Message from H. C. to return Lechmere's Bill.

A Message from the House of Commons, by Mr. Sandys and others:

To return the Bill, intituled, "An Act for vesting Part of the Estate late of Anthony Lechmere Esquire, deceased, in Trustees, to be sold, for Payment of Debts;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Nedham's Bill.

The Earl of Clarendon reported from the Lords Committees to whom the Bill, intituled, "An Act for Sale of Part of the Estate of Edward Nedham Gentleman, in the County of Leicester, for Payment of Debts charged thereupon; and for other Purposes therein mentioned," was committed: "That they had considered of the said Bill, and found the Allegations thereof to be true; that the Parties concerned had given their Consents; and that the Committee had gone through the Bill, and made some Amendments thereunto."

Which were read Twice, and agreed to.

Ordered, That the Bill, with the Amendments, be engrossed.

List of Army Debts undetermined, delivered:

The House being informed, "That the Secretary of the late Commissioners for examining and determining the Debts due to the Army attended:"

He was called in; and delivered, at the Bar, pursuant to the Order of this House of Thursday last,

A List of the Demands remaining undetermined by Commissioners for examining and determining the Debts due the Army."

And withdrew.

And the Title of the said List was read.

Signs Manual and Certificates to be laid before the House.

Ordered, That the late Commissioners, appointed to examine, state, and determine, the Debts due to the Army, do lay before this House, a List of all the Signs Manual they have received; expressing what Services they were for, and what Sums they have Certificates for thereupon.

Aislabie and Administrators of Craggs, Petitions against the Bill for Relief of the South Sea Sufferers, considered:

The House (according to Order) resumed the adjourned Consideration of the Petition of John Aislabie Esquire; as also the Petition of Edward Eliot and Elizabeth his Wife, Anne the Wife of John Newsham Esquire, and Margaret the Wife of Samuel Trefusis Esquire, Daughters, Coheirs, and Administrators, of James Craggs late of London Esquire, deceased; praying to be heard, by their Counsel, against the Bill, intituled, "An Act for raising Money, upon the Estates of the late Sub-governor, Deputy Governor, Directors, Cashier, Deputy Cashier, and Accomptant, of the South Sea Company, and of John Aislabie Esquire, and likewise of James Craggs Senior Esquire, deceased, towards making good the great Loss and Damage sustained by the said Company; and for disabling such of the said Persons as are living, to hold any Office or Place of Trust under the Crown, or to sit or vote in Parliament, for the suture; and for other Purposes in the said Act expressed," before any further Proceedings be had thereupon.

After Debate; and reading the several Proceedings out of the Journals of this House, in the Year 1695, upon the Bill relating to Sir Thomas Cooke; as also the Proceedings in the Year 1697, upon the Bill for punishing Charles Duncomb Esquire:

Resolved, by the Lords Spiritual and Temporal in Parliament assembled, That a Conserence be desired with the House of Commons; to the End that the Grounds upon which the last mentioned Bill proceeded in that House, so far as the same relates to John Aislabie Esquire and James Craggs Senior Esquire, deceased, may appear the more plainly to their Lordships.

Committee to prepare Heads for a Corference, to know on what Grounds the Bill proceeded in H. C. with respect to them:

The Lords following were appointed a Committee, to prepare what shall be offered at the said Conference; and to report to the House; (videlicet,)

"The Lords having entered upon the Consideration of the Bill, intituled, "An Act for raising Money, upon the Estates of the late Sub-governor, Deputy Governor, Directors, Cashier, Deputy Cashier, and Accomptant, of the South Sea Company, and of John Aislabie Esquire, and likewise of James Craggs Senior Esquire, deceased, towards making good the great Loss and Damage sustained by the said Company; and for disabling such of the said Persons as are living, to hold any Office or Place of Trust under the Crown, or to sit or vote in Parliament for the future; and for other Purposes in the said Act expressed;" and having read the same a First and Second Time, and committed it; and the Matters of Fact suggested in the said Bill, as the Ground and Foundation upon which it seems to have proceeded in the House of Commons, so far as the same relates to the said John Aislabie and to the said James Craggs, not appearing sufficiently before the Lords: Their Lordships have desired this Conference, that they may have the Assistance of the Commons, in order to have the State of the said Matters of Fact more fully laid before their Lordships."

Which Report, being read by the Clerk, was agreed to by the House.

This Day the Answer of Mary Vaughan Widow, and of Walter Vaughan an Infant, by the said Mary Vaughan his next Friend, Respondents to the Petition and Appeal of the Honourable Joslin Sidney Esquire and Elizabeth his Wife, Francis Dorsett and Emmett his Wife, was brought in.

Message to H C for a Conference on South Sea Sufferers Bill.

A Message was sent to the House of Commons, by Mr. Lovibond and Mr. Bennet:

To desire a present Conference with that House, in the Painted Chamber, upon the Subject-matter of the Bill, intituled, "An Act for raising Money, upon the Estates of the late Sub-governor, Deputy Governor, Directors, Cashier, Deputy Cashier, and Accomptant, of the South Sea Company, and of John Aislabie Esquire, and likewise of James Craggs Senior Esquire, deceased, towards making good the great Loss and Damage sustained by the said Company; and for disabling such of the said Persons as are living, to hold any Office or Place of Trust under the Crown, or to sit or vote in Parliament, for the future; and for other Purposes in the said Act expressed."

Earl of Rothes' Privilege re-referred.

The Earl of Clarendon reported from the Lords Committees for Privileges, to whom was referred the Matter of the Complaint of a Breach of Privilege, committed by James Cleiland Younger Messenger, in summoning, requiring, and commanding, John Earl of Rothes, Provost or Mayor of the Town of Coupar in Fife, the Twentyfourth of March last, to appear before the Court of Session at Edinburgh, at the Suit of Patrick Crombie and Walter Christieson, late Magistrates of the said Town, and others: "That the Committee, having taken into Consideration the Matter of the Complaint to them referred, have thought proper to direct the Matter, as it appeared to them, to be reported specially to the House; as also the Nature of the Evidence produced to prove the same, as follows:

"The Committee, in the First Place, were informed, That the said Earl of Rothes has, for many Years past, been Annually chosen Provost or Mayor of the said Town of Coupar; and particularly, at the last Annual Election in the Months of September or October last, he was elected Provost, as were likewise the full Number of other Magistrates in that Town, and, with the other Magistrates, continued to exercise their respective Offices of Magistracy, without any Complaint or Interruption, till the Twenty-second of March last;" after which Information, there was delivered in, at the Bar, and read, a Paper in Writing, intituled, "Notorial Copy of the Process pursued before the Lords of Session, at the Instance of Patrick Crombie and Walter Christieson Merchants, and late Baillies of the Town of Coupar, and others, against John Earl of Rothes and others;" in which Paper is contained a Copy of Letters, said to be given under His Majesty's Signet, the Twenty-second of March 1721, and subscribed by Will. Wilson for Mr. James Anderson, written by William Simson his Servant, giving full Power to Messengers, to summon, warn, and charge, John Earl of Rothes and Mr. Charles Leslie his Son, John Bayne One of the present Baillies of the said Town of Coupar, Will. Rigg present Baillie and Counsellor there, and Mr. Horseburgh Sheriff Clerk of Fifc, present Baillie of the said Town, and others, to compere before the Court of Session in Scotland, on the First and Fifteenth Days of June 1721, at the Suit of the said Crombie, Christieson, and others, to hear and see certain Matters, touching the Election of Magistrates for the said Town of Coupar, declared null and void, and the said Earl and other Magistrates discharged from exercising their Offices, and themselves decerned to make Payment of the Damages and Expences sustained, or to be sustained, by the Pursuers.

"There is also contained in the said Paper a Copy of a Summons, said to be executed at the Instance of Patrick Crombie and Walter Christieson Merchants, and late Baillies of Coupar, William Sibbald Son to the deceased David Sibbald late Baillie there, James Dott Clothier and Dyer there, Thomas Davidson Guild Brother there, David Smith late Dean of the Smiths there, and John Anderson late Deacon of the (fn. 1) Wrights of the said Borough, for themselves, and in the Name of the whole Guildry, Trades, and Burgesses, in the said Borough of Coupar, concurring with them against the said Earl of Rothes and his Son, John Bayne, Will. Rigg, and Mr. Horseburgh, and others.

"That there is contained, in the said Copy of the Summons, a Copy of the Execution of the same whereby the said Earl of Rothes and others are charged to answer the said Suit.

"For the Proof of which Summons, this Copy is attested to be true, by Two Notaries and Four Witnesses subscribing; to which is subjoined a Declaration, signed Ja. Elphinston, declaring, "That, in his Presence, being a Justice of Peace, the abovementioned Two Notaries and Four Witnesses did, upon their Oaths, declare, That they had diligently compared the above Copy with the Principal Writings themselves, and deponed the same is a just and true Copy thereof."

"That there appeared, at the Bar, George Lesley and William Caddell Esquire; who, being examined, did attest, upon their Oaths, "They were well acquainted with the Hand-writing of Sir James Elphinston; and verily believed the said Subscription, Ja. Elphinston, to be the Hand-writing of the said Sir James Elphinston."

Which Report being read by the Clerk:

It was moved, "That the Standing Order of this House, of the Eleventh of January 1699, That no Person shall be taken into Custody upon Complaint of a Breach of Privilege, but upon Oath made at the Bar of this House, might be read."

The same was read accordingly.

Ordered, That the Matter of the said Complaint be re-referred to the same Committee.

Commissioners Army Debts, Bill.

Whereas Yesterday was appointed, for the Second Reading of the Bill, intituled, "An Act for appointing Commissioners, to examine, state, and determine, the Debts due to the Army:"

It is Ordered, That the said Bill be read a Second Time To-morrow Morning.

Odell versus Graydon et al.;

After hearing Counsel, upon the Petition and Appeal of John Odell Esquire; complaining of several Orders of the Court of Exchequer in Ireland, of the Third of July One Thousand Seven Hundred and Two, the Twenty-fifth of May One Thousand Seven Hundred and Twenty, and the Third of May last, in a Cause wherein Henry Graydon deceased and Grizel his Wife, John Langton and Mary his Wife, were Plaintiffs, and the Appellant and others were Defendants; and praying, "That the same may be reversed, and the Respondents Bill dismissed:" As also upon the Answer of the said Grizel Graydon, John Langton and Mary his Wife, put in to the said Appeal; and due Consideration had of what was offered on either Side in the said Cause:

Orders affirmed, with Costs.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the several Orders therein complained of be, and are hereby, affirmed: And it is further Ordered, That the Appellant do pay, or cause to be paid, to the Respondents, the Sum of Sixty Pounds, for their Costs in respect of the said Appeal.

Upon reading the Petition of Robert Blake Esquire, Respondent to the Appeal of Sibella Appolinea Blake, and Jane Henrietta Barbara Blake, by Elizabeth Blake their Mother and Guardian; praying, "That the said Appellants may be obliged to procure Richard Blake, made a Party to the said Appeal by Order of this House, to put in his Answer thereunto by a short Day; he having neglected to put in his Answer, as required by their Lordships Order of the Sixth of June last; and that, in Default thereof, a Day may be appointed, for hearing the said Cause, on the Merits of the same:"

It is Ordered, That the Appellants do procure the said Richard Blake to put in his Answer to the said Appeal, within a Week.

Captain Coudell, Petition for a Clause in the Bill for stating Army Debts.

A Petition of Captain Mathew Coudell, was presented to the House, and read; setting forth, "That, in the Beginning of the late War, the Petitioner, being in the Enemy's Service, did, upon the Proclamation published by the late Duke Schonburgh (in Pursuance of Her Majesty's Warrant) in Portugal, the Twentyfifth of April 1704, quit the same, and came over to the Allies, on the Terms therein mentioned;" and praying, "That a Clause may be inserted in the Bill now depending, intituled, "An Act for appointing Commissioners, to examine, state, and determine, the Debts due to the Army," to empower the said Commissioners to state and determine the Petitioner's Demands, as to what shall appear to be remaining due to him on Accompt of his Whole and Half Pay, pursuant to the Intent and Meaning of the said Proclamation."

It is Ordered, That the said Petition do lie on the Table.

South Sea Sufferers, for Relief of, Bill.

The Order of the Day, for the House to be in a Committee upon the Bill, intituled, "An Act for raising Money, upon the Estates of the late Sub-governor, Deputy Governor, Directors, Cashier, Deputy Cashier, and Accomptant, of the South Sea Company, and of John Aislabie Esquire, and likewise of James Craggs Senior Esquire, deceased, towards making good the great Loss and Damage sustained by the said Company; and for disabling such of the said Persons as are living, to hold any Office or Place of Trust under the Crown, or to sit or vote in Parliament for the future; and for other Purposes in the said Act expressed;" being read:

It is Ordered, That the House be put into a Committee thereupon, on Saturday next.

Message from H. C. for a Conference on the Bill for Relief of the Sufferers in the South Sea:

A Message was brought from the House of Commons, by Mr. Clayton and others:

To desire a Conference, upon the Subject-matter of the last Conference.

To which the House agreed.

Then the Messengers were called in; and told, "That the Lords do agree to a Conference, as desired; and appoint it presently, in the Painted Chamber."

And the Lord President reported, "That the Managers had been at the Conference; which, on the Part of the Commons, was managed by Mr. Clayton and others; who delivered a Paper, to the Effect following; (videlicet,)

"Your Lordships having desired, at a Conference, That the Commons would acquaint your Lordships with the Matters of Fact upon which the Bill, intituled, "An Act for raising Money, upon the Estates of the late Sub-governor, Deputy-governor, Directors, Cashier, Deputy-cashier, and Accomptant, of the South Sea Company, and of John Aislabie Esquire, and likewise of James Craggs Senior Esquire, deceased, towards making good the great Loss and Damage sustained by the said Company; and for disabling such of the said Persons as are living to hold any Office or Place of Trust under the Crown, or to sit or vote in Parliament, for the future, and for other Purposes in the said Act expressed," so far as the same relates to the said John Aislabie and to the said James Craggs, was grounded:

"The Commons have commanded us to acquaint your Lordships, That the said Matters of Fact, so suggested in the said Bill, are relative to the Matters of Fact suggested in the former Part of the Preamble of the Bill, and will be explained thereby. And, for your Lordships further Satisfaction, we are commanded by the Commons to acquaint your Lordships, That the Bill, so far as it relates to the said John Aislabie, besides the Notoriety of Facts, was grounded as well upon Proof, as the Confession of Mr. Aislabie.

"As to the Confession of Mr. Aislabie; we are commanded by the Commons to affirm, in their Names, to your Lordships, That Mr. Aislabie did, in his Place, confess, "That, upon the Third and Nineteenth Days of December 1719, £. 22,000. South Sea Stock was bought, by Mr. Robert Knight, late Cashier of the South Sea Company, for him the said Mr. Aislabie:" And Mr. Aislabie delivered in to the Commons, a Paper of the Hand-writing of Mr. Knight, containing Part of an Accompt, in the Words following; (videlicet,)

"We are also commanded to acquaint your Lordships, That the Commons having received Information, "That Mr. Francis Hawes (One of the late Directors of the South Sea Company) had negotiated very large Sums for Mr. Aislabie, and had Dealings for a considerable Time past in South Sea Stock with the said Mr. Aislabie; and that an Accompt thereof was kept in a Book, of which Mr. Aislabie had a Duplicate, which Accompts were continued in that Book till some Time in November last:" The Commons did, on the Seventh Day of March last, order that the said Book should be laid before them the next Morning; at the making of which Order, Mr. Aislabic was present in his Place, and did not object or offer any Thing to the House, that the same could not be complied with. But the next Day, Mr. Aislabic attending, in his Place, to make his Defence to the several Matters objected to him; an Obedience to that Order being required, Mr. Aislabie declared, "That Mr. Hawes, if called in, would tell the House, "That Mr. Hawes, with his own Hands, committed the said Book to the Fire." Upon which, Mr. Hawes, being called in, and examined, said, "That the said Book was, in the Beginning of November last, upon Mr. Aislabie's pressing Instances, delivered up by him to Mr. Aislabie; and the same Book, and also the said Duplicate thereof kept by Mr. Aislabie, were both then burnt together, Part by Mr. Aislabie, and Part by himself at Mr. Aislabie's Instance; and that the Proposal for burning them came from Mr. Aislabie." And Hawes further said, "That he had not any Duplicate or Entry of what was contained in the said Book."

"We are further commanded to acquaint your Lordships, That, upon the Twentieth of January 1719, the Commons resolved, "That their House would, upon the Two and Twentieth of that Month, resolve itself into a Committee of the whole House, to consider of that Part of His Majesty's Speech which related to the Public Debts;" which the House did accordingly. And that aftewards, on the Twentyseventh of January, the House again resolved itself into the said Committee: And the Committee did then receive Proposals from the South Sea Company, for paying the Public Debts.

"As for Proof; the several Persons following, (videlicet,) Mr. Robert Surman, Mr. Francis Hawes, Mr. Mathew Wymondesold, Thomas Weddell Esquire, Sir Theodore Janssen, Sir Lambert Blackwell, Mr. Wehster, Mr. Robert Knight, Sir John Fellowes, Sir John Blunt, Mr. John Falconbridge, Edmund Waller Esquire, Mr. Edward Gibbon, and Mr. Charles Joye, were examined; and did, in the Opinion of the Commons, make out the Allegations in the said Bill, relating to the said Mr. Aislabie.

"The Commons have also commanded us to acquaint your Lordships, That the said Bill, so far as the same relates to the said James Craggs, besides the Notoriety of Facts, was grounded upon Proof; and that Mr. Robert Surman, Sir John Blunt, Mr. Charles Joye, Mr. Jacob Sawbridge, Sir George Caswall, Mr. James Grammer, Mr. Mathew Wymondesold, and Mr. Thomas Horne, did, in the Opinion of the Commons, make out the Allegations in the said Bill, which relate to the said James Craggs."

Which Report, being read by the Clerk, was ordered to be taken into Consideration To-morrow; and the Lords to be summoned.

Carroll & al. versus Chamberlain & al.:

After hearing Counsel, upon the Petition and Appeal of Eleanor Carroll and Anthony Carroll, Executors of William Carroll; complaining of a Decree of Dismission made in the High Court of Chancery in Ireland, the Third of February last, in a Cause wherein the Appellants were Plaintiffs, and Christopher Chamberlain, Margaret his Wife, and Margaret Coddan, were Defendants; and praying, "That the same may be reversed, and the Defendants compelled to execute a legal Lease of the Premises in Question; or that such Decree may be made as the Lord Chancellor of Ireland ought to have made:" As also upon the Answer of the said Chrislopher Chamberlain, Margaret his Wife, and Margaret Coddan, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Decree affirmed, with Costs.

E. of Coningesby's Privilege:

A Petition of Thomas Earl Coningesby, was presented to the House, and read; complaining of Two most notorious Breaches of the Privilege of this House; one, in relation to scandalous Words against the Petitioner, said to be spoken by William Jenkins; and the other, in procuring a Commission to be issued out of Chancery, the Twenty-seventh of April last, to empower certain Persons to survey, divide, and distinguish, a Farm belonging to the Petitioner.

Ordered, That the Consideration of the said Petition be referred to the Lords Committees for Privileges.

Report of E. of Coningesby's Privilege:

The Earl of Clarendon reported from the Lords Committees for Privileges, to whom the Petition of Thomas Earl Coningesby, complaining of a Breach of his Privilege, and the Privilege of this House, was referred: That the Committee have taken into Consideration the Matter of the said Petition, complaining of a Breach of Privilege committed, since the Petitioner's Consinement, by Thomas Rodd Attorney at Law and others, in serving several of the Petitioner's menial Servants with Rules out of the Court of King's Bench, as also One of his Tenants with an Ejectment by the said Rodd, at the Suit of Thomas Lingen Clerk and others; and likewise that Jonas Cook did, some Time last Month, pull down a Wall, which was a Fence for the Petitioner to a Piece of Pasture-ground in the Petitioner's own Hands, known to be Part of the Demesne Lands of the Manor of Marden, though the said Cook was forbid, at his Peril, to do the same: And that their Lordships, having examined several Witnesses, upon Oath, touching the Matter of this Complaint, are of Opinion, That as to so much thereof as relates to the serving the Petitioner's Servants with the said Rules of Court, was no Breach of the Privilege of this House; and as to such Part of the said Complaint which relates to the delivering an Ejectment to One of the Petitioner's Tenants, the same was likewise no Breach of Privilege; but as to the other Matter of the said Complaint, which relates to the pulling down the Petitioner's Wall by the said Cook, the Committee are of Opinion, That the said Jonas Cook, in pulling down Part of the said Wall, within the Time of Privilege of Parliament, is guilty of a Breach of the Privilege of this House:"

Which Report, being read by the Clerk entire, the Resolutions therein were read a Second Time, and severally agreed to by the House; and the following Order was made:
