Fowle versus Cope & al.

Upon reading the Petition of Reginald Bretland Serjeant at Law, and Robert Fowle, Executors of the last Will of Sir Thomas Fowle; shewing, "That a Bill in the High Court of Chancery was brought against them and John Berkeley Esquire, by Jonathan Cope and others; and a Decree obtained, that the Petitioners should pay the Value of Three Thousand Four Hundred and Eighty Pounds, formerly paid to the Plaintiff's Mother; and the Master was to allow a reasonable Maintenance for the Plaintiffs, and to tax their Costs: That the Petitioners, together with the said John Berkeley, being advised the said Decree was therein Erroneous, appealed to your Lordships; and upon hearing the said Appeal, your Lordships were pleased to affirm the said Decree, wherein your Petitioners do acquiesce: And upon hearing the Matter touching Costs, by the now Lord Keeper of the Great Seal of England, the Thirteenth of July last, his Lordship would not deliver any Opinion therein, but directed your Petitioners to apply to your Lordships:"

Whereupon it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Jonathan Cope and other the Respondents in the said Appeal may have a Copy of the said Petition; and do put in their Answer thereunto, in Writing, on Wednesday the Fifth Day of March next, at Ten of the Clock in the Forenoon.

Box's Bill, for a Divorce.

Hodie 1a vice lecta est Billa, intituled, "An Act to dissolve the Marriage of Ralph Box with Elizabeth Eyre, and to enable him to marry again."

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Bill shall be read a Second Time on Wednesday the Twelfth Day of March next, at Eleven of the Clock in the Forenoon; and that this Order be fixed on the Door of this House.

Tidcombe, Leave to attend his Appeal against Bodington.

Upon reading the Petition of John Tidcombe Esquire; shewing, "That he hath an Appeal depending in this House; but, being in Custody in The Fleet Prison, cannot attend the same, without your Lordships Order; and praying, that he may have his Liberty, to prosecute the said Appeal:"

It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said John Tidcombe shall have Leave, with his Keeper, to attend and prosecute his said Appeal, while it shall be depending in this House; and this shall be a sufficient Warrant on that Behalf.

To the Warden of The Fleet, his Deputy, or Deputies, and all other his Underofficers, whom this may concern.

The Lord Chamberlain, by His Majesty's Command, delivered Copies of Treaties, and Translations of them; (videlicet,)

1. "Treaty of Defensive Alliance between England and Holland, 3d March, 1677/8."

2. "Renewal of the Treaties between England and The States Generall of the United Provinces, 17th August, 1685."

3. "Renewal of the Treaties of Alliance between England and Holland, 24th August, 1689."

And also Ten Papers, being Five in English, and Five in French:

1. Intituled, "Ratification of the Treaty in English and French."

2. "The Ratification of the separate Article, in English and French."

3. "The Ratification of the secret Article, in English and French."

4. "The King's Declaration, English and French."

5. "The Dauphin's Declaration, in English and French."

Squadron desired by The States:

The House went into Consideration of the adjourned Debate Yesterday, concerning the Squadron desired by The States in their Memorial.

The States pressed to fit out their Fleet.

The Lord Chamberlain, by His Majesty's Command, acquainted the House, "That the King had given Order to His Minister in Holland, to press the sitting out their Fleet, according to the Treaty."

Adjourn.
