Akerode, Stanfeild, &c. versus Whawley.

Forasmuch as in the Matter depending now in Parliament, by Writ of Error, brought by John Akerode, Thomas Stansfeilde, and divers others, Plaintisfs, against Richard Whawlley, Defendant, for the reversing of certain Errors, supposed by the said Plaintiffs to be in the said Defendant's Grandfather's Form of Pleading, and other Things, in his Recovery of the Manor of Eringden, in the County of Yorcke; it hath appeared to this Honourable Court, by the Certificate of the Lords Chief Justices, the Master of the Rolls, and others, being by this Honourable Court appointed Committees to hear and examine the Matter Privately before them, that the Writ of Error, and the Scire Facias, are insufficient in Law, for divers Causes opened to this Court; therefore it is, the Day abovesaid, Ordered, by the said Lords, That the said Writ of Error shall abate, and the Plaintiffs to pursue their further Remedy as they shall think good.
