Malt, &c. Bill.

The House was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for continuing the Duties upon Malt, Mum, Cyder, and Perry, for One Year."

After some Time, the House was resumed.

And the Lord Guilford reported, "That the Committee had gone through the said Bill; and think it fit to pass, without any Amendment."

Hodie 3a vice lecta est Billa, intituled, "An Act for continuing the Duties upon Malt, Mum, Cyder, and Perry, for One Year."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Hodie 2a vice lecta est Billa, intituled, "An Act for confirming an Agreement made by certain Articles, by and between John Earl of Kildare, Richard Lord Bellew and Frances his Lady, Charlotte Countess of Newburgh, and William Rowley Esquire; and for selling Part of the Estate of the said Earl of Kildare, for the Purposes therein mentioned."

ORDERED, That the Consideration of the said Bill be committed to the Lords following; (videlicet,)

Message from H. C. to return Pile's Bill.

A Message was brought from the House of Commons, by Mr. Bromley and others;

To return the Bill, intituled, "An Act to enable Thomas Pile Esquire and Elizabeth Freke to make Leases for Lives of the Estate of Thomas Freke, of Iwerne Courtney Esquire, deceased; as also the Son of George Pitt Esquire so to do, when entitled, and in actual Possession of the Premises; and that he may be enabled to make a Jointure, upon any Woman he shall marry, out of the same; and for establishing a School in Iwerne Courtney, and augmenting the Vicarage of Cerne Abbas, in the County of Dorsett;" and to acquaint this House, that they have agreed to their Lordships Amendments made therein.

Countess Lindsey versus E. Lindsey,

The Order being read, for taking into Consideration the Petition of Elizabeth Countess Dowager of Lindsey; praying, "she may be permitted to proceed in her Claim of Dower, notwithstanding the Privilege insisted on by the Earl of Lindsey Lord Great Chamberlain of England:"

After Consideration of the said Petition,

And Debate thereupon;

The Question was put, "Whether this Petition shall be rejected?"

It was Resolved in the Affirmative.

Mugg versus Browne, in Error.

Whereas To-morrow is appointed, for hearing the Errors argued upon the Writ of Error depending in this House, wherein Henry Mugg is Plaintiff, and John Browne Defendant; the House being moved, "That another Day may be appointed for hearing thereof, the Parties being upon an Agreement:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Errors argued in this Case on Saturday the Seven and Twentieth Day of this Instant January, at Eleven a Clock.

Griffin's Bill.

Whereas this Day was appointed, for the House to be put into a Committee on the Bill, intituled, "An Act to enable James Griffin Esquire to make Leases of Part of the Manor of Dingley, and Lands therein, for raising Money, to pay Debts and Portions for his Younger Children:" The House being moved, That the said Bill may be committed to a Select Committee, Her Majesty's Attorney General having been heard to the said Bill:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Bill shall be committed to the same Committee to whom the Bill, intituled, "An Act for confirming an Agreement made by certain Articles, by and between John Earl of Kildare, Richard Lord Bellew and Frances his Lady, Charlotte Countess of Newburgh, and William Rowley Esquire; and for selling Part of the Estate of the said Earl of Kildare, for the Purposes therein mentioned, stands committed:" Who are to meet To-morrow, at Ten a Clock in the Forenoon, in the Prince's Lodgings near the House of Peers; and to adjourn as they please.

Smith against Griffin's Bill.

Upon reading the Petition of Sir Edward Smith and others, relating to Mr. Griffin's Bill:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition shall be, and is hereby, referred to the same Committee to whom the said Bill stands committed.

Godolphin versus Tuder, in Error.

Whereas Thursday next is appointed, for arguing the Errors upon the Writ of Error depending in this House, wherein Charles Godolphin Esquire and Elizabeth his Wife are Plaintiffs, and Thomas Tuder is Defendant: The House being this Day moved, on the Behalf of the Defendant, "That a farther Day may be appointed for hearing thereof, for that he hath not all his Evidence in Town:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Errors argued in this Case on Monday the Two and Twentieth Day of this Instant January, at Eleven a Clock.

Messages from H. C. with Bills.

A Message from the House of Commons, by Mr. Gulston and others:

Who brought up a Bill, intituled, "An Act for Sale of Part of the Estate of Edward Baines Gentleman, for Discharge of a Mortgage thereupon, and making Provision for his Daughters;" to which they desire the Concurrence of this House.

A Message from the House of Commons, by Mr. Gwyn and others:

Who brought up a Bill, intituled, "An Act to enable the Right Honourable John Lord Poulett and Bridgett Lady Poulett his Wife, with the Consent of their Trustees, to sell their Shares and Interest of and in certain Manors and Lands in the County of Kent; and to purchase other Lands or Hereditaments, of the like Value, to be settled to the same Uses;" to which they desire the Concurrence of this House.

The House was adjourned during Pleasure, to robe.

The House was resumed.

Queen present.

Her Majesty, being seated on Her Royal Throne, adorned with Her Crown and Regal Ornaments, attended with Her Officers of State (the Peers being also in their Robes), commanded the Deputy Gentleman Usher of the Black Rod to let the Commons know, It is Her Majesty's Pleasure, that they attend Her presently, in the House of Peers."

Who being come; their Speaker made a short Speech to Her Majesty, in relation to the Money Bills to be passed.

Then the Clerk of the Parliaments took the said Bills from the Hands of the Speaker, and brought them to the Table; where the Clerk of the Crown read the Titles of them, and the other Bills to be passed, as follow:

Bills passed.

"1. An Act for raising Monies, by Sale of several Annuities, for carrying on the present War."

"2. An Act for continuing the Duties upon Malt, Mum, Cyder, and Perry, for One Year."

To these Bills the Clerk of the Parliaments pronounced the Royal Assent in these Words; (videlicet,)

" (fn. 1) Le Raine remercie ses (fn. 1) bon Subjects, accepte leur Benevolence, et cinsi le veult."

"3. An Act to enable Thomas Pile Esquire and Elizabeth Freke to make Leases for Lives of the Estate of Thomas Freke, of Iwerne Courtney, Esquire, deceased; as also the Son of George Pitt Esquire so to do, when entitled, and in actual Possession of the Premises; and that he may be enabled to make a Jointure, upon any Woman he shall marry, out of the same; and for establishing a School in Iwerne Courtney, and augmenting the Vicarage of Cerne Abbas, in the County of Dorsett."

"6. An Act for Sale of the Estate of Daniel Drake Gentleman, deceased, for the Provision of his Widow and Children, according to his Will."

"7. An Act for naturalizing of Henry Bowman."

To these Bills the Clerk of the Parliaments pronounced the Royal Assent in these Words,

"Soit fait come il est desiré."

Then Her Majesty was pleased to withdraw; and the Commons went to their House.
