E. of Lincoln, for the Murder of Webb, Recognizance.
This Day, the Lord Chief Justice of Their Majesties Court of King's Bench at Westminster having brought into this House, by virtue of Their Majesties Writ of Certiorari, the Tenor of a Recognizance entered into before his Lordship, the Eight and Twentieth Day of February last, by Edward Earl of Lincolne and his Sureties, for his the said Earl's Appearance in Parliament, to answer the Felony and Murder of Anthony Webb; as also the Coroner's Inquest and Proceedings upon the Trial of Thomas Atkins and Thomas Selby, at the last Newgate Sessions, concerning the same, whereby it appeared, "That the said Thomas Atkins (who was supposed to do the Fact) and Thomas Selby were acquitted, and that the said Anthony Webb died by the Visitation of God;" and the Earl of Lincolne, appearing according to the Condition of the said Recognizance, desired the same might be discharged, and that his own Recognizance might be taken for his Appearance for the future.
After Debate thereupon,
This Question was put, "Whether the Earl of Lincolne's own Recognizance should be taken in this Case?"
It was Resolved in the Affirmative.
And ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Earl should be discharged from any further Appearance, by virtue of the said Recognizance so entered into by him and his Sureties as aforesaid; and that the said Earl's Recognizance of Four Thousand Pounds should only be taken, with Condition to appear in Parliament on the First Day of the next Session of Parliament, and so from Day to Day until he be discharged; which Recognizance the said Earl did enter into accordingly, and followeth in these Words; (videlicet,)
"Ed'r'us Comes Lincoln. recognovit se debere Domino Regi et Dominæ Reginæ Quatuor Mille Libr. legal. Monet. Angl. fieri et levari de Bonis et Catoll. Terr. et Tenement. suis, sub Conditione sequen. (videlicet,)
"The Condition of this Recognizance is such, That if the abovesaid Edward Earl of Lincolne shall personally appear in Parliament on the First Day of the next Session of Parliament, and so from Day to Day until he shall be discharged, then the said Recognizance to be void and of none Effect; or else to remain in full Force."
Writs of Error brought in.
The Lord Chief Justice of Their Majesties Court of King's Bench, in the usual Manner, brought in Two Writs of Error:
One, Edmund Winder & al. Plaintiffs, versus Roger Swindlehurst Defendant.
The other, Thomas Thompson Plaintiff, versus Simon Leach Defendant.
The Earl of Nottingham acquainted the House, "That Her Majesty had sent a Commission for the proroguing the Parliament."
Then the Lords Commissioners, in their Robes, being seated on a Form, placed between the State and the Woolsack; the Lord Privy Seal in the Middle; and the Earl of Bridgewater, Earl of Bath, Earl of Macclesfeild, and the Earl of Nottingham on his Right Hand; and the Lord Great Chamberlain, Lord Chamberlain, and the Earl of Bedford on his Left Hand; commanded the Gentleman Usher of the Black Rod to go to the House of Commons, and let them know, "That the Commissioners desire them to come and be present, to hear the said Commission read."

De Fidelitate igitur, Prudentia, et Circumspectionibus vestris plurimum confidentes, de Avisamento et Assensu Concilii Nostri, assignavimus vos Commissionarios Nostros; dantes vobis, et aliquibus Tribus vel pluribus vestrum, Tenore Præsentium, plenam Potestatem et Auctoritatem, hoc instante Die Martis, præsens Parliamentum Nostrum, Nomine Nostro, ad et in Vicesimum Quartum Diem Maii jam proxim. futur. usque prædictam Civitatem Nostram Westm. prorogandum et continuandum, ibidemque tunc tenendum et prosequendum; et ideo vobis mandamus, quod circa Præmissa diligenter intendatis, ac ea in Forma prædicta effectualiter expleatis.
