Horner versus Hilliard & Ux.

Upon reading the Petition of William Hilliard and Mary his Wife, Respondents to the Appeal of George Horner; shewing, "That the Appellant George Horner brought his Appeal for Delay, and to prevent the Payment of Costs;" and praying, "a Day may be appointed for hearing the said Cause:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause on Friday the Twelfth Day of January next, at Eleven a Clock.

Message from H. C. with a Bill.

A Message from the House of Commons, by Mr. Lloyd and others:

Who brought up a Bill, intituled, "An Act for Sale of several Manors and Lands, in the Counties of Hereford, Radnor, and Brecon, for Payment of the Debts of Richard and Thomas Williams, late of Cabalva, in the County of Radnor, Esquire, deceased;" to which they desire the Concurrence of this House.

Hodie 1a vice lecta est Billa, intituled, "An Act for Sale of several Manors and Lands, in the Counties of Hereford, Radnor, and Brecon, for Payment of the Debts of Richard and Thomas Williams, late of Cabalva, in the County of Radnor, Esquire, deceased."

Queen to be attended.

The Earl of Bradford acquainted the House, "That the Queen has appointed Two a Clock this Afternoon, for this House to attend Her, with their Address, at St. James's."

Jones versus James.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause wherein William Jones is Appellant, and Nicholas James Respondent, on Wednesday the Seventeenth Day of January next, at Eleven a Clock.

Grange, Leave for a Bill.

Upon reading the Petition of Joseph Grange, late of the City of Westminster, Brewer, and of Elizabeth his Wife, One of the Daughters of the Right Honourable John Lord Haversham; praying Leave to bring in a Bill, for the Sale of a Fee Farm Rent, and a Messuage and Lands:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners have Leave to bring in a Bill, as desired.

Hodie 1a vice lecta est Billa, intituled, "An Act for naturalizing Jacob Pechels, Elias Landes, Francis Lacroix, and others."

Dr. Watson's Writ of Error discontinued.

Whereas, by virtue of Her Majesty's Writ of Error, a Record of the Court of Exchequer was brought into this House the Fourteenth Instant, wherein Judgement is entered for the Queen, in an Information of Intrusion, against Thomas Watson Doctor in Divinity, and Johanna Watson; and whereas, by the Standing Orders and Rules of this House, the Plaintiff on all Writs of Error is to assign his Errors within Eight Days after the bringing of such Writs with the Records, which the said Thomas Watson and Johanna Watson have neglected to do: And Her Majesty's Attorney General acquainting the House therewith; and desiring, pursuant to the said Orders and Rules, "that it may be recorded, that the Plaintiffs have not prosecuted their said Writ of Error:"

It is thereupon ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Thomas Watson Doctor in Divinity, and Johanna Watson, shall lose their Writ of Error; and it is hereby discontinued; and that the Record shall be remitted to the Court of Exchequer, that Execution may be issued thereupon, as if no such Writ of Error had been brought into this House.

The Tenor of which Judgement, to be affixed to the Record to be remitted, is as followeth:

"Et postea, scilicet, Vicesimo Secundo Die Decembris, 1704, Anno Regni dictæ Dominæ Reginæ nunc Angl. &c. Tertio, usque quem Diem præd. Thomas Watson et Joanna Watson habuere Licentiam Error. in Record. præd. assign. venit Ed'r'us Northey Miles; Attorn. dictæ Dominæ Reginæ nunc General. et prædictus Thomas Watson et Joanna non vener. nec Error. in Record. præd. assignaverunt: Ideo consideratum est per eandem Cur. Parliamenti (eo quod præd. Thomas et Joanna Breve de Error. præd. non prosecut. sunt) quod Record. et Process. præd. in præd. Cur. Scaccar. remittantur pro Executione inde pro dicta Domina Regina fiend."

Then the House was adjourned during Pleasure, to attend Her Majesty with the Address.

After some Time, the House was resumed.

And the Lord Keeper reported Her Majesty's Answer to the Address, as followeth; videlicet,

Queen's Answer to the Address.

"My Lords,

"I shall direct a Survey to be made of the several Places mentioned in this Address, in order to lay it before the Parliament.

"What Forces can be spared from their Attendance here, shall be quartered upon the Borders, as they were last Year. I shall likewise give the necessary Directions upon the other Particulars of your Address."

Address and Answer to be printed.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Keeper of the Great Seal of England do give Order, That the Address of this House, presented to Her Majesty this Day, and Her Majesty's most Gracious Answer thereunto, shall be forthwith printed and published.

Adjourn.
