Hampson to enter into Recognizance for Polland.
Upon reading the Petition of Walter Pollard Esquire, praying, "That Charles Hampson Esquire, his Agent, may be permitted to enter into a Recognizance for him upon his Appeal depending in this House, the Petitioner's Residence being in Ireland:"
It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Charles Hampson may enter into a Recognizance for the Petitioner as desired.
River Trent navigable, Bill.
Hodie 1a vice lecta est Billa, intituled, "An Act for making more effectual an Act of the Tenth and Eleventh Years of the Reign of King William, intituled, An Act for making and keeping the River Trent, in the Counties of Leicester, Derby, and Stafford, navigable."
Gery, in Behalf of E. of Huntington, Petition to be heard to it.
Then a Petition of John Gery, Doctor of Laws, Archdeacon of Bucks, and Testamentary Guardian of the Right Honourable Theophilus Earl of Huntingdon, a Minor, on Behalf of the said Earl, was presented to the House, and read; praying "to be heard, by his Counsel, before the said Bill shall be passed; and to make such Objections to the said Bill, or any Matters contained in it, as he shall be advised unto."
Ordered, That the said Petition do lie on the Table, until the Second Reading of the said Bill.
State of the Navy to be considered.
Ordered, That the Lords Committees appointed to consider of the Sate of the Navy be revived, and meet on Monday Morning next; and that a Book, intituled, "A List of Her Majesty's Ships, from Fifty Guns and upwards, with the Condition of each, laid before this House, from the Commissioners of the Admiralty, the 31st of March last," be referred to the said Committee; and that their Lordships have Power to send for Persons, Papers, and Records.
Wilson versus Tooker:
After hearing Counsel, upon the Petition and Appeal of William Wilson Goldsmith, from a Decretal Order made in the Court of Chancery the Second Day of July last, on the Behalf of James Tooker; praying, "that the same may be reversed:" As also upon the Answer of the said James Tooker put in thereunto; and due Consideration of what was offered thereupon:
Judgement reversed.
It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Decretal Order of the Second of July last, complained of in the said Appeal, be, and is hereby, reversed; and that the Appellant do accompt with the Respondent for all Sums of Money received by the Appellant, either by Sale of the Annuities, or out of the Exchequer, by virtue thereof; and on Payment by the Respondent of what shall remain due to the Appellant on such Accompt, for Principal and Interest together, with his the Appellant's Costs, to be taxed by the Court of Chancery, in such Time as shall be limited by the said Court, the Appellant, is hereby enjoined from proceeding against the Respondent on the Action of Covenant or otherwise.
