the Petitioners Elizabeth and Jean Campbell, having brought their Appeal to this House, complaining of certain Interlocutors made by the Court of Session in Scotland, on Behalf of Mrs Mary Campbell, and she having brought her Cross Appeal against other Interlocutors, or Parts of Interlocutors, made in the same Cause, the Matters in Question by the said Appeals were referred to the Arbitration of his Grace the Duke of Argyll, who has lately made an Award, by which the Parties are willing to abide," and praying, "That the said Original and Cross Appeals may stand dismissed."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn.

Appeals dismissed.

Ordered (by Consent of the Parties), That the said Appeals do stand dismissed accordingly.

With a Bill, intituled, "An Act for the more easy and speedy Recovery of small Debts within the Town and Borough of Southwark, and the several Parishes of Saint Saviour, Saint Mary at Newington, Saint Mary Magdalen Bermondsey, Christ Church, Saint Mary Lambeth, and Saint Mary at Rotherhith, in the County of Surry, and the several Precincts and Liberties of the same," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Brereton, Leave for a Bill, to take the Name of Salusbury.

Upon reading the Petition of Thomas Brereton, of Shotwicke Park, in the County of Chester, Esquire, praying Leave to bring in a Bill, to empower him to take the Surname of Salusbury, pursuant to a Settlement made by Letitia Lloyd, of Leadbrooke in the County of Flint, Widow, deceased.

It is Ordered, That Leave be given to bring in a Bill, as desired.

Accordingly, the Earl of Warwick presented to the House a Bill, intituled, "An Act for authorizing and empowering Thomas Brereton Esquire and his Heirs to take and use the Surname of Salusbury"

And the same was read the First Time.

Worcester Road, repairing, Bill.

A Message was brought from the House of Commons, by Mr. Sandys and others.

With a Bill, intituled, "An Act for the further enlarging the Term and Powers granted and continued by Two Acts of Parliament, the One passed in the Twelfth Year of the Reign of Her late Majesty Queen Anne, and the other in the Twelfth Year of the Reign of His late Majesty King George the First, for repairing the Roads from the City of Worcester, through the Borough of Droitwich, to Dyers Bridge, near Bromsgrove, in the County of Worcester, and also for repairing the Roads from Dyers Bridge, through the Town of Bromsgrove, to Spadesbourn Bridge, and from Droitwich to Bradley Brook, in the same County," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Petition to be heard, by Counsel, against it, to lie on the Table.

Upon reading the Petition of the several Persons whose Names are thereunto subscribed, setting forth, "That they were elected Trustees, pursuant to the Powers granted for putting in Execution an Act passed in the Twelfth Year of the Reign of His late Majesty King George the First, for enlarging the Term granted by an Act passed in the 12th Year of Her late Majesty Queen Anne, intituled, "An Act for repairing the Highway, or Road, leading from the City of Worcester to the Borough of Drotwich, in the County of Worcester, and for making the same more effectual, and for repairing other Roads therein mentioned, in the County of Worcester," and that the Petitioners are informed there is a Bill brought into Parliament, and now pending before this House, for the further enlarging the Term and Powers granted and continued by the said Two Acts of Parliament, whereby the Petitioners apprehend themselves greatly aggrieved," and representing to then Lordships, "That, if the said Bill should pass, they will be deprived of those Rights and Powers which they now possess and enjoy under the Authority of an Act of Parliament, for that, by the Bill now pending, all the Trustees which have been elected since the 31st of July last will, from and after the First Monday in June next, be excluded from the said Trust, and the Petitioners, who have been elected since that Time, will consequently be divested of those Rights and Privileges which they are entitled to by Law," and therefore praying, "In regard they are not conscious of having done any Thing contrary to their Duty, or to require so extra ordinary a Law to be made, that their Case may be taken into Consideration, and that they may be allowed to be heard, by their Counsel, against the said Bill, and such Relief given them as this House in their great Wisdom shall think meet"

It is Ordered, That the said Petition do lie on the Table till the said Bill be read a Second Time.

Trustees in former Acts of Parliament, also against the said Bill.

Upon reading the Petition of the Trustees, whose Names are thereunto subscribed, for putting in Execution the Acts of Parliament formerly passed, for repairing the Roads leading from the City of Worcester to Droitwich, setting forth, "That a Bill is depending before this House, for further enlarging the Term and Powers granted and continued by the said former Acts, for repairing the Roads aforesaid, and other Roads in the Bill mentioned, which, if passed into a Law as it now stands, the Petitioners are advised, will deprive them of a Right which they are entitled to under and by virtue of One of the said former Acts of Parliament,' and praying, "That they may be heard, by their Counsel, against the said Bill now depending, before the same shall pass into a Law, or that they may have such other Relief as to this House shall seem meet"

It is Ordered, That the said Petition do lie on the Table, till the said Bill be read a Second Time.

A Message was brought from the House of Commons, by the Lord Barrington and others.

To return the Bill, intituled, "An Act for Sale of Part of the settled Estate of John Raymond, a Bankrupt, and for applying Part of the Money arising by such Sale, as Part of the said Bankrupt's Estate liable to Distribution, amongst his Creditors, and for laying out the Residue in the Purchase of another Estate, to be settled as therein is mentioned," and to acquaint this House, that they have agreed to the same, without any Amendment.

Brereton to take the Name of Salusbury, Bill.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for authorizing and empowering Thomas Brereton Esquire and his Heirs to take and use the Surname of Salisbury," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Ordered, That the said Bill be committed to a Committee of the whole House, on Wednesday next, and that the Two Petitions, which were ordered to he on the Table till the said Bill was read a 2d Time, be referred to the said Committee, and that the Petitioners may be heard, by then Counsel, before the said Committee, thereupon, and that Counsel may be heard for the said Bill at the same Time, and that the Cause appointed for that Day be put off to the Friday following, and the other Causes removed in Course.

The Lord Chancellor acquainted the House, "That His Majesty had been pleased to grant a Commission to his Royal Highness the Prince of Wales, his Royal Highness the Duke of Cumberland, and several Lords therein named, for declaring His Royal Assent to several Acts agreed upon by both Houses."

Then Six of the Lords Commissioners (in their Robes), being seated on a Form placed between the Throne and the Woolsack, the Lord Chancellor in the Middle, with the Archbishop of Canterbury and Duke of Montagu on his Right Hand, and the Lord Privy Seal, Duke of Argyll, and Duke of Newcastle, on his Left, commanded the Gentleman Usher of the Black Rod to signisy to the Commons, "That the Commissioners desire then immediate Attendance in this House, to hear the Commission read"

After hearing Counsel, as well on Thursday and Friday last as this Day, upon the Petition and Appeal of Mrs Agnes Steuart of Phisgill, and John Hathorn of Coveraries her Husband, for his Interest, complaining of an Interlocutor of the Lords of Session in Scotland, of the 9th of February last, and also of another Interlocutor of the same Lords, of the 22d of the same Month, whereby they adhered to their former Interlocutor, made on the Behalf of Christian Heron, and praying, "That the same might be reversed, varred, or amended, and such other Relief given the Appellants as to this House in their great Wisdom should seem meet" As also upon the Answer of the said Christian Heron put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause.

Worcester Road, Bill.

The Order of the Day being read, for the House to be put into a Committee upon the Bill, intituled, "An Act for the further enlarging the Term and Powers granted and continued by Two Acts of Parliament, the One passed in the Twelfth Year of the Reign of Her late Majesty Queen Anne, and the other in the Twelfth Year of the Reign of His late Majesty King George the First, for repairing the Roads from the City of Worcester, through the Borough of Droitwich, to Dyers Bridge, near Bromsgrove, in the County of Worcester, and also for repairing the Roads from Dyers Bridge, through the Town of Bromsgrove, to Spadesbourn Bridge, and from Droitwich to Bradley Brook, in the same County"

William Giles, John King, Thomas Allen, John Grover, Edward Bearcroft, and Edward Barwell, were called in, and sworn, in order to be examined before the said Committee.

Then the House was adjourned during Pleasure, and put into a Committee thereupon.

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment"
