Dymock & al. versus Sir J. Hobbort. Judgement affirmed with Costs.

After hearing Counsel, upon the Petition and Appeal of Charles Dymock Gentleman, and James Selby Serjeant at Law, from a Decree of the Court of Chancery made the Nineteenth Day of May last, on the Behalf of Sir John Hobbort Baronet; praying the Reversal of the said Decree; as also upon the Answer of Sir John Hobbort, by his Guardian Henry Earl of Suffolke, put in thereunto; and due Consideration of what was offered thereupon:

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of the said Charles Dymock and James Selby shall be, and is hereby, dismissed this House; and that the Decree therein complained of shall be, and is hereby, affirmed: And it is further ORDERED, That the said Charles Dymock and James Selby shall pay, or cause to be paid, unto the said Sir John Hobbort (or his Guardian for his Use), the Sum of Ten Pounds, for his Costs.

Nixon & al. versus Clark.

Upon reading the Petition of Richard Nixon and Daniel Ireson, and the Affidavit of Thomas Simons thereto annexed; shewing, "That the Petitioners being prevented from certifying the Record on the Writ of Error in Parliament by the Default of Samuel Clark the Defendant therein; whose Attorney Opey being lately dead, and not having entered Judgement on the Affirmetur, but detained the same; the Petitioners had, by Order of this Honourable House on the Fourteenth Instant, Nine Days allowed for getting the same certified; but, though the said Order hath been delivered to the Persons who manage the said Opey's Affairs, yet they have not entered up the said Judgement, nor brought in the Affirmetur;" and praying, "That the said Samuel Clark may cause the said Judgement to be entered, or Affirmetur brought in, or that he may shew Cause to the contrary:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Samuel Clarke shall have Notice of this Petition.

Dibble versus Piper & al.

Upon reading the Petition of John Dibble; shewing, That John Piper and Jacob Bridger having recovered a Judgement against him in the Queen's Bench, and since affirmed in the Exchequer Chamber, the Petitioner hath brought his Writ of Error in Parliament, and assigned Errors, and alledged in Diminution, that there have been no Continuances or Warrants of Attorney, as there ought; and praying a Certiorari to the Lord Chief Justice of the said Bench, to certify whether the Continuances are duly entered, and the Warrants of Attorney duly filed, in that Cause:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said John Piper and Jacob Bridger shall have Notice of the said Petition.

Weedon Ford versus Reginam, in Error.

This Day the Lord Chief Justice of Her Majesty's Court of Queen's Bench and Mr. Justice Gold attended, and owned their Seals to the Bill of Exceptions in the Writ of Error depending in this House, inter Dominam Reginam et Will'um Weedon Ford.

Bp. of Derry and Ulster Society, Bill:

Hodie 3^a vice lecta est Billa, intituled, "An Act for settling the Right of several Parcels of Land and other Tenements, and of certain Fishings and Tithes of Fishings, in the Society of the Governor and Assistants, London, of the new Plantation in Ulster within the Realm of Ireland, and their Successors; and for settling a Rent Charge of Two Hundred and Fifty Pounds per Annum upon the Lord Bishop of Derry, and his Successors for ever."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.
