Hodie 2a vice lecta est Billa, intituled, "An Act for the better recruiting Her Majesty's Land Forces and the Marines, for the Year One Thousand Seven Hundred and Seven."
Ordered, That the said Bill be committed to a Committee of the whole House, presently.
Then the House was adjourned during Pleasure, and put into a Committee thereupon.
After some Time, the House was resumed.
And the Lord Herbert reported, "That the Committee of the whole House had gone through the said Bill; and think it fit to pass, without any Amendment."
Thompson versus Ling, in Error.
Whereas Brian Thompson and Walter Wildboare brought into this House their Writ of Error, on the Seventh Day of this Instant March, to reverse a Judgement given in Her Majesty's Court of Queen's Bench, and the Affirmation thereof in Her Majesty's Court of Exchequer, to which Brian Ling is Defendant; that, by the Standing Orders of this House, the Plaintiffs ought to have assigned Errors thereupon within Eight Days after bringing the same into this House, which they have not done; and the House being this Day moved, "That the said Writ of Error should be discontinued, for Want of Prosecution:"
Writ of Error discontinued.
It is therefore Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Writ of Error shall be, and is hereby, discontinued; and that the Record shall be remitted, to the End Execution may be had, as if no such Writ of Error had been brought into this House.
The Tenor of which Judgement, to be affixed to the Transcript of the Record to be remitted, followeth; (videlicet,)
Et Postea, seilicet, Decimo Septimo Die Martii, Anno Regni dictæ Dominæ Reginæ nunc Angl. &c. Sexto usque quem Diem præd. Ordered, That the Consideration of the said Bill be committed to the Lords following; (videlicet,)
Their Lordships, or any Five of them; to meet on Tuesday the First Day of April next, at Ten a Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.
