PRAYERS.

Low Wines, &c. Bill to explain the Act for Duties on, and to prevent Frauds in Brewers, &c.

Hodie 2a vice lecta est Billa, intituled, "An Act to explain that Part of the Act passed the last Session of Parliament, for laying several Duties on Low Wines, and Spirits of the First Extraction, and for preventing the Frauds and Abuses of Brewers, Distillers, and other Persons chargeable with the Duties of Excise, which relates to the Payment of Tallies, and the Interest thereof."

ORDERED, That the said Bill be committed to a Committee of the whole House, presently.

Then the House was adjourned during Pleasure, and put into a Committee upon the said Bill.

And, after some Time, the House was resumed.

And the Earl of Stamford reported, "That the Committee had gone through the said Bill; and think it fit to pass, without any Amendment."

Coin, ill State of, Bill for further remedying:

Hodie 2a vice lecta est Billa, intituled, "An Act for the further remedying the ill State of the Coin of the Kingdom."

ORDERED, That the said Bill be committed to a Committee of the whole House, presently.

Then the House was adjourned during Pleasure, and put into a Committee upon the said Bill.

After some Time, the House was resumed.

And the Lord Herbert of Chirbury reported, "That the Committee had gone through the said Bill; and think it fit to pass, with some Amendments."

Which, being read Twice, were agreed to.

Hodie 3a vice lecta est Billa, intituled, "An Act for the further remedying the ill State of the Coin of the Kingdom."

The Question was put, "Whether this Bill, with the Amendments, shall pass?"

It was Resolved in the Affirmative.

Protest against it:

Message to H. C. with Amendments to the Bill.

A Message was sent to the House of Commons, by Sir Miles Cooke and Sir John Francklyn:

To return the said Bill, and desire their Concurrence to the Amendments.

A Letter from Sir George Rooke was read, in relation to the Order made Yesterday.

Whereupon Sir George Rooke was called in, and told by the Lord Keeper, by Order of the House, "That the Lords think fit to have the Originals of the Letters and Papers laid before this House."

Waade versus Heath, in Error.

Upon reading the Petition of Sir Edward Baesh Knight and Dame Anne his Wife; shewing, "That there is a Writ of Error depending in this House, wherein Anne Waade is Plaintiff, and Charles Heath Defendant, brought only for Delay, and to prevent the Petitioners from taking out a Writ of Possession; and the said Anne Waade not having assigned Errors thereupon, as by the Orders of this House she ought to have done; and praying that the said Writ of Error may be remitted to the Court of King's Bench, to the End the Petitioners may take out a Writ of Possession on the said Judgement given in the Court of King's Bench:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Writ of Error, now depending in this House, wherein Anne Waade is Plaintiff, and Charles Heath Defendant, shall be, and is hereby, remitted to the Court of King's Bench, to the End the said Charles Heath may take out a Writ of Possession, as if no such Writ of Error had been brought into this House.

Judgement affirmed.

The Tenor of which Judgement, to be affixed to the Record to be remitted, is as followeth; (videlicet),

Postea, scilicet, Die Lunæ, Vicesimo Tertio Die Novembris, Anno Regni Domini Will'i Tertii nunc Regis Angl. &c. Octavo, usque quem Diem prædict. Anna Waade et Edward Stacey habuer. Licentiam ad Error. five Errores in Record. et Process. præd. assignand. prædictique Anna et Edvardus in eadem Cur. Parliament. solemnit. exact. non ven. nec sunt Brev. de Error. præd. versus præd. Carolum Heath. ulterius pros. Ideo per eandem Cur. Parliament. cons. est, quod prædicti Anna et Edvardus sint inde in Misericordia; et præd. Carolus eat inde fine Die &c. Et super hoc Record. et Process. præd. coram dicto Domino Rege in Parliamento suo, de et super Præmiss. hic per eandem Cur. Parliament. coram dicto Domino Rege ubicunque &c. remittuntur, &c."

Adjourn.
