E. of Montagu & al. versus E. of Bath & al.

Upon reading the Petition and Appeal of Ralph Earl of Montagu, Elizabeth Dutchess of Albemarle his Wife, Christopher Monck and Henry Monck Esquires, by Mary Monck their Mother, next Friend, and Guardian, from a Decree of Dismission made and pronounced in the Court of Chancery, the Two and Twentieth of December last, in several Causes there depending, wherein the Petitioners were Plaintiffs; and John Earl of Bathe, Sir Bevill Grenvill Knight, Bernard Grenvill Esquire, Sir Thomas Clargis Knight, Sir Walter Clergis Baronet, Thomas Clergis his Son an Infant, Arthur Farwell, Monck Rawlinson Esquire, Thomas Pride Esquire, and others, Defendants; and praying the Reversal of the said Decree:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Earl of Bathe and other the Defendants abovementioned may have a Copy of the said Petition; and put in their Answer or respective Answers thereunto, in Writing, on Wednesday the Seventeenth Day of this Instant January, at Ten of the Clock in the Forenoon.

Ld Mayor, &c. of London versus Gulston's Bill, for breaking Pavement in Southwark, to supply it with Water.

Upon reading the Petition of the Lord Mayor and Aldermen of the City of London; shewing, "That there is a Bill brought into this House, intituled, "An Act to empower William Gulston Esquire to break up the Streets and other Public Ways in Southwarke, and Parts adjacent, for repairing and laying of Pipes for supplying of Water from the River of Thames to the Inhabitants there;" and conceiving themselves to be legally entitled, not only to the Waste, Soil, and Streets, but to the said Pipes also; and praying to be heard, by their Counsel, concerning the Premises:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Mayor and Aldermen of the City of London shall be heard, by their Counsel, as desired, against the said Bill, as also Counsel for the Bill, on Monday the Fifteenth Day of this Instant January, at Ten of the Clock in the Forenoon.

Keymer versus Penny.

Upon reading the Petition of Mary Keymer, Respondent to the Petition of Edward Penny; praying the Dismission of Penny's Appeal depending in this House:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Clerks give an Account what Proceedings have been in this Case, Tomorrow, at Ten of the Clock in the Forenoon.

Then the Orders being read, for the Admirals (who commanded the Fleet the last Summer) and several others, in relation to the last Summer's Expedition at Sea, to attend;

And after hearing of Captain Rutter, and several others on his Behalf; as also the Three Admirals, and others on their Behalfs, the following Order was made:

"It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the House shall proceed on this Business again To-morrow, at Twelve of the Clock, after the Cause appointed to be heard."

Sir R. Dutton versus Howell, in Error.

The Lord Chief Justice Holt, in the usual Manner, brought in a Writ of Error; wherein Sir Richard Dutton is Plaintiff, and Richard Howell and others Defendants.

King's Answer to Address for Papers.

The Lord Steward reported, "That he had waited on His Majesty, with the Address of the Second Instant; and His Majesty's Answer was, That the Reports should be sent, as desired."
