This Day John Duke of Montagu sat first in Parliament, upon the Death of his Father Ralph Duke of Montagu; and took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.

E. Sandwich & al. Petition referred to Judges.

Upon reading the Petition of Edward Earl of Sandwich and Elizabeth Countess of Sandwich his Wife, Edward Richard Lord Hinchingbrook (Son and Heir of the said Earl) and Elizabeth Lady Hinchingbrook his Wife; praying Leave to bring in a Bill, for the applying One Moiety of the Lady Hinchingbrook's Portion for and towards the paying of Six Thousand Pounds, Part of the Debts wherewith the Earl of Sandwich's Estate stands now charged; and for applying the other Moiety to the Use of the said Earl; and for vesting divers Feefarm Rents in Trustees, for Two Hundred Years, for the paying Five Hundred Pounds per Annum to the Lady Hinchingbrook, pursuant to her Marriage Articles; and for applying the Overplus to the Lord Hinchingbrook during so many Years of the said Term as the said Lord and Lady Hinchingbrook shall live; and, after the said Lord's Death, in case the said Lady survive, for paying the whole Receipt of the said Fee-farm Rents to the said Lady, during her Life, for her Jointure; and, after her Death, for Provision and raising Portions for the Daughters and Younger Children of the said Lord and Lady Hinchingbrook; and for settling the whole Real Estate of the said Earl, in such Manner, as that the same may continue in the Name and Family of the said Earl; and that the said Countess of Sandwich may have her Rent-charge of Twelve Hundred Pounds per Annum paid her during Coverture:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Justice Powell and Mr. Baron Bury; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Message from H. C. to return Brasennose College Bill.

A Message was brought from the House of Commons, by Mr. Nicholas and others:

To return the Bill, intituled, "An Act for confirming to the Principal and Scholars of King's Hall, and College of Brasen-nose, in the University of Oxford, the Purchase of the Advowsons of Stepney and other Churches; and for settling the same to the Benefit of the said College;" and to acquaint this House, that they have agreed to the said Bill, without any Amendment.

Upon the First Reading of the said Bill, it is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration thereof shall be, and is hereby, referred to Mr. Justice Powell and Mr. Justice Tracy; who are forthwith to summon all Parties that are to be concerned therein; and, after hearing them, and perusing a Copy of the Bill, attested by the Clerk of the Parliaments, are to report to the House the State of the Case, with their Opinion thereupon, under their Hands.
