The Lord Ward reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing the Road from Birmingham, in the County of Warwick (through Elmdon), to a Lane leading by the End of Stone Bridge, in the said County," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Tadcaster Road, Bill.

A Message was brought from the House of Commons, by Mr. Wentworth and others:

With a Bill, intituled, "An Act to repair the Road leading from Tadcaster Bridge, within the County of the City of York, to a Place near the said City, called Hobmoor Lane End;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Ld. Archibald Hamilton and Count. of Ruglen and her Son:

Counsel (according to Order) were called in, to be further heard, upon the Appeals of Archibald Hamilton Esquire, commonly called Lord Archibald Hamilton, and Anne Countess of Ruglen, and William Earl of March, her Infant Son.

And the Second Counsel for the Respondents to the Appeal of Lord Archibald Hamilton being fully heard:

And the First Counsel for his Lordship's Appeal having been also heard, by Way of Reply:

The Counsel were all directed to withdraw.

Ordered and Adjudged, as to the Interlocutor of the 26th of January 174½, concerning the Superiority and Non-entry Duties of the Lands of Ellistoun, it appearing in this Case, that, since the exhibiting of the Original Appeal, John Earl of Selkirk and Ruglen is dead without Issue Male, by Means whereof new Questions may arise between the Parties, as to that Part of the Estate in Question, it is hereby further Ordered and Adjudged, That the said Interlocutor and Affirmance thereof be, and the same are hereby, reversed; and that the Court of Session do re-hear this Cause, as to the said Superiority and Non-entry Duties of the Lands of Ellistoun, and proceed therein according to Law and the Course of the said Court: And it is further Ordered and Adjudged, That the rest of the Interlocutors complained of be, and the same are hereby, affirmed.

The entire Order and Judgement, on hearing the Causes on the several Appeals, is as follows; (videlicet,)

Judgement on all the Appeals.

"After hearing Counsel, as well on Monday and Tuesday last, as Yesterday and this Day, upon the amended Petition and Appeal of John Earl of Cassillis and Susan Countess of Cassillis; complaining of an Interlocutor of the Lords of Session in Scotland, of the 18th of February 174²/3 and of another Interlocutor of the same Lords, of the 18th of January 174¾, whereby they adhered to their former Interlocutor; and likewise of an Interlocutor of the said Lords, of the same Date; and also of an Interlocutor of the Lord Ordinary, of the 25th of the same Month; and praying, "That the said Interlocutors might be reversed, varied, or amended, and such other Relief given the Appellants as to this House in their great Wisdom and Justice should seem meet:" And also upon the Petition and Appeal of Archibald Hamilton Esquire, commonly called Lord Archibald Hamilton; complaining of Part of an Interlocutor of the said Lords of Session, of the 22d of January 174½; and likewise of the Interlocutor of the same Lords, of the 4th of February following, affirming their former Interlocutor; and also of an Interlocutor of the said Lords, of the 12th of November 1742; and praying, "That the same might be reversed:" And likewise upon the Petition and Appeal of Anne Countess of Ruglen and William Earl of March her Son, an Infant, by the said Anne Countess of Ruglen his Curator; complaining of the said Interlocutor of the 22d of January 174½; and also of an Interlocutor of the 18th of November 1743; and praying, "That the same might be reversed; and that the Appellants might have such Relief as to this House in their great Wisdom should seem meet:" As also upon the joint and several Answer of the said Countess of Ruglen and her said Son, and the Answer of the said Lord Archibald Hamilton, and the Answer of Mr. John Hamilton Writer to His Majesty's Signet at Edinburgh; and the joint and several Answer of Dunbar Hamilton Earl of Selkirk, and Mary Hamilton his Sister, only surviving Children of Basil Hamilton Esquire, deceased; which said Basil Hamilton was the only Son of Lord Basil Hamilton, also deceased, put in to the amended Appeal of the said Earl and Countess of Cassillis; and the several Answer of the said John Hamilton, the Answer of the said Earl and Countess of Cassillis, the Answer of the said Countess of Ruglen and her said Son, the several Answer of the said Earl of Selkirk, and the several Answer of the said Mary Hamilton put in to the Appeal of the said Lord Archibald Hamilton; and the several Answer of the said John Hamilton, the several Answer of the said Lord Archibald Hamilton, and the joint and several Answer of the said Earl of Selkirk and the said Mary Hamilton his Sister, put in to the Appeal of the said Countess of Ruglen and her said Son; and due Consideration had of what was offered on all Sides in these Causes: It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Interlocutors complained of in the Appeal of the said Earl and Countess of Cassillis be, and the same are hereby, affirmed: And it appearing, that the Question touching disburthening the Estate of Riccartoun of the Sum of Three Thousand Pounds and Interest, claimed by the Appellant, is now immaterial, and doth not properly come in Judgement in this Cause; it is hereby also Ordered and Adjudged, That the said Interlocutor of the 12th of November 1742, pronounced thereupon, be, and the same is hereby, reversed; but without Prejudice to that Question, when the same shall properly come in Judgement in any other Case: And as to the said Interlocutor of the 26th of January 174½, concerning the Superiority and Non-entry Duties of the Lands of Ellistoun, it appearing in this Case, that, since the exhibiting of the Original Appeal, John Earl of Selkirk and Ruglen is dead without Issue Male, by Means whereof new Questions may arise between the Parties as to that Part of the Estate in Question, it is hereby further Ordered and Adjudged, That the said Interlocutor and Affirmance thereof be, and the same are hereby, reversed; and that the Court of Session do re-hear this Cause, as to the said Superiority and Non-entry Duties of the Lands of Ellistoun, and proceed therein according to Law and the Course of the said Court: And it is further Ordered and Adjudged, That the rest of the said Interlocutors complained of be, and the same are hereby, affirmed.

A Message was brought from the House of Commons, by Mr. Hoblyn and others:

With a Bill, intituled, "An Act for rendering more effectual the several Acts passed, for the erecting of Hospitals and Workhouses within the City of Bristol, for the better employing and maintaining of the Poor thereof;" to which they desire the Concurrence of this House.

County Elections, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to explain and amend the Laws touching the Elections of Knights of the Shire, to serve in Parliament, for that Part of Great Britain called England."

After some Time, the House was resumed.

And the Earl of Warwick reported from the said Committee, "That they had gone through the Bill, and made some Amendments thereunto; which he would be ready to report, when the House will please to receive the same."

With a Bill, intituled, "An Act for granting further Powers to the Commissioners for building a Bridge cross the River Thames, from the City of Westminster, to the opposite Shore in the County of Surrey; and for the better enabling them to finish the said Bridge, and to perform the other Trusts reposed in them;" to which they desire the Concurrence of this House.

The Lord Willougby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of the Freehold and Copyhold Estates of Rodolph Hobbes Gentleman, deceased, in the County of Bucks, for discharging the Encumbrances affecting the same; and for making Provision for his Widow and Infant Children," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and made some Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House.
