L. Herbert takes the Oaths.

This Day Henry Lord Herbert took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes.

E. Orford & al. versus Daston & al.

After hearing Counsel, at the Bar, upon the Petition and Appeal of the Right Honourable Edward Earl of Orford, Robert Lord Russell, and the Lady Letitia his Wife, William Bridges Esquire, and William Thornburgh, Executors of the last Will and Testament of the Right Honourable Francis Russell Esquire deceased, who intermarried with Katherine Lady North & Grey also deceased, who was the Widow and Executrix of the Right Honourable Charles Lord North and Grey deceased; complaining of several Orders of the Court of Chancery, of the Seventeenth of December One Thousand Seven Hundred and One, and the Second of June last, on the Behalf of Richard Daston and Henry Alnut; and praying, "That they may be discharged; and that it may be referred back to the Master, to make to the Petitioners an Allowance and Deduction of the several Sums of Seven Hundred and Two Pounds and Ten Shillings, paid to Mrs. Hatton; as also of the Sum of One Thousand Three Hundred Eighty-nine Pounds, Eleven Shillings, and Nine Pence, paid by the said Lady North, out of the Personal Estate of the said Lord North, before her Inter-marriage with the Petitioner's said Testator Francis Russell;" as also upon the Answer of the said Richard Daston and Henry Alnut put in thereunto; and due Consideration of what was offered thereupon:

Judgement reversed.

It is ORDERED, and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Orders complained of in the said Petition and Appeal shall be, and they are hereby, reversed, as to the said Seven Hundred and Two Pounds, Ten Shillings, and One Thousand Three Hundred Eighty-nine Pounds, Eleven Shillings, and Nine Pence.

Instructions to D. Ormond and Sir Geo. Rooke, to be laid before the House.

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Instructions given to the Duke of Ormonde and Sir George Rooke, relating to Cadiz and Vigo, be laid before this House on or before Tuesday next.
