Morison versus Nisbet & al.

Upon reading the Petition and Appeal of William Morison Esquire, from Two several Decretal Orders of the Lords of Council and Session in Scotland, on the Behalf of William Nisbett of Dirlton, Dame Jane Nisbett, Lady Harden, Sir William Scott of Thirlstons, the Heirs of William Scott of Harden, her First Husband, deceased, praying Relief:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said William Nisbett and the other Parties abovenamed may have a Copy of the said Appeal; and shall and are hereby required to put in their Answer or respective Answers thereunto, in Writing, on or before Wednesday the Twelfth Day of May next, at Eleven a Clock.

Dutchess of Hamilton & al. for Time to bring up a Writ of Error.

Upon reading the Petition of Elizabeth Dutchess of Hamilton and Brandon, the Lady Charlotte Orby, John Elrington Esquire, and the Honourable Mrs. Elizabeth Mohun an Infant; shewing, "That Elizabeth Lady Mohun brought Ejectments in the Court of Exchequer, in order to get Possession from the Petitioners of several Manors and Lands in the Counties of Chester and Lancaster; and, having obtained Verdicts in the said Ejectments, the Petitioners have brought Writs of Error, returnable in Parliament; and are fully determined to transcribe and bring up the Records from the Exchequer Chamber, to be argued in this House; but their Attorney being (without their Privity) gone into Cheshire, and not yet returned, they have now employed another Clerk to transcribe the said Records, which, by reason of the great Number of Tenants made Defendants therein, contain above Twelve Rolls of Parchment;" and praying, "that convenient Time may be allowed, to transcribe the said Records, and bring up the said Writs of Error:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Plaintiffs in the said Writs of Error do, on or before Wednesday the Twentyeighth Day of this Instant April, procure the same to be returned into this House; and, in Default thereof, that the Court of Exchequer may proceed to award Execution, as if no such Writs of Error had been granted.

Highways Wilts, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for repairing the Highways between Shepherd's Shord and Horsley Upright Gate, leading down Bagdon Hill, in the County of Wilts, and other ruinous Parts of Highways adjacent thereunto."

Ordered, That the said Bill be committed to a Committee of the whole House, on Tuesday next.

Herbert & Ux. versus Finch & al.

The House being moved, "That a Day may be appointed, for hearing the Cause depending in this House, wherein Philip Herbert Esquire and Mariamne his Wife are Appellants, and John Finch Esquire and others are Respondents:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Wednesday the Twenty-first Day of this Instant April, at Eleven a Clock.

Lockhart versus Chiefly.

The House being also moved, "That a Day may be appointed, for hearing the Cause depending in this House, wherein George Lockhart Esquire is Appellant, and John Cheisley Esquire and others are Respondents:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel, at the Bar, on Friday the Twenty-third Day of this Instant April, at Eleven a Clock.

After reading, and considering, the Report of the Judges, to whom was referred the Petition of John Tregagle and others; praying Leave to bring in a Bill, for the Purposes therein mentioned:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That Leave be given to bring in a Bill, according to the Prayer of the Petition.

Hodie 1a vice lecta est Billa, intituled, "An Act for Sale of Part of the Estate of Joseph Oliver Gentleman, lying in the County of Devon and City of Exon, for Payment of his Debts, and for making Provision for Maintenance and Education of his Daughter."

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Bill shall be, and is hereby, referred to Mr. Baron Bury and Mr. Baron Price; who are forthwith to summon all Parties that are to be concerned therein; and, after hearing them, and perusing a Copy of the Bill, attested by the Clerk of the Parliaments, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands.

Yarmouth Church, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for the building a new Church, or Chapel of Ease, in Great Yarmouth, in the County of Norfolk, by a Duty or Imposition on all Coals, Culm, and Cinders, to be landed there."
