Ld. Wharton versus Squire & al.

Upon reading the Petition and Appeal of Thomas Lord Wharton, from an Order of the Court of Exchequer, dated the Fifteenth Day of July One Thousand Seven Hundred and One, on the Behalf of Robert Squire and Mr. Thompson; and praying, "That the said Order may be discharged and set aside, and put into the same State and Condition wherein it was when the Suits between the Parties were commenced:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Robert Squire and Mr. Thompson may have a Copy of the said Petition and Appeal; and shall and they are hereby required to put in their Answer thereunto, in Writing, on Saturday the Second Day of January next, at Eleven a Clock in the Forenoon.

Vesey's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for Sale of divers Lands, in the County of Kildare, and Kingdom of Ireland, being the Estate of Agmondisham Vesey Esquire, and his Two Daughters Anne Vesey and Henrietta Vesey, for the paying Debts and clearing Incumbrances charged thereon; and also for empowering the said Agmondisham Vesey to make Leates for any Term not exceeding One and Twenty Years."

Fane's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act to enable the surviving Trustees and Executors of the last Will and Testament of Thomas Fane Esquire, deceased, to pay an Annuity to Mildmay Fane, for his Maintenance and Education, till he shall attain his Age of One and Twenty Years."

ORDERED, That the Consideration of the said Bill be referred to the Lords Committees above named; and to meet at the same Time and Place.

Butler's Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for setting aside a Settlement, in order that Wm. Butler may have a good Conveyance of Lands from Raphael Whistler, according to the Articles agreed on."

ORDERED, That the Consideration of the said Bill be referred to the Lords Committees abovenamed; who are to meet on Monday the Fourth Day of January next, at the Place aforesaid.

Hindmarsh versus Everard:

After hearing Counsel, upon the Petition and Appeal of Richard Hindmarsh and Margaret his Wife, from a Decree made in Her Majesty's Court of Exchequer Chamber, the Seven and Twentieth Day of June in the Twelfth Year of the Reign of our late Sovereign Lord King William the Third, and several Reports and Orders made thereupon, in a Cause wherein Mary Everard the Mother, and Mary Everard the Daughter by her said Mother her Guardian, the now Respondents, were Complainants, and the Petitioners and others Defendants; and praying the Reversal of the said Decree, Reports, and Orders; as also upon the Answer of the said Mary Everard the Mother, and her Daughter, put in thereunto; and due Consideration of what was offered thereupon:

Judgement affirmed, with Costs.

It is ORDERED and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Richard Hindmarsh and his Wife shall be, and is hereby, dismissed this House; and that the Decree, Reports, and Orders, therein complained of, shall be, and they are hereby, affirmed: And it is further ORDERED, That the said Richard Hindmarsh and his Wife shall pay, or cause to be paid, unto the said Mary Everard and her Daughter, the Sum of Twenty Pounds, for their Costs in Prosecution of this Appeal.

Bendlows to attend, for Reflections in Appellants Case.

The House taking Notice, "That in the printed Case delivered this Day, intituled, ["Richard Hindmarsh and his Wife Appellants, Mary Everard the Mother and Mary the Daughter Respondents, The Appellants Case;"] there are reflecting Words against the Respondents;" and the House being also informed, "That Mr. Bendlows drew the said Case, and ordered it to be printed:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Bendlows shall and he is hereby required to attend this House, on Monday next, at Ten a Clock in the Forenoon.

Haberdashers Company versus Attorney General.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the Cause, wherein the Master and Wardens of the Haberdashers Company are Appellants, and the Attorney General and Inhabitants of the Parish of Newland, in Gloucestershire, are Respondents, on Friday the Eighth Day of January next, at Eleven a Clock in the Forenoon.

Lands in Brampton, to exchange for others in Wickham, Ravencroft's Bill.

The Earl of Stamford reported from the Lords Committees, the Bill, intituled, "An Act concerning the Exchange of certain Lands, lying in or near Brampton, in the County of Northampton, for Lands lying in or near Wickham, in the County of Lincolne," as fit to pass, with some Amendments.

Which were read Twice, and agreed to; and the Bill ordered to be engrossed, with the said Amendments.
