ORDERED, That Mr. Gray and Mr. William King do attend this House on Tuesday next, at Ten of the Clock in the Forenoon, as Witnesses on the Behalf of Sir John Fenwick.

M. Normanby versus D. Devon.

The House this Day resuming the Consideration of such Matters of Fact as have passed, in relation to the Waiving of Privilege, in a Cause concerning the Purchase of Berkeley House, depending in Chancery, between the Marquis of Normanby, the Lord Berkeley of Stratton, and the Duke of Devonshire:

The Duke of Devonsh'r declaring, "That he would not insist on Privilege in this Case;" and the Marquis of Normanby and Lord Berkeley also declaring the same on their Parts; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That none of the said Lords shall have Privilege of Parliament in the said Cause, or in any Process or Proceeding to be had in relation thereunto.

E. Winchilsea, Leave to be absent.

Leave was given for the Earl of Winchilsea, to be absent till Tuesday next.

E. Lincoln versus Rolle & al.

Whereas Tuesday the Eighth Day of this Instant December was appointed for hearing of the Cause depending in this House, wherein Henry Earl of Lincoln an Infant, by Susanna Countess of Lincoln his Mother and Prochein Amy, is Appellant, and Samuell Rolle, Vere Booth, Hugh Fortescue and Bridget his Wife, Richard Wynne, Christopher Davenport, and George Townshend, are Respondents:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That Counsel shall be heard, in this Cause, on Thursday the Seventeenth Day of this Instant December, at Ten of the Clock in the Forenoon.

Lady M. Fenwick, Leave to go to her Husband.

Upon reading the Petition of the Lady Mary Fenwick; praying, "That she may have Liberty of going to her Husband Sir John Fenwick, now Prisoner in Newgate, and be with him in private:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Lady Mary Fenwick may go to her Husband Sir John Fenwick, and be with him in private, so as she continue in Prison with him.
