Touchet versus Count. Castlshaven:
After hearing Counsel Yesterday and this Day, upon the Petition and Appeal of James Touchett, of the City of Dublin, in the Kingdom of Ireland, Esquire, from a Decree of Dismission made in the Court of Chancery in the said Kingdom, the Eighth Day of December 1713, and an Affirmation of the same on the Twenty-fourth Day of February following, in a Cause wherein the Appellant was Plaintiff, and Elizabeth Countess Dowager of Castlehaven and James Earl of Castlehaven were Desendants; praying, "That the said Decree may be reversed:" As also upon the Answer of the said Countess Dowager and Earl of Castlehaven put in to the said Appeal; and due Consideration had of what was offered in this Cause:
Judgement affirmed.
It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the said Decree, and the Affirmation thereof, in the said Appeal complained of, be, and are hereby, affirmed.
Pitts versus Page.
Upon reading the Petition and Appeal of Mathew Pitts Esquire; complaining of a Decree of the Court of Exchequer, made the Fourth Day of this Instant July, in a Cause wherein George Page was Plaintiff, and the Appellant Defendant, & è contra; and praying, "That the said Decree may be reversed; and that the Petitioner may have such Relief as to the Judgement of this House shall seem meet:"
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said George Page may have a Copy of the said Appeal; and shall and is hereby required to put in his Answer thereunto, in Writing, on or before Wednesday the Tenth Day of August next.
Daly versus Lynch.
The House being moved, on the Behalf of Mary Lynch, Respondent to the Appeal of Denis Daly Esquire and Ellin his Wife, "That the hearing the same be put off for some few Days; her Money not being remitted to her from Ireland, as was promised;" and the Appellants consenting:
It is Ordered, That this House will hear the said Cause, by Counsel, at the Bar, on Thursday the Fourth Day of August next, at Eleven a Clock.
Powell to enter into Recognizance for Evans.
Upon reading the Petition of John Evans and Mary his Wife; praying, "In regard their Residence is in Herefordshire, that David Powell, their Agent, may be at Liberty to enter into a Recognizance upon their Behalf, on their Appeal depending in this House:"
It is Ordered, That the said David Powell hath hereby Liberty to enter into a Recognizance for the Petitioners, as desired.
Adjourn.
