E. Ferrers' Privilege; Hurd to be attached, for arresting Kirkland, his Servant:

Complaint being made to the House, and Oath made at the Bar, "That Thomas Kirkland, Steward and menial Servant to Robert Earl Ferrers, was arrested, during the Time of Privilege of Parliament, at the Suit of John Hurd, in Breach of the said Earl's Privilege, and the Privilege of this House:"

It is thereupon Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Serjeant at Arms attending this House, his Deputy or Deputies, do forthwith attach the Body of the said John Hurd; and bring him, in safe Custody, to the Bar of this House, to answer for his Offence; and this shall be a sufficient Warrant on that Behalf.

To Francis Jephson Esquire, Serjeant at Arms attending this House, his Deputy or Deputies, and every of them.

Leacroft to attend about it.

Complaint was also made to the House, "That Thomas Leacroft, an Attorney, hath not only been concerned in arresting the said Thomas Kirkland, but also in delivering, or causing Declarations to be delivered, against Thomas Tipper and Joseph Frost Tenants to Earl Ferrers, within the Time of Privilege of Parliament:"

It is therefore Ordered, That the said Thomas Leacroft do attend this House, on Monday the Twenty-sixth Day of this Instant March, to answer the said Complaint; and that Notice be forthwith given him of this Order.

Tobacco and Wine Merchants Bill rejected.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for Relief of Merchants, Importers of Tobacco and Wine, concerned in Bonds given for Part of the Duties on the same."

And, after some Time spent therein, the House was resumed.

And the Earl of Clarendon reported from the said Committee, "That they had heard the Officers of the Customs concerned in the Revenue, touching the said Bill; as also the Merchants, upon their Petition, pursuant to the Order of this House; and that the Committee had gone through the Bill, and disagreed to every Part thereof."

Ordered, That the said Bill be rejected.

E. Wintoun's Petition to put off his Trial, rejected.

A Petition of George Earl of Wintoun, was presented to the House, and read; setting forth, "That his Agents have used all possible Diligence in getting his Witnesses hither; and several of them are lately arrived; but Four of the most material of them, though they all be on their Way hither, are not yet come up, some of them being lame, and others very infirm, so that they are not able to travel so quickly; and praying that the Time appointed for his Trial may be enlarged, for such Time as their Lordships, in their great Justice and Wisdom, shall think proper, in a Case of so great Concern."

And, after Debate thereupon, and reading the Orders made in relation to the said Trial;

Charles Menzies, the Petitioner's Solicitor, was called in; and examined, upon Oath, at the Bar, touching the Allegations of the said Petition.

And being withdrawn;

It was moved, "To reject the Petition."

And the Question being put, "Whether the said Petition shall be rejected?"

It was Resolved in the Affirmative.

Address for a Lord High Steward.

Ordered, That an humble Address be presented to His Majesty, humbly to desire, "That His Majesty will be pleased to appoint a Lord High Steward, for the Trial of George Earl of Wintoun, on Thursday next, in Westminster Hall, upon the Impeachment of High Treason exhibited against him by the House of Commons."

Ordered, That the said Address be presented to His Majesty by the Lords with White Staves.

Adjourn.
