Banks's Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the settled Estate late of Joseph Banks the Elder, Esquire, deceased, in the Parish of St. James, within the Liberty of Westminster, in Trustees, in order to make Sale thereof, and for laying out the Money arising by such Sale in the Purchase of Lands, to be settled to the same Uses," was committed That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given their Consents, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Chafin's Bill.

His Lordship also reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of the settled Estate of George Chafin, in the Counties of Southampton and Surrey, for paying off and discharging several Debts and Encumbrances, and for settling Lands, in the County of Somerset, in Lieu thereof, to the like Uses," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given then Consents; and that the Committee had gone through the Bill, and made some Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House.

Ordered, That the said Bill, with the Amendments, be engrossed.

Fox's Bill.

Hodie 3^a vice lecta est Billa, intituled, "An Act for confirming an Agreement between James Fox and John Bridges Esquires, for exchanging certain Lands, in the Parish of Cobham, in the County of Surrey, and for rendering the said Agreement more effectual for the Purposes thereby intended"

Narsh's Creditors, Bill.

Hodie 3^a vice lecta est Billa, intituled, "An Act for confirming certain Articles of Agreement, between the Creditors of Hugh Narsh Esquire and the Trustees named in an Act of Parliament of the Eleventh Year of His present Majesty, for vesting the Real and Personal Estates of the said Hugh Naish in Trustees, for the Benefit of his Creditors, and for other Purposes therein mentioned."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Dickson & al. against Lockhart, & e contra

After hearing Counsel, as well on Tuesday last as Yesterday and this Day, upon the Petition and Appeal of David Dickson Gentleman, Second Son of William Dickson of Kilbucho Esquire, and the Heir and Executor to the deceased Thomas Dickson, Third Son to the said William Dickson, which Thomas was the Husband and Disponee of the deceased Girzel Rachel Baillie, who was only Child of the deceased John Baillie of Walston, and His Majesty's Advocate, complaining of an Interlocutor of the Lords of Session, of the 15th of July 1747, and of another Interlocutor of the said Lords, of the 15th of December following, whereby they adhered to then former Interlocutor, to which Appeal George Lockhart of Carnwath Esquire is Respondent As also upon the Cross Appeal of the sud George Lockhart, complaining of an Interlocutor of the Lord Ordinary, of the 2d of July 1740, and of another Interlocutor of his Lordship, of the 10th of November following, adhering to his former Interlocutor, and likewise of an Interlocutor of the Lords of Session, of the 19th of June 1741, whereby they adhered to the Lord Ordinary's Interlocutors, to which Cross Appeal the said David Dickson and His Majesty's said Advocate are Respondents, and due Consideration had of what was offered on both Sides in these Causes.

Judgement.

It is Declared, by the Lords Spiritual and Temporal in Parliament assembled, That it appears to this House not to be necessary, in the present State of the said Causes, to determine the Question arising upon the said Interlocutors complained of by the Cross Appeal And it is therefore Ordered, That the said Cross Appeal be dismissed And it is further Ordered and Adjudged, That the said Original Appeal be, and is hereby, dismissed this House, and that the said Interlocutors therein complained of be, and the same are hereby, affirmed.

E Shelburre and his Son against Biddulph.

Ordered, That the Hearing of the Cause wherein Henry Earl of Shelburne and his Son are Appellants, and Nicholas Biddulph Esquire is Respondent, which stands for To morrow, be put off to this Day Sevennight, and the other Causes removed, to come on in Course.

Co Dowager of Kildare against Burton & al Pleadings proved.

The House being informed, "That Mr Baily attended, in order to deliver in certain Copies of Papers, in the Cause wherein Mary Countess of Kildare and others are Appellants, and Robert Burton Esquire and others Respondents"

He was called in, and, at the Bar, delivered the said Copies, and attested upon Oath, "The same were true, he having examined them with the Originals in the proper Offices in Ireland"

And then he was directed to withdraw.

Peirs Bridge Road, Bill.

With a Bill, intituled, An Act for repairing the High Road from Peirs Bridge to Kirkmorrington, in the County of Darham, and from thence to the Turnpike Road at Tudhoe Lone End, in the said County," to which they desire the Concurrence of this House.

The Earl of Warwick reported from the Lords Com mittees to whom the Bill, intituled, "An Act for raising Money, out of an Estate in the County of Middlesex, given by Lawrence Sheriff, for the founding and maintaining a School and Almshouses at Rughby, in the County of Worwick, to be applied in re-building the said School, or purchasing One or more Messuage or Messuages, together with some Ground adjoining thereto, and for the better Support of the said Charity," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given their Consents, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Ordered, That the said Bill be engrossed.

Basingstoke Road, Bill.

"That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Kynaston's Bill.

The Lord Ward reported from the Lords Committees to whom the Bill, intituled, "An Act for the Sale of Part of the Estate of Corbet Kynaston Esquire, deceased, for the Payment of Debts affecting the same, and for other Purposes therein mentioned," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given then Consents, and that the Committee had gone through the Bill, and made some Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House.

Treason in the Highlands of Scotland, Punishment of, Bill.

The House proceeded to take into Consideration the Amendments made by the Commons to the Bill, intituled, "An Act for the more effectual Trial and Punishment of High Treason, or Misprision of High Treason, in The Highlands of Scotland, and for abrogating the Practice of taking down the Evidence in Writing, in certain Criminal Prosecutions, and for making some further Regulations relating to Sheriffs Depute and Stewards Depute, and their Substitutes, and for other Purposes therein mentioned."

And the said Amendments, being read Thrice, were severally agreed to.

And a Message was sent to the House of Commons, by the former Messengers, to acquaint them therewith.

Message from thence, to return Buckingham Assizes Bill,

A Message was brought from the House of Commons, by Mr. Grenville and others.

Neau's Nat Bill,

A Message was brought from the House of Commons, by Mr Martin and others.

To return the Bill, intituled, "An Act for naturalizing Peter Neau," and to acquaint this House, that they have agreed to the same, without any Amendment.

and Gore & al far Sale of Sir Orlando Humfreys's Estate, Bill.

A Message was brought from the House of Commons, by Mr. Hayle and others.

To return the Bill, intituled, "An Act for the Sale of certain Lands, in the Parishes of Barking and Dagenham, in the County of Essex, Part of the Estate of the late Sir Orlando Humfreys Baronet, deceased, for the Purposes therein mentioned," and to acquaint this House, that they have agreed to the same, without any Amendment.

Tea exporting to Ireland, &c. Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill intituled, "An Act for permitting Tea to be exported to Ireland and His Majesty's Plantations in America, without paying, the Inland Duties charged thereupon by an Act of the Eighteenth Year of His present Majesty's Reign, and for enlarging the Time for some of the Payments to be made on the Subscription of Six Millions Three Hundred Thousand Pounds, by virtue of an Act of this Session of Parliament"

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Arbuthnot against M^cFarlan.

The House being moved, "That a Day may be appointed, for hearing the Cause wherein James Ar buthnot Esquire is Appellant, and Walter M^cfarlan Esquire Respondent"

It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on the First vacant Day for Causes after those already appointed.

Keck's Bill.

Ordered, That the Committee to whom the Bill, intituled, "An Act for repealing of Part, and for explaining and amending other Parts, of an Act passed in the Eighteenth Year of the Reign of His present Majesty, intituled, An Act for charging, selling, and applying, Part of the settled Estate of Anthony Keck Esquire, for raising Money, towards the Purchase of the Manors of Dolby and Broughbeen, in the County of Leicester, contracted for, pursuant to the Will of Anthony Keck his Grandfather, and for other Purposes therein mentioned," stands committed, be revived, and meet on Monday next.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for repealing of Part, and for explaining and amending other Parts, of an Act passed in the Eighteenth Year of the Reign of His present Majesty, intituled, "An Act for charging, selling, and applying, Part of the settled Estate of Anthony Keck Esquire, for raising Money, towards the Purchase of the Manors of Dalay and Broughton, in the County of Leicester, contracted for, pursuant to the Will of Anthony Keck his Grandfather, and for other Purposes therein mentioned," was committed "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given their Consents, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment"

Pens Bridge Road, Bill.

The Lord Sandys made the like Report from the Committee to whom the Bill, intituled, "An Act for repairing the High Road from Pens Bridge to Kirkmerrington, in the County of Durham, and from thence to the Turnpike Road at Tudhoc Lane End, in the said County," was committed.

Bishop of Norwich takes the Oaths.

Samuel Lord Bishop of Norwich took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.

Highlands in Scotland disarming, &c. Bill.

A Message was brought from the House of Commons, by the Lord Duplin and others.

With a Bill, intituled, "An Act to amend and enforce so much of an Act made in the Nineteenth Year of His Majesty's Reign, as relates to the more effectual disarming The Highlands in Scotland, and restraining the Use of the Highland Dress, and to Masters and Teachers of Private Schools, and Chaplains, and to explain a Clause in another Act, made in the same Year, relating to Letters of Orders of Lpiscopal Ministers in Scotland, and to oblige Persons allowed to carry Arms, and the Directors of the Banks there, and certain Persons belonging to, or practising in, the Courts of Session and Justiciary, to take the Oaths, and to repeal some Clauses in an Act, made in the First Year of the Reign of His late Majesty King George the First, whereby certain Encouragements are given to Landlords and Tenants in Scotland, who should continue in their Duty and Loyalty to His said late Majesty," to which they desire the Concurrence of this House.

The said Bill was read the First Time.

The Earl of Warwick acquainted the House, "That the Committee to whom the Bill, intituled, "An Act for vesting the Estates of Richard Williams a Bankrupt (which were settled on his Marriage with Sarah Williams his present Wife) in the Assignees under the Commission of Bankruptey awarded against him, to be sold, for the Payment of his Debts, and for making a Provision for the said Sarah Williams and her Issue, in such Manner as therein is mentioned," was committed, "had met upon the said Bill, and made some Amendments thereunto, since which it has been conceived that some other Amendments may be proper to be made Wherefore he was directed by the said Committee to move, That the said Bill may be re-committed."

Ordered, That the said Bill be re-committed accordingly.

And their Lordships to meet To morrow Morning, at the usual Time and Place, and to adjourn as they please.

The Earl of Warwick reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the Estates of Richard Williams a Bankrupt (which were settled on his Marriage with Sarah Williams his present Wife) in the Assignees under the Commission of Bankruptcy awarded against him, to be sold, for Payment of his Debts, and for making a Provision for the said Sarah Williams and her Issue, in such Manner as therein is mentioned," was re-committed. That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, that the Parties concerned had given their Consents, and that the Committee had gone through the Bill, and made several Amendments thereunto."
